RE: AN OPEN LETTER ON THE STATE OF THE NATION AND CORRUPTION.

We write to you as patriotic citizens in good faith, to share our deepening concern regarding a number of issues which in our humble view threaten the soul of our beloved Nation. We do this cognizant of the fact that your administration has been in office for only nine months, and in addition to presiding over the implementation of a new constitutional dispensation and managing the execution of devolution in the face of high expectations by an impatient population. Amidst the plethora of challenges, it is our humble opinion that Kenya is not at a crossroads as doomsday sayers opine, but that we have reached a critical tipping point, hence our decision to address your Excellency on some critical issues that affect our Nation.

Corruption

Corruption has always been a Cancer in our Country's body politic and numerous are the unresolved scandals that continue to haunt our Nation. While the ghosts of ‘Goldenberg', ‘Anglo Leasing', ‘Maize', ‘Kazi kwa Vijana' continue to dance their macabre dance of defiance; over the past few months the Country has been seized in the thrall of the proposed new ‘Standard Gauge Railway Project' from Mombasa to Nairobi. No sooner had your Excellency launched the noble and timely project with pomp and circumstance than critical ethical issues were raised from within your administration. For example, evidence tabled before the Parliamentary Investment Committee (PIC) suggests that the contracted Company has questionable credentials, and the project cost is unclear and inflated. Given the whiff of irregularity, it is our submission that it would be prudent to immediately terminate the current process, and begin a transparent process afresh, so as to ensure efficiency and value for money.

Your Excellency's administration took office on the promise of making a break from what you described as the ‘analog' past to embrace a new ‘digital' future with zero tolerance for Corruption. It is therefore worrying that under your watch a possible scandal of gigantic proportions is consolidating the widespread perception that every Kenyan President must as a way of ‘initiation' into Office, preside over a mega corruption scandal that costs Kenyans dearly. These perceptions are easily tribalised and politicized in a manner that may make governance more difficult, to the detriment of the Country. We therefore respectfully urge your Excellency to immediately suspend the project and to make all documents germane to the Railway Contract public for scrutiny. This, in our view, will enhance your stature and spare you history's indictment.

Cost of Living

The age old adage is that, ‘a hungry man is an angry man'. Indeed, in the last few days we have seen Kenyans vent their anger in the streets of Mombasa, Meru, Thika, Machakos, Nairobi and many more will come because of a sense of despondency. Taxation measures designed to raise money without due regard to the already unbearable cost of living will only exacerbate the situation. While we respect and even admire your administration's desire to sustain the Country on a rapid growth trajectory, we urge you to keep public servants on a short leash and to reign in your Government officials from engaging in corrupt practices and arrant profligacy amidst sorrow and want of the majority of the Population. In the recent past, we have seen the International Monetary Fund (IMF) Supremo, whom we respect in town. If history is a good teacher, we learn from her that the long-term health of our nation not only requires but demands that we wean ourselves off the IMF, which has a history of capturing Government policy and prescribing unpalatable solutions.

Insecurity

Each and every Kenyan is mindful of the rampant insecurity that continues to plague every corner of our Nation. No-one, regardless of their station in society is exempted from the vagaries of the opportunistic criminal such as theft, carjacking, & robbery, or horrific atrocities such as that which unfolded at Westgate last September. That senior police officers are currently undergoing vetting is positive, and indicative of your administration's cognizance of the reforms required in the security sector to improve the capacity of the Police to provide security to all Kenyans, across the country. We are also sensitive to the fact, however, that the Police is one of our ‘disciplined forces'. As such members are not so much ‘retrenched' like as in a private company but rather demobilized with due dignity.

One of the most critical institutions in the country, the Jomo Kenyatta International Airport, has in recent months been plagued by a number of incidents, ranging from the fire that consumed the International Arrivals building, to an explosion, and the discovery of sensitive security equipment in an airport toilet. The dearth of official communication on these matters exacerbates the trepidation of the public, and creates an impression not of laxity, but rather inability to secure one of the most important installations on Kenyan soil. With the memory of Westgate so fresh in our minds, it is incumbent upon the relevant organs within your administration to communicate accurate and confirmed information to the public in order to stem speculation. Furthermore, full investigation of such incidents, as well as the responses thereto must be conducted and reports made available for public scrutiny. Your Excellency, we have written this humble letter not because we have monopoly of wisdom but because like you, we love this Country and we have a patriotic, moral and constitutional duty to protect Her even with our lives.

Just think about that for a fleeting moment.The economic multiplier would be of gigantic proportions.

Okay so Kamau and Nduva convinced the chinese to force KPA to commit them to transport cargo thro the new
line; never mind KPA doesn't own any cargo. Let's even assume all 18-20M tonnes of cargo that land annually in Mombasa port is transported through the diesel powered SGR to Nairobi....at the currentmuneconomical rate of 8shs per tonne per Km...to Nairobi's KPA inland port. 20M*8shs*450Km=72B ksh per annum; now remove the operating expense to
get rail running; maybe out of 8shs; KR will use 4shs; make that 36Bshs per annum profit; pay the loan at those rate; close to 50B; That is already loss making TAZARA line or our lunatic express..

And we have assumed 100% of cargo is destined to Nairobi and KPA can force importers to load cargo to Nairobi; KPA
can also force exporters to drop their cargo in NAirobi ; and we have given them current transport rate...negating
why we need the rail.

We need to see the damn feasibility studies.

The Jubilee administration is facing increasing pressure over corruption allegedly taking root at high levels and influencing tenders worth billions of shillings.

The latest salvo was fired Sunday when Uongozi, an advocacy group associated with the former anti-corruption czar John Githongo, wrote an open letter to President Uhuru Kenyatta asking him to suspend the Sh425 billion Mombasa-Malaba railway project until all questions that have been raised over the tender are answered.

"We write to you as patriot citizens in good faith, to share our deepening concerns regarding a number of issues which in our humble view threaten the soul of our beloved nation," the group said in the letter signed by Mr Githongo, Dr PLO Lumumba and Mr Tom Mboya.

"We have reached a critical tipping point hence our decision to address you... Given the whiff of irregularity, it is our submissions that it would be prudent to immediately terminate the current process and begin a transparent process afresh, so as to ensure efficiency and value for money."

COMMITTED TO FIGHTING GRAFT

But on Sunday, the spokesman for the Presidency, Mr Manoah Esipisu, said Mr Kenyatta was committed to the fight against corruption.

"The President has even launched a website on which to report any cases. He is always in touch with anti-corruption agencies," he said.

Deputy President William Ruto also declared that the government would neither engage in business with corrupt cartels nor accept to be held to ransom.

"We are here to serve all Kenyans, not a few greedy individuals," Mr Ruto said at St Monica ACK church, Dandora during a thanksgiving service for Embakasi North MP James Mwangi Kaguya.

"No one and nothing will stop us from building the railway, building the roads, giving children laptops and doing irrigation among other pledges as enunciated in our manifesto."

Earlier, the Consumer Federations of Kenya warned that the rising number of corruption cases could make the cost of living too high for Kenyans as cartels will block the flow of cheaper services to the public.

"This is no longer just about the government because it has demonstrated that it has a weak ability to fight corruption," said Cofek secretary-general Stephen Mutoro.

Ethics and Anti-Corruption Commission (EACC) said some of the cases could take long to be concluded.

"These scandals seem to be in succession, but the EACC is very much aware. If we get a good case, we will let everyone know," said Mr Yasin Amaro, the commission's public communications officer.

Since May, questions have been raised on some of the government's investment and expenditure decisions. Among the most prominent was the controversial hiring of a luxury jet for the Deputy President, the airport expansion project, repair works on the Deputy President's official house in Karen and the multi-billion-shilling railway tender.

This month, the controversial Tassia NSSF project has come to light after Mr Francis Atwoli, the Central Organisation of Trade Unions secretary-general called it "the scandal of the year" for supposedly going forward without a formal board approval.

Yesterday, Mr Atwoli, who has since written to the Ombudsman to complain about the project, said every participant in the scandal should be punished regardless of status.

"Cotu wishes to see any individual involved in defrauding Kenyans dealt with irrespective of his/her political persuasions," he told journalists in a statement.

SUSPENDED PROJECT

Last week, Labour Cabinet Secretary Kazungu Kambi suspended the Sh5.053 billion housing venture to allow time to address Cotu's complaints.

The renewed focus on corruption comes just a day after key Jubilee coalition figures led by National Assembly Majority Leader Aden Duale and Senate Majority leader Kithure Kindiki gave President Kenyatta an ultimatum to expose corruption cartels tainting his administration.

Speaking at a funeral in Kieni, Nyeri, the leaders claimed that corruption networks were blackmailing the government by pretending to expose graft after losing out on lucrative procurement deals.

The leaders seemed to be targeting critics of the railway project led by Nandi Hills MP Alfred Keter, who has claimed that the tender was riddled with corruption.

The MPs accused Mr Keter and other Jubilee critics of being used by merchants and wheeler-dealers who were out to discredit the government and derail important projects after losing out on tenders.

They cited the networks inherited from the Kibaki government, such as those behind the Anglo-Leasing scandal, which they claimed were still in government and trying to resume their activities.

The railway deal is the subject of investigations by two parliamentary committees.

Starehe MP Maina Kamanda, who chairs the Transport Committee, hit out at unnamed individuals who have allegedly infiltrated the government to try and influence decision-making.

Mr Kamanda accused the individuals of seeking to hold the government to ransom.

Speaking to the Nation on condition of confidentiality, a State House official agreed with the claims made by the Jubilee MPs.

"It is a motley of groups that have had long interest in government. They are so deep in government that nothing can happen without them having their hands on it," the source said. "They are the reason some of the projects have not taken place even though money was released.

They are now back seeking to demonise the grand projects like the railway."

CARTELS

Senator Kipchumba Murkomen also spoke of cartels who he accused of seeking to hold the government to ransom.

Senate Majority leader Kithure Kindiki had earlier said a few wealthy people were using their connections to intimidate people in government to award them tenders.

"You can intimidate some people some time, but you cannot intimidate all the people all the time," he said.

And Mr Duale cautioned the cartels against using the courts to achieve their goals, saying Kenya now has a reformed Judiciary that did not condone corruption.

Well done Kenya!!These lot will leave us picking ants in our pants! I was really intrigued by that police vetting exercise last month! that was absolutely fab!!I was wondering if something like that could happen here in TZ!? mmh by the way what was the fate of that Ms Beatrice Nduta ( head of community police), I have only watched part of her interview, did she got away from that interview?? anyone knows abt it!!
 
If these allegations of grand corruption in Kenya are legit, then UK has a monumental task ahead of him, and at the same time I'm extremely disappointed!. I've been a fan of UK since he took office months ago for a fact that he's been very aggressive in leading the efforts towards radical economic transformation particularly infrastructural projects. I personally favor leaders who embrace and commit to ambitious and fast radical changes, leading to a sole reason as to why I've been a fan of UK.
 
Poor souls,,,they are the greatest failures that Kenya ever produced.

Then,,this Lumumba man,,,,one of the finest speaker Kenya ever produced. He who made the Kenyan mountains and
hills tremble as he spoke,,,, with his strong language,,, even president Kibak could not stand it,,,,he gave him that
top job of fighting corruption in Kenya.

Kumbe,,,,,there is,,,the difference between talking and walking the talk,,as they say it. This man,,,Lumumba,,
got compromised by the same cartels everyone is talking about. He never did anything,,any better,,,,,,,

He got sacked,,,unceremoniously for performing even worse than his predecessors.

just wants the president to halt the project.


Why,,,,not because they have come with new revelations about any corruption about to take place in
Kenya,,,,,,,but,,for the simplest reason that some people are complaining about it,,,,,without,,,,i repeat,,,

Without giving any tangible evidence about,,,anything but just biting about the bush,,,

This was the right forum to come out forcefully with all the evidence about
what was not right,,,, in railway line contract.

What did he do,,,appear there,,,with a very expensive,,lawyer,,AhmedNasir,,,
some newspaper cuttings as evidence and shouting that Ethiopian railway
line was cheaper than the Kenyan one.

Ohh!!! cabals/cartels/mafias are at it again.... projects have been ongoing since kibaki and even one of many feasbilty studies have yet to be documented for the public. as it is now the local cargo transport companies will stop at nothing to stop the rail project with a possibility that many may close shop. Look on the bright side of life, the rail project will help increase the competitive rates within the transport sector.

Members of parliament and politicians are spending too much time talking
about it in public instead of taking the matter to the commission.

Why,,,because they are simply,,,,politicking.

But one thing is that the deputy president says that the project will
continue.

This is it,,,,the project has to continue,,,,ignore these good for nothing
politicians who are out to confuse everybody.

They do not have any good agenda for this country.

County governments in Kenya are wasting so much money on
foreign trips.

They are going around the world using Kenyan taxes for no
any reasons and no one complains.

Where are Githongo's and Lumumbas of Kenya??????????when
real money and not that,,phanton Chinese one,,,is being raped
by county assembly members.

They are making trips to Rwanda,,Uganda,,Tanzania,,Israel,,USA,,
but,,everybody is blind on this.

But,,when one mad man starts a chorus and everybody takes in on,,
this is when you here akina Githongo and Lumumbas,,rumbling in
their sleep,,,,'another corruption',,

So,,,some Kenyans and Chinese are sharing money????????????

Nairobi, Kenya: President Uhuru Kenyatta has said the construction of the standard gauge railway (SGR) will proceed, despite criticism that has prompted a probe by a parliamentary watchdog committee.

The Head of State said that no amount of "noise making" would stop the biggest infrastructural project in the country's history.

Apparently incensed by allegations of impropriety in the procurement of the multi-billion shillings project, now the subject of investigation by the House Public Investment Committee, the President declared that there would be no going back. Parliament's Transport committee is also conducting a parallel probe.

Press conference

"There comes an hour when the noise must stop, and the work must begin. We are at that hour," said Kenyatta at a press conference at State House. Deputy President William Ruto and the entire Cabinet flanked him, in a show of unity by the Jubilee Administration, which has faced internal strife over the deal with the Chinese Government.

The president sought to set the record straight on the cost of the project following conflicting figures by his officials saying the contract sum is Sh327 billion for the 609km rail.

Without expounding, the President said bitter local and international commercial interest groups were sabotaging the project after losing out on the lucrative deal.

He challenged those who have information on any aspects that they feel are questionable to appear before the parliamentary committees investigating the matter and give their evidence "or come to me, tell me where the problem is."

The President said those challenging the project must do so on the basis of facts and table their evidence.

He further said those who had lost the bid were now keen on frustrating it.

Parliamentary committees

"We must stop this culture we have developed that if one loses a bid, then he has to employ every trick to stop the project. If you lose a bid fair and square, move on but do not stop the transformation agenda," he said.

He added: "It is good to compete, and I encourage it, but let them know that their interests do not supersede that of the majority Kenyans".

He declared that the Government would not be delayed in taking the opportunity granted by the Chinese Government - which is funding the bulk of the project - and fall to the schemes of those serving their selfish interests or the interests of partisanship.

Kenyatta particularly singled out businessmen, parliamentarians and members of civil society, urging them to consider the larger interests of Kenyans, which he said overrides any other.

The multi-billion project has been a subject of controversy since the tender was awarded to China Roads and Bridges Corporation (CBRC), resulting in two parliamentary committees opening investigations into how the Chinese parastatal was contracted.

Critics appearing before the two parliamentary committees' hearings have claimed that the right procurement procedures were not followed in awarding the tender, but government officials have insisted that the award was above-board. They said due process was followed as the matter was a Government-to-Government deal.

President Uhuru maintained that position, insisting that due process was conducted in awarding the tender.

"What we know is that we have followed the laws here and in China. We have investigated the capability of the company to handle such a project and the China government has confirmed that," he said.

The President added: "We believe in their word. No one is better placed to give us that verdict than the China government."

Uhuru cautioned that if Kenya does not make haste and take advantage of the funding of the project by the China government, the same could be diverted to another country. He emphasised the magnitude of the funding, disclosing that it amounted to 20 per cent of what China was pumping into Africa.

Uhuru maintained that the cost of the railway line construction was Sh327 billion, adding that the other costs - including the buying of land where the railway line will pass and for the construction of a container depot - would be borne by the Kenya Government.

The President said the Government-to-Government arrangement was entered into during the former administration, but said his government was eager to expedite the process they see as a major key to unlock Kenya's potential.

Refute claims

"We took over the project from where we found it and it was one of the main agenda that took me to China in July last year. We have followed the plan as per our agreement with China.

"We embraced it as our own, fully acknowledging its transformative role in our economy. We have detailed timeframes for the delivery of this railway. We intend to meet those time-frames," he said.

The President's press conference was attended by all his cabinet secretaries, with Kenyatta insisting that those seeking more information can get answers from line members of the Cabinet. Attorney-General Githu Muigai denied ever challenging the procurement process of the tender, insisting that an opinion that he had given to the Public Procurement Oversight Authority (PPOA) and which the PIC has been relying on to claim that his advice was ignored in the tendering process, was not particularly on the SGR. "At no time did the AG express any reservations on this tender. The opinion was quoted out of context," said Prof Muigai.

people like keter should know that the country has lost billions since indepence, from goldernberg and angloleasing type contracts, funds that can develop the country in a span of 50 years are currently in swiss banks, the noises should be about if the funds can be tracked and returned to treasury because....... the most corrupt have also learned how to cry wolf...

Last notable political assassination in Kenya happened in 1990, Githongo was part of the process and when he probably saw some corruption within his circles he bailed to U.K to go and display his trash, if he had given his expose to a local media i would have taken him with utmost seriousness but then again for whose interest was he working for?
