Tanzanian investigative journalist Erick Kabendera, who was arrested on Monday, is to be charged with sedition, his lawyer has said.
Jebra Kambol said in a statement that the police first questioned his client over his citizenship even though he holds a Tanzanian passport.
He was then passed over to the cyber crime unit for interrogation, the lawyer said.
Kabendera is now being charged with sedition in connection with an article published in The Economist about the nation's president entitled: John Magufuli is bulldozing Tanzania’s freedom, Mr Kambol said.
If you search for the article online, it now links to an Economist piece published on Thursday called Another critic of President John Magufuli is silenced.
"Erick has been denied police bail despite the fact that bail is a constitutional right in Tanzania," Mr Kambol said, adding that officers had been sent on Friday to search the journalist's house.

Since Mr Magafuli, nicknamed “The Bulldozer”, came to office in 2015, laws overseeing the media have been toughened and a number of newspapers and radio stations have been suspended for "incitement".
He has often warned about fake news in the wake of articles critical of the government, saying there are limits to press freedom.

CRITICALLY ill in a hospital in Nairobi, Tundu Lissu, the chief whip of Tanzania’s main opposition party, Chadema, is a lesson to those who would criticise the Tanzanian president, John Magufuli (pictured). On September 7th Mr Lissu was gunned down in broad daylight near his house in the sleepy administrative capital, Dodoma, after returning from a session in parliament. The attempted assassination came just two weeks after he was arrested—for the sixth time—for such things as insulting the president. It is not clear who was behind the attack. A month later, the government has yet to make any arrests. Mr Lissu had previously complained about being followed, and said he worried he might be killed. “This cowardly attack on one of Tanzania’s most fearless and prominent politicians raises concerns about the safety of all dissident voices in the country, at a time when space for dissent is quickly shrinking,” said Amnesty International, a human-rights group.
Tanzania, a country of 55m people on the East African coast, is rarely seen as one of Africa’s problem cases. Unlike Congo, Uganda or Burundi, it has never had a civil war or a military dictatorship. And although its elections have never once ousted the party (and its predecessor) that has governed Tanzania since independence in 1962, nor are they especially bloody affairs. Yet over the past two years, since the election of John Magufuli, Tanzania’s descent into autocracy has been stunning. It is a lesson in how when the presidency is strong and other institutions are weak, a single bad leader can set a country back many years.

JOHN MAGUFULI, Tanzania’s president, is known as “the Bulldozer”. When he took office in 2015 the nickname was seen as a compliment: at last the East African country of 57m people had a leader who would take on graft and get things done. In his first months in charge Mr Magufuli wasted no time in cracking down on corruption (at least among his enemies). But since then the only things being squashed in Tanzania are civil liberties.

One observer who knows this well is Erick Kabendera. A journalist, Mr Kabendera has written for the Economist Intelligence Unit, our sister company, and many other international outlets. He has documented Mr Magufuli’s abuses of power, including a proposal last year that would make it illegal to contradict official statistics.

On July 29th Mr Kabendera was forcibly removed from his home on the outskirts of Dar es Salaam, the commercial capital, by plain-clothes policemen. His phone, and those of his wife and neighbours, were taken. The premise for the abduction is unclear and his whereabouts are unknown.


Mr Kabendera’s arrest is not the first attack on journalists in Tanzania under Mr Magufuli. Azory Gwanda, a freelance, was abducted in 2017 and has not been seen since. At least four newspapers and two radio stations have been closed. Legislation enacted in 2016 made it harder to criticise those in power. (The East African Court of Justice says it violates press freedom.)

Other critics of the regime, including opposition MPs, are frequently arrested. One MP, Tundu Lussu, was shot in 2017 in an assassination attempt. Companies such as Acacia Mining have been shaken down for huge tax bills.
The repression is hurting Tanzania. Earlier this year the IMF warned that authoritarianism and arbitrary policies were crimping growth in what was once one of the continent’s fastest-growing economies. Mr Magufuli, naturally, blocked the report’s release.

But it is the human cost that is most apparent. Tanzania was until recently a relatively liberal country in a region dotted with tyrannies. Under Mr Magufuli that reputation is in tatters. It is a story that Mr Kabendera has told. He seems to be paying the price for that.■
