Judiciary Chief Registrar Gladys Boss Shollei appeared before budget committee to answer to graft allegations this morning and as she promised delivered out a shocker to the world.

According to Shollei,the JSC from the period Jan 2011 to July 2013 have held 500 series of meetings which she terms as baseless. In the meetings a staggering amount of Ksh.141M has been used to pay the 14 members commission as Sitting allowances from the taxpayers’ money.

The shocking figures gets revealed at a time when the JSC recommended a private session of which she had objected saying the public deserved to know the truth.

Below is what each member of the commission earns as sitting allowance only;

The Judiciary is to be audited over reported improprieties in procurement, salary advances and allowances.

On Thursday, it was revealed that JSC commissioners had about 14 meetings every month, with each drawing an allowance of Sh80,000 per sitting. (READ: Judiciary vomiting on our shoes)

There have been over 500 meetings in the last three years, a meeting with the Salaries and Remunerations Commission was told.

According to Chief Registrar Gladys Shollei, with the SRC in place, it is time to change allowances allocated to the Judiciary.

REDUCE ALLOWANCES

The Parliamentary Public Accounts Committee has ordered Auditor-General Edward Ouko to report the audit findings in four weeks.

This emerged as another Parliamentary committee, the Budget and Appropriations Committee, sought to reduce JSC allowances to curb wastage. It was noted that the commissioner's allowances ought to be at the same level as that of Members of the National Assembly.

Chairman Mutava Musyimi said failure to tame the JSC could bring down the Judiciary.

One of the interesting titbits in the standoff between Gladys Shollei and a faction within the Judicial Service Commission (JSC) has been the revelation that each member of the JSC receives Sh80,000 as sitting allowance for every session.

This means that each time JSC convenes with all 12 members present, the Kenyan taxpayer is hit for Sh960,000! If JSC sits at least twice a week—in sub-committee or full sessions to deal with finance, recruitment, court cases etc—that translates to Sh7,680,000 per month, or Sh92,160,000 per year!

Every member who attends two sessions per week takes home Sh640,000 per month, for simply putting buttocks on a chair! One need not speak at the meeting or stay till the end! This is more than what most judges and magistrates make, they who sit day in, day out, listening to cases.

Of these 12 members, seven are public officers getting a regular pay check and for whom serving at the JSC is a logical part of their work!

Make no mistake: There can never be any transformation, reform, efficiency or progress when the underlying systems are as kleptomaniac as this. No number of documents, philosophies or reports can take away the fact that this “eating” can only lead to maintaining status quo.

This fundamental attitude then gives rise to other issues perpetuating corruption: cronyism, nepotism, and patronage. For if you earn an easy Sh700,000 a month simply for sitting, and on top of your other income as a judge, magistrate, lawyer, registrar or retired politician, why not go the whole hog and treat the public purse as an ATM? It is a very thin line to cross.

Hence the utter lack of shame when the JSC approves purchase of a house for Sh350 million when houses in Muthaiga go for Sh150 million.

Or that Supreme Court judges are provided with lunch and breakfast everyday catered by Serena Hotel. Or that a senior judge trades with the Judiciary as a supplier.

Sadly, it is not only the JSC that treats our taxes as personal ATMs. Parliament and the civil service are probably better at this. Now parliamentarians are convening as many sessions as they can so that they can sit and “eat” our taxes.

Thus, for instance, interviews for public positions are treated as separate sessions for each interview so as to maximise on the eating. And it is this urge to sit that motivates parliamentary committees to convene for anything under the sun, at the slightest provocation.

As the joke around town goes, for MPs “checks and balances mean cheques that improve their bank balances.”

For civil servants, the impetus is creating as many cross-ministerial committees, task forces, panels as possible to maximise on allowances and per diems. It is about having as many forums outside the station to get per diems.

There is a former staffer at the Attorney General’s office who was nicknamed “Mr Per Diem” for his efforts to ensure he attended, for the shortest time possible, every meeting of every parastatal that required the presence of the Attorney General. He would go in and sign off, and then leave for yet another parastatal meeting, assured that his allowances were made.

Foreign travel is the icing on the cake for this eating and it no wonder that “study tours,” an area of contention within the JSC, are more common than anything else. For here, our senior public officers beat the richest nations on earth in terms of the amount of per diems they receive.

This gravy train of allowances, for sitting, standing, smiling, and just being, must stop. The system today is not about service but about selfishness.

While taxpayers have been a humble lot, this vomiting on our shoes will have consequences, unless Sarah Serem can stop it.

Judiciary's Chief Registrar Gladys Shollei has been sacked.

In a media briefing Friday, the Judicial Service Commission announced Shollei's sacking, citing misappropriation of funds, insubordination and incompetence.

"It is the unanimous resolution of the Commission that (Shollei) is hereby removed from office with immediate effect for incompetence, misbehaviour, violation of the prescribed code of conduct for judicial officers, violation of Chapter 6 and Article 232 of the Constitution of Kenya, 2010 (and) insubordination," JSC chair and Chief Justice Willy Mutunga stated.

He said the Judiciary stood to lose Sh2.2 billion from financial impropriety on which the allegations against her were based.

The Chief Justice noted that Shollei had admitted to 33 allegations in which Sh1.7 billion taxpayer funds had been lost or were at risk.

He added that her responses to some allegations which would cost the Judiciary Sh361 million were "mixed, flippant and flimsy," while denying 38 other allegations with a Sh250 million cost implication.

"Shollei admitted 33 allegations and denied 38 others. Responses to the balance were equivocal, evasive and contradictory," he said.

87 ALLEGATIONS

The JSC chair said Mrs Shollei had been served with 87 allegations on financial and human resource mismanagement, irregularities and illegalities in procurement and misbehaviour.

He said Shollei had been given 21 days to respond and a further 18 days for oral submission at her request, adding that the long process has brought out "deliberate disinformation, distortions and sideshows."

According to the JSC, this was intended to distract focus from the grave allegations facing her.

EACC TO INVESTIGATE

The Chief Justice said JSC had invited the Ethics and Anti-Corruption commission to do a thorough investigation "in light of the gravity of the issues" that informed Shollei's sacking.

Earlier on, there was a deadlock as Shollei declined to respond to allegations against her when she appeared before the commission, citing impartiality.

Nairobi. Msajili Mkuu wa Mahakama ya Kenya, Gladys Shollei amefukuzwa kazi kwa madai ya utovu wa nidhamu na kuwadharau makamishna wa Tume inayosimamia idara hiyo (JSC).

Shollei ndiye aliyemwapisha Rais Uhuru Kenyatta alipoingia madarakani mwaka huu.

Kwenye taarifa ya uamuzi huo iliyosomwa na Jaji Mkuu Willy Mutunga mwishoni mwa wiki, JSC ilitoa sababu tano za kumsimamisha kazi Shollei, ambapo msajili huyo alishutumiwa kwa kukosa maadili.

“Baada ya kusoma madai yote yaliyomkabili msajili mkuu wa mahakama na baada ya kusoma majibu yake, ikizingatiwa kwamba aliamua kujitokeza mbele ya tume, tumeamua kwa pamoja kumsimamisha kazi mara moja,” alisema Jaji Mutunga.

Kwa hatua hiyo, Shollei anakuwa msajili mkuu wa Mahakama wa kwanza kufutwa kazi tangu Idara ya Mahakama ifanyiwe marekebisho ili kuafiki matakwa ya Katiba ya sasa.

Aidha, ni ofisa wa pili wa ngazi ya juu kwenye idara hiyo kupigwa kalamu, baada ya aliyekuwa Naibu Jaji Mkuu, Nancy Baraza kufutwa mwaka jana.

Akielezea uamuzi huo, Jaji Mutunga alitaja ukosefu wa nidhamu, ukiukaji wa kanuni za kazi za maofisa wa mahakama, ukiukaji wa sura ya sita ya Katiba inayohusu maadili na kukaidi maagizo ya wakubwa wake, kama sababu zilizosababisha JSC kumsimamisha kazi Shollei.

“Kutokana na uzito wa masuala yaliyosababisha kusimishwa kazi kwa Shollei, JSC inaialika Tume ya Maadili na Kupambana na Ufisadi (EACC) ifanye uchunguzi wa kina kuhusu masuala haya,” alisema Jaji Mutunga.

“Madai yaliyotolewa kumhusu Shollei ni mazito sana. Pesa zinazohusishwa katika madai hayo ni Sh2.207 bilioni. Amekubali madai 33 ambapo Sh1.7 bilioni pesa za walipa ushuru ziko katika hatari ya kupotea. Amekataa madai 38 ambayo yanafikia Sh250 milioni ilhali majibu yake kuhusu Sh361 milioni yanakanganya,” alisema.

Jaji Mutunga alisema kuwa JSC imeweka madai yote yanayomkabili Shollei, majibu yake na matokeo ya uchunguzi uliofanywa na JSC katika tovuti yake.

Mwezi uliopita, Shollei aliiandikia barua JSC akiifahamisha kwamba yuko tayari kufika mbele yake kuanzia Oktoba 15, kujibu madai dhidi yake.

Shollei pia aliomba kwamba aruhusiwe kuyajibu madai dhidi yake hadharani, mbele ya wanahabari. Awali, Shollei waliafikiana kusuluhisha tofauti kati yao nje ya mahakama. Hii ni baada ya Shollei kwenda mahakamani akitaka JSC ambayo ndio mwajiri wake izuiwe kumchunguza.
