KENYA: International Criminal Court (ICC) Chief Prosecutor Fatou Bensouda has rejected a request by three Kenyans to follow proceedings of their trial at The Hague via video link.

Ms Bensouda, in a new submission to the three-judge Bench, maintained that according the Rome Statute, an accused is required to be physically present in court during trial.

She urged the judges to dismiss the request terming it ‘against the interests of justice' adding the court's technology is inadequate to ensure meaningful attendance.

"The request can be disposed of on the basis of the plain language of Article 63(1) of the Statute, which provides that the accused shall be present during the trial," she told the Trial Chamber V judges.

Hard stance

President-elect Uhuru Kenyatta, Deputy President-elect William Ruto and radio journalist Joshua arap Sang had applied to attend their trials via video link.

However, Bensouda took a hard-line stance on the matter, insisting if witnesses were required to travel to the court to testify, the same should be expected of the three accused.

She said the proposed absence of Ruto and Uhuru would undermine the integrity of the proceedings and "would create risk of the trials being seen as a trial in absentia, that the accused can engage with or ignore as and when convenient."

"If witnesses are presumptively required to travel to the court to testify, no less should be expected of the accused. It is important to ensure justice is not only done, but is seen to be done, particularly given the wide public interest in the case," she argued.

In an application made shortly before the March 4 polls, Ruto pleaded with the judges to allow them to attend the trials via video link arguing that depending on the outcome of the election, Uhuru whom he deputises, may be elected president.

He asked the bench led by presiding judge Kuniko Ozaki to balance between his would be roles and his duties to the court if Jubilee won the elections.

"Depending on the outcome of Monday's elections, or their subsequent ‘run-off', Mr Ruto may become the Deputy President of Kenya," his lawyers argued.

But in her application, the prosecutor maintained conducting a full trial through video-link raises the prospect of unnecessary technological problems.

Supreme Court upholds Uhuru's election as president

The Supreme Court has upheld the election of Uhuru Kenyatta as Kenya's fourth president.


Chief Justice Willy Mutunga said Mr Kenyatta and William Ruto were validly elected as President and Deputy President respectively.


"It is the decision that the third and fourth respondents were validly elected," Dr Mutunga said.


The judgement paves way for the swearing in ceremony of Mr Kenyatta set for April 9 at the Kasarani Gymnasium in Nairobi.


The Head of Public Service Francis Kimemia said the government will gazette Tuesday, April 9 as a public holiday when Mr Kenyatta will be sworn in as president.


"The rehearsals will begin on Monday. We have adopted the programme we had earlier on," said Mr Kimemia Saturday.

Your thinking is very myopic to say the least.

It doesn't matter if Uhuru Kenyatta is going to the Hague or not (in my opinion he will not go)
...what matters is the consequences that Kenyans have to face. Giving me an example of Bashir goes to show your appreciation of all matters political and I will live you at that. Its the same scenario in Zimbabwe under Mugabe...just ask the local people how hard life is under such regimes and you will get a clear answer.

Now we know why Uhuru Kenyatta is standing in these elections and why William Ruto is standing with him.
Uhuru said, "A vote for us is a vote of no confidence in the ICC."(Daily Nation, 1 February 2013). Ruto said, "Presidential victory for the Jubilee Alliance may indicate there is something wrong with the charges its two leaders are facing at The Hague". (The Standard, 1 February 2013).

Their own words indicate that they are using the election to try and get out of the ICC Trial. This then is the truth behind their earlier prayer campaigns, and, now, their election campaigns.

An election is not about saving oneself. It is about serving the nation. Secondly, Uhuru and Ruto cannot make the election which concerns 40 million Kenyans a referendum on the ICC trials which concern 2 Kenyans.

Because the ICC Trials arise from our commitment to international law enshrined in the Constitution of Kenya 2010 and because the ICC is also a Kenyan court, to make this election a referendum on the ICC trials is also to make it a referendum on the Constitution of Kenya.

Uhuru wants us to vote for him and thus against the ICC. But that is also a vote against our new constitution. It is a hidden attack on the new constitution. We must reject this. To vote against the constitution, directly or indirectly, is to destroy our future.

Uhuru and Ruto then proceeded to make even more suggestions on international criminal procedure. Ruto said "To the best of my knowledge on March 5, we will sit down with the people running the business at The Hague and tell them that we have this matter in court, we have every intention to attend, but we also have a country to run." (Ibid) This suggestion, soon perhaps to be known as the Ruto Rule, might be helpful to President Bashir of Sudan. But not to Kenya. Uhuru and Ruto have got it wrong here.

An accused person cannot stop a trial by winning an election and then telling the court he is too busy. Uhuru tried to improve on this error. He stated, "If Ruto could be [at The Hague] today, I would be around running the affairs of the country.

When he comes back, he takes charge as I go and defend myself." (The Star, 1 February 2013). Then when Ruto's trial has a break he returns and takes over again, and Uhuru goes to The Hague. And they go on governing Kenya like this in turns. Till they are convicted or acquitted. This is not an improvement. It is a degrading disregard of the rights of other Kenyans.

Uhuru is also concerned with how Kenya should vote to aid him and Ruto. So next he told rally crowds in Meru, that Kenyans who live in other parts of Kenya are ‘outsiders', (The Standard, 1 February 2013), and if they seek votes from there, they are ‘dividing' the region. Uhuru confirmed that the ‘region' "had over the years voted as a bloc", and implored the locals there to vote as a bloc "as they have done before." This is the type of canvassing that is practiced within the ‘region', including freely using the vernacular, while in the rest of Kenya there are pious statements about ‘unity'.

The admission from its presidential candidate that the ‘region' elects as a bloc is a sad indicative. But the election is not the only place the region has acted as a bloc. It has also done this in the Civil Service.

The Treasury needs to provide at least Sh5 billion to the police to effectively provide security. "But unfortunately, we are seeing political games being played by top officials of Treasury and the Internal Security ministry.

No firm commitments have been made to release the money as yet," said the consultant for a police reform group. (The Standard, 1 February 2013). It may further be recalled that last month the Treasury officials had also not released the full amount of the funds for devolution.

Uhuru and Ruto said their manifesto was a contract with all Kenyans on unity. The above words at Meru show that if there is any such contract, it is already being broken. Just like TNA's contract with Mudavadi was being broken even as it was being announced.
At the launch of his manifesto Uhuru had confetti falling from the ceiling. Those were the pieces of paper from the shredded contract with Mudavadi.

Hata kama Kenya ilikuwa ni lazima itawaliwe na Mkikuyu, Wakenya walikuwa na nafasi ya kuteua Mkikuyu mwingine ambaye pengine angekuwa na sifa zaidi ya Uhuru, ambaye alishiriki kutoa roho za Wakenya zaidi ya 1500 kwa ajili ya ukabila na uchu wa madaraka, lakini Wakenya kwa ukabila walipuuza na kufikiri wanamkomoa mtu bila kujali kama alikuwa anakabiliwa na kesi The Hague. Na wakaamua kumchagua. Sasa ndiyo wataanza kuipata kuwa tatizo la watu 2 litaleta matatizo ya kutengwa na dunia kwa nchi nzima. Msilalamike mliyataka wenyewe na msilaumu mtu. Wachawi ni nyie wenyewe. Mtoto akililia wembe mpe ajikate.

There is evidence in history where dictators have been known to exploit such systems i.e criminal court et al to consolidate their stay in power.

.......ANd when those dictators start ruling with an iron grip, the same court will not intercede to caution the dictators so long as they are serving the interests of such systems and not the people. Mr. Nowrjee should know this.......

There is nothing unusual with the ICC process, by its partisan nature, And it is not understandable why there is still an over-indulgence in trying to illuminate the ICC process for the Kenyan scenario as credible when it is not. (even after witnesses dropping their identity on reports of bribery and coercion to give false testimony). My advice is stop dreaming and wake up to the reality

.......The truth is those that overindulge with ICC want to cheer on the idea of sanctions, but even as subtle as the western powers be, sanctions are never automatically applied without consideration. That is why Kenyans after perceiving ii shunned it and it is an excercise in futility.
