Huyu inabidi kila anapokuwa ni lazima kuwepo na gari la kubeba choo au avae bukta za kuzuia choo kisidondoke. Mgonjwa wa namna hii, kweli ana sifa ya kuendelea kuwa askari?
 
Kabla ya kulaumu hebu tujuzwe kwanza endapo kwenda chooni mara kwa mara ni afya au ugonjwa.

Learned brother, that is basically how the system should work but trust you me - none of these witnesses will be purged! It is unfortunate that truth is measure by the verdict (just after final submissions) and not during the process (including during testifying and cross-examination). You will have noticed a retained lawyer cannot use words like "you are lying". Witnesses do not refuse to answer truthfully, they deceitfully say "I do not know, i am not aware" etc. They choose not to divulge information and there is no way the judge can tell between a lie and truth. Predetermined positions from prosecution are all over and contradictions are rampant - they you hear prosecution demanding restrictions on defense's line of questioning. You hear repetitions being curtailed even though wanting to check previous answers is one way to ensure consistency.

I want to believe the way our laws are written is top class. When it comes to how proceedings go - this is a different ball game altogether. A judge is told we cannot have a witness in court and all he says is "hakikisheni anafika mahakamani". A witness says "I have a movement order in a hotel room" and a judge does not demand its presentation in court to prove defense right or wrong. And the thing dies just like that and the witness disappears into the woods!!

If a witness does not tell the truth, they are not helping the judge reach a just verdict and the judge is responsible for dispensing justice!! A lie-telling witness must be purged! The problem is how does the judge know if all they do is listen to arguments instead of asking follow up questions to unearth the truth?? I so very much want the judges to be involved and ask important questions! You will have also known that only one piece of a mishap in court proceedings could force a mistrial submitted by the defense and the judge can award that. In our case, there will not be a mistrial if a judge mentions a court case, the court run will have to end with conviction or no conviction. Our justice system as a whole has a long way to go.
