Nasikiliza taarifa ya habari bbc. Aliyekuwa Naibu Jaji Mkuu wa Kenya leo amekamatwa kwa tuhuma za kifisadi na rushwa...hii haikuwa habari kubwa ila lililonigusa ni haki aliyopewa mtuhumiwa...baada ya kukamatwa alienda kuhojiwa na baadae kufikishwa mahakamani ula muda wa mahakama ulikuwa umeisha hivyo asingeweza kusikilizwa wala kuomba dhamana ila ameachiwa huru kwa kusaini tu baadhi ya masharti.

Sababu za kuachiwa ni kwamba muda wa mahakama ulikuwa umeisha na hivyo hata kama angepata dhamana ya kuweka bondi pesa mabenki yalikuwa tayari yamefungwa hivyo kungezuia haki yake ya kupewa dhamani..hivyo kuachiwa kwa masharti..

Nimejifunza kitu hapa tz mtu anakamatwa mpaka watu waseme apelekwe mahakamani inafikia hatua magereza wanasema hawana gari la kubeba watuhumiwa kupelekwa mahakamani kwa ajili ya dhamani au mambo mengine hivyo watuhumiwa kusota rumande na kunyimwa haki zao za msingi.

Mtu amekamatwa asubuhi kahojiwa mchana na kupelekwa mahakamani pamoja na kuwa muda wa mahakama ulikuwa umeisha lakini amepewa haki yake ya dhamana.. Tujifunze hili watz haki za watu hasa katika mahakama na polisi pale mtu anapokuwa hajatiwa hatiani kwa kosa.

The only person who cannot be arraigned in court in Kenya due to the office they hold is the President himself. Any charges against him will be heard after leaving office. As for the deputy President and every other Kenyan the law applies fully and without bias.

Now to what you have stated about the commission (Judicial Service Commission), they will only hear matters pertaining to complaints as to a judge's competence and abuse of office. They have NO authority to hear ceiminal matters, which is what the deputy Chief Justice is Facing currently.

There is absolutely no legal provision that a sitting judge has to be dismissed first before appearing in court to face charges.

I never said any supreme court Judge is immune from prosecution..however the procedure to bring a supreme court judge before a court for any matter(civil or criminal) that adversly affects their oath of office or brings their integrity into disrepute is well decribed in the constitution and the JSC Act.
DPP never followed the law, and fortunately The highcourt has suspended the unlawful prosecution.

I still haven't come across any Articles of the constitution (under Chapter 10) or Sections of any statute that provides for the same.

If you might know them kindly inform me of the same. I will highly appreciate it.
