Huko nchini Kenya, Bunge la Seneti liko mbioni kujadili Muswada unaolenga kufuta kurushwa moja kwa moja kwa matokeo ya uchaguzi wa rais yanayotangazwa kutoka vituo vya kupigia kura.
Muswada huo unapendekeza kufutwa kwa Kipengele cha 39 cha Sheria ya Uchaguzi ambacho hulazimisha IEBC kurusha moja kwa moja matokeo ya uchaguzi wa Rais.
Kulingana na Kipengele cha 39(1G) cha Sheria ya Uchaguzi, IEBC inatakiwa kuweka mfumo wa kurusha moja kwa moja matokeo kwa lengo la kutoa taarifa kwa umma.
Hata hivyo, matokeo hayo hayawezi kutumika kama msingi wa kutangaza mshindi wa uchaguzi.
Muswada huu umetokana na ripoti ya Kamati ya Mazungumzo ya Kitaifa (NADCO), ambayo iliundwa kufuatia maandamano ya kupinga serikali baada ya Rais William Ruto kuingia madarakani.
Kamati hiyo ilijumuisha wanachama kutoka pande zote za kisiasa, Kenya Kwanza na Azimio.
Muswada huo umefadhiliwa kwa pamoja na Kiongozi wa Wengi wa Seneti, Aaron Cheruiyot, na Kiongozi wa Wachache, Stewart Madazyo.

Endapo Muswada huu utapitishwa, wananchi watakaotaka kufahamu takwimu halisi za uchaguzi wa urais kabla ya mshindi kutangazwa watalazimika kutegemea picha za kielektroniki za Fomu 3A ambazo huwekwa kwenye tovuti ya IEBC na kufanya mahesabu yao wenyewe.
Aidha, Muswada huo unapendekeza kuwa kushindwa kuchapisha matokeo ya uchaguzi kwa njia ya kielektroniki hakutabatilisha matokeo ya mwisho yatakayotangazwa na IEBC.
Muswada huu umepokelewa kwa hisia tofauti, huku baadhi ya wadau wakihofia kuwa huenda ukapunguza uwazi wa mchakato wa uchaguzi wa urais.

An Amendment Bill is currently before the Senate seeking to remove the compulsory streaming live of presidential election results by the Independent Electoral & Boundaries Commission (IEBC).
The Bill proposes the deletion of Section 39 of the Elections Act and replaces it with a section that does not compel IEBC to stream live election results as announced from polling stations.
Section 39(1G) of the Elections Act states: The Commission shall, to facilitate public information, establish a mechanism for the live-streaming of results as announced at polling stations, and the results so streamed shall be for purposes of public information only and shall not be the basis for a declaration by the Commission.
The Bill, which is from the National Dialogue Committee (NADCO) report, has jointly been sponsored by Senate Majority Speaker Aaron Cheruiyot and his Minority counterpart, Stewart Madazyo.
(NADCO is the committee that was formed following anti-government protests that erupted after President William Ruto took office. Members of the committee were drawn from both Kenya Kwanza and Azimio.)
Should this Bill be passed, Kenyans seeking to know the exact figures in an ongoing Presidential election before the winner is announced will have to rely on digital images of Forms 3A uploaded on the IEBC portal as declared from various polling stations and do their own calculations.
Further, the Bill proposes that should there be any failure to transmit or publish the election results in an electronic format, this shall not invalidate the final results announced or declared by the IEBC.
