Despite good intentions from section 49(2) the definition of a journalist encroaches on rights of non journalists to disseminate and receive information.

We have constitutional rights to give and receive information from anywhere accreditation of journalists notwithstanding.

Section 49(1)(d) is unconstitutional for violating freedom of expression

Section 49(2) is good law for it decriminalizes any form of criticism against the government, public policy or even the constitution

Looks like section 49(2) leaves its preceding section 49(1) gasping in constitutional pariah land!

Board of accreditation is ministerial appointees being responsible of accrediting all members of the so called "INDEPENDENT MEDIA COUNCIL" Can that council really be independent?

Independent Council only in titular because the Board can easily revoke accreditation of one of the council leader and create a vacancy there.
