In Summary

  • Family pathologist given special clearance to participate in post-mortem examination just hours after arriving from the UK

Seven pathologists on Tuesday took part in the post-mortem examination of Makueni Senator Mutula Kilonzo, whose death has plunged the nation into mourning and speculation.

The team of doctors - one of the largest ever to investigate the cause of a person's death in Kenya - included British pathologist Calder Ian Maddison, who was flown into the country by the family on Tuesday.

The Medical Practitioners and Dentists Board issued Dr Maddison with a special license allowing him to take part in the examination.

The lead investigator is the
Government Pathologist, Dr Johansen Oduor. The examination was delayed on Monday to allow Mr Kilonzo's relatives to appoint their own doctor.

The other doctors include
Dr Luke Musau, Dr Frederick Okinyi of Thika Level 5 and Dr Dorothy Njeru.

Others were
Dr Andrew Kanyi Gachie and Dr Emily Rugena.

On Tuesday evening, they addressed the media, saying they had agreed on the preliminary findings and that results of further tests would be ready in eight to 10 weeks.

Also present at the post-mortem were homicide detectives from the Criminal Investigations Department, Assistant Commissioner of Police Pius Macharia and Superintendent Japheth Maingi.

Police told the Nation that they were pursuing four possible causes of death.

"We are exploring
suicide, heart attack, poison or an overdose of drugs as all these point to the condition his body was found in," said a detective on the case, who cannot be named because officers are not allowed to comment on an ongoing investigation.

Mr Kilonzo was found dead lying on his back with some evidence of foaming at the mouth and vomiting on the bed, in the room and a sink in his bathroom.

According to Dr Oduor, poisoning may cause nausea, vomiting, pain, troubled breathing and abnormal skin colour. Poisoning can be through the skin, by breathing, by injection or through a snake bite.

A heart attack can also cause nausea, vomiting and sudden dizziness, he said, adding that foaming on the mouth is commonly associated with epilepsy, trauma and snake bite, among others.

On Tuesday, the Director of Public Prosecutions, Mr Keriako Tobiko, constituted a legal team to guide the investigations.

By Tuesday evening, there was no word on the doctor's findings, but detectives said they were questioning the workers who were in the compound with the senator on the day of his death.

Detectives will be testing the consistency of the statements given by the workers about what actually transpired.

Senator Johnstone Muthama of Machakos, who is chairing the burial committee, said the rising number of unresolved and sudden deaths had prompted the family to seek the opinion of an independent expert.

Meanwhile, preparations are ongoing for the burial of Mr Kilonzo at his ranch next week. The Provincial Security and Intelligence Committee said more than 600 police officers will be at the ranch.

The team visited the ranch on Tuesday, 47 kilometres from the city, to plan access, parking, security and other details, including the protection of the wildlife on the property.

Mr Kilonzo kept a variety of animals, including cheetahs and lions.

"We want to guarantee security during the burial and that is why we are making early arrangements," provincial police officer Marcus Ochola said.

The senator was found dead by his long-serving cook, who alerted Mr Chris Musau, the senator's brother-in-law and proprietor of the neighbouring Maanzoni Lodge.

Workers have told the media that the senator drove himself into the ranch last Friday at 3pm. More than 60 employees live and work on the ranch.

The workers described the senator as "jovial" as he inspected their work.

"He alighted and went round the flower beds, giving instructions here and there on how best the place should look," one worker said.

He was served his favourite food, maize and beans, but also asked for roast meat, which was prepared for him. He also ordered breakfast for the following morning.

When workers realised that he had not woken up at his usual time of between 9 and 9.30am, they went to his bedroom after calling out and getting no response.

Mr Kilonzo loved country life and spent his weekends at the ranch.

The Boss,

This is to answer you from a previous mention in another post. My inner instinct tells me this guy has been offed by the powers that ride in Kenya's corridors of power. Unajua the Kenya Government has taken its people for granted for a long time in regards to these unresolved deaths...some which carry the tag of political assasination. Imagine mpaka leo there is no tangible official government report as to who killed Tom Mboya, J.M. Kariuki, Pio da gama Pinto, Robert Ouko, Professor Mbadi, George Saitoti...sasa kwenye hio orodha ongeza Mutula Kilonzo.

Somebody needs to explain to me why Dr Johansen Oduor is leading this so called investigation? This is the same character who advised the other pathologists handling the Saitoti autopsy not to include the 'cherry-pink tissue findings' in their final report!!!...Pray do tell, how Im I supposed to trust this man who claims (and I believe him to the T) that he got a phone call from Gichangi, the NSIS spook, not to tell Kenyans so to speak that Saitoti's death was suspicious based on the evidence deduced by the autopsy findings....Why should we trust his report this time around knowing very well that Gichangi can call upon him to doctor (pun intended) the results this time around?

WAS MUTULA KILONZO AN ICC WITNESS? | MY254

Secret Mutula died with

By Standard Team

Nairobi, Kenya:
There is a secret so big that Makueni Senator Mutula Kilonzo will take to hisgrave. It is a story he warned Standard reporter Roselyne Obala would shake Kenya.

Though he refused to give details, the late Senior Counsel insisted to Obala the story would not only surprise Kenyans, but could have major consequences.

That was on March 28 after Mutula was sworn in as Senator. A
post-mortem scheduled to be carried out on his body Monday will seek to establish why he died suddenly, and without making even a single call to family or friends for help.

Mutula was explaining how they intend to take on the National Government over the implementation of the Devolution,
"when he suddenly diverted and stated that there is a lot going on that Kenyans need to know,'' Obala went on.

Mutula told her that it is no secret that the National Government is trying to frustrate the implementation of Devolved Government. "

It was at this juncture that his tone changed, he looked serious and stated;
"I have information that if I disclose to you Monday, your papers will be burnt the next minute."

The statement came as a surprise, but when Obala pressed him, because she was curious to know more, and even offered not to name him in the story, Kilonzo retorted: "No, No, No."

She pleaded with him, saying, "Please Mheshimiwa (Honourable), I will use an anonymous source," he declined.

When she insisted he reiterated as they walked down the stairs: "Save the company (Standard Group Limited) and yourself. I promise to give you the information at the right time."

Finally hebu nambie, post mortem gani inachukua miezi miwili jamani?...ama ni kwa vile nimekaa unyamwezi siku kibao nimezoea mambo fasta fasta?...It is highly plausible that whatever comes out of this report will be doctored to satisfy some quarters. Kudadeki wakenya!

Revealed: Assassins Were After Mutula Kilonzo, Raila Odinga And Johnstone Muthama

Machakos Senator Johnstone Muthama on Tuesday revealed that the late Makueni Senator Hon. Mutula Kalonzo had expressed fears about his safety. Muthama said the late Mutula warned that his life and that of the former Prime Minister Raila Odinga alongside his very own were in danger.Muthama made the allegations on the floor of the senate.

The late Mutula revealed the plot to kill the three leaders on Thursday afternoon at a hotel in Nairobi where he had lunch with Raila, Muthama and Kitui senator David Musila.

Muthama has not yet made a formal statement to the police or the investigating officers, his revelations collaborate Raila's testimony that he had lunch with the late senator less than 48 hours before he was found dead.

It is not yet clear if the assassination claims on Mutula, Raila and Muthama were the big secret that the late senator had hinted to Standard Newspaper a journalist during the swearing in of senate members.

Hon Muthama did not however disclose if Mutula indicated who wanted them killed.

Meanwhile MPs have asked the government to ensure it unravels the mystery surrounding Mutula's sudden death.

Sources close to family members told disclosed that the late Hon. Mutula had expressed fears for his life during the week leading up to his death, including the day he died. This was after having retired to bed at about 7.30pm the previous night after enjoying his favourite meal.

The late senator was later to be found lying dead in bed by one of his workers with foam on his mouth when he failed to wake up as usual after 9am. There were also traces of blood on his vomit, a friend of the family who was at the scene revealed.

June last year the late Senator updated his Facebook thus
"Only God protects his own,i will always stand for the truth and for Kenyans at large despite all the threats coming from the forces of Darkness who want to bring down this wonderful country of ours. But God will stand with us Kenyans.God bless our beloved country…"

Mutula links death threats to ICC

By MWAKERA MWAJEFA mmwajefa@ke.nationmedia.com
Posted Saturday, June 30 2012 at 21:17

Education minister Mutula Kilonzo has attributed the threatening text messages sent to him and members of his family to his stand on a number of politically sensitive issues.

In an interview with the Sunday Nation, Mr Kilonzo, the former Justice minister, cited his outspoken stand on Kenyan cases at the International Criminal Court (ICC), free education funds and constitutional reforms as possible reasons he was being targeted with death threats.

He spoke on the sidelines of the Kenya Secondary School Heads Association meeting in Mombasa on Thursday.

Last week, the minister told Parliament that he had received two messages from unknown people, threatening to kill him, on Tuesday.

Mr Kilonzo said that his wife and daughter had also received similar messages.

"I am not like Martha [Karua] who bowed out of the Ministry of Justice and Constitutional Affairs under pressure. I am a hard nut to crack. That is why they removed me from the ministry because of my stand on ICC trials," he said.

"I am the first sitting Cabinet minister to receive such messages in the history of this nation."

Mr Kilonzo vowed to get on with his life, saying that conceding to the threats would hand the people behind the messages a leeway to control him.

"Fear is the key that is used to control the human will and resolve. Brave people die only once but cowards die very many times," he said.

"Their messages are horrifying for a soft heart because they threatened to rape my wife and daughter before killing me in cold blood."

Mr Kilonzo said he received the first message at his Jogoo House office in Nairobi on his way to Parliament but ignored it. The second message followed at 4.20 p.m. while he was in the House.

"This time round I could not keep it to myself so I shared the two messages with my Cabinet colleagues and Speaker Kenneth Marende," he said.

The sender, who did not identify himself or herself, claimed to be working under the instructions of a ‘boss' he named and who works at a firm on State House Road.

The boss, according to the sender, has connections to the Al-Shabaab terror group.

The sender alleged involvement in the recent kidnapping of Imenti Central MP Gitobu Imanyara, the bombing of Assanands House and the explosion at a church in Ngara, Nairobi.

The minister recorded statements with the police, the CID director and the National Security Intelligence Services (NSIS) on Wednesday after consultations with close associates.

While at the Justice ministry, Mr Kilonzo was outspoken for his firm stand on the ICC trials and repeatedly advised Kenyans facing charges to cooperate with the court.

Kwahiyo sababu wanazochunguza ni mbili yaani poisoning and acute vascular disease/accident.

52 samples taken in Mutula death probe

Doctors collected 52 samples for testing to establish the cause of Makueni Senator Mutula Kilonzo's death.

A source close to the family and a doctor involved in the investigations said they would conduct a wide range of tests, including for the sophisticated poison, Polonium 210.

All the tests will be conducted locally and no samples will be sent abroad.

Polonium 210 is a deadly radiation poison, which causes victims to waste away and to lose hair and teeth. Because of its highly radioactive nature, normally areas visited by a polonium victim are quarantined to prevent further poisoning.

Government pathologist Johansen Oduor declined to comment on the polonium reports.

"We will carry as many tests as possible to remove any doubts. The tests are informed by what we saw," Dr Odour said.

The analysis of the samples has started at the Government Chemist, he said, and results will be expected in eight-to-10 weeks.

"No sample will be taken out of the country as all the samples collected can be analysed locally," he said.

The tests will confirm the cause of death and rule out other possibilities.

The samples included the nail, hair, tissues from the bone and skin, saliva, urine. Three different samples were collected for the police, the visiting foreign pathologist, and for preservation.

The pathologists were reported to have agreed on the cause of death and want to offer a conclusive report after the analyses have been done.

Detectives now have over 100 samples collected both from the scene of death and at the mortuary during the autopsy.

In Maanzoni, detectives collected some pieces of meat, charcoal that was used to roast the meat, the plates used to serve the food, water and two soft drinks.

The family yesterday expressed optimism that the death would be resolved, partly due to the involvement of Dr Ian Calder and Dr Emily Rogena.

"Dr Calder provided leadership and insisted that as many samples as possible had to be collected," a family member who attended the post-mortem said.

Dr Rogena, a senior lecturer at the Department of Human Pathology at the University of Nairobi, was among the team of pathologists who took part in the post-mortem examination of marathon star Samuel Kamau Wanjiru. She also testified at the commission that investigated the circumstances surrounding the deaths of Prof George Saitoti, Mr Orwa Ojodeh and four police officers in a helicopter crash last year.

Polonium 210 hit the headlines when it was used to kill KGB agent-turned-Kremlin critic Alexander Litvinenko in London in 2006.

Litvinenko suffered nausea, hair loss, throat swelling and pallor, all said to be typical effects of the poisoning. In July last year, Yasser Arafat's widow called for the Palestinian leader's body to be exhumed after scientists in Switzerland found traces of Polonium-210 on clothing he allegedly wore before his death in 2004.

It is not clear whether the pathologists observed any of the symptoms of radiation poisoning on Senator Kilonzo or whether they merely wished to rule it out.

Police have questioned four employees at the Maanzoni ranch. A source close to the investigation said those interviewed are the farm manager, a cook, a supervisor and the housekeeper. More employees are lined up for police interviews with the aim of testing consistency in their accounts on what happened on the material day.

The investigation is headed by deputy head of the Serious Crimes Unit at the directorate of criminal investigations headquarters in Nairobi. The police would also want to establish if there were any persons who visited the farm on Saturday when the Senator was found dead.

Wonderful and I agree 100%. These theories dont make sense and infact they add to one thing. This dude was poisoned! And now listen to the slithery language of the political killers in Kenya. Just like in the days of Robert Ouko's death it is always the same - ABSURD!!!....How does one intending to commit suicide run to the bathroom to vomit in a sink and then return to his bed? And a heart attack which allows you to run to the bathroom, vomit and then return to the bed and continue sleeping peacefully till you pass out in your sleep? WHY NOT CALL FOR MEDICAL HELP INSTEAD PASSING OUT IN YOUR SLEEP?

Add that to theory that such an intelligent person like Mutula would mistakenly take a drug overdose. That would be equivalent to suicide which is already out as stated above! Give me another one.

Did somebody sneak into his bedroom and spray poison in the room which he then inhaled? His bedroom door was not locked from the inside on this occasion contrary to the standard norm. Or was the poison administered through food/drink? And what are the 600 police officers going to do at the burial site? Is there a security threat expected on that day? Kenya is slowly but surely turning into a police state! It is always police, police everywhere, yet Kenyans die everyday in large numbers due to lack of security.....When you need the help of police officers, you don’t see them.....But when the Supreme Court is about to deliver its judgement, the whole city is a no-go-zone for ordinary Kenyans but teeming with police officers everywhere one looks!

What a paradox for my Country!!
