Uhuru wa Maoni Sheria ya 1984 Na.15 ib.6 18.-(1) Bila ya kuathiri sheria za nchi, kila mtu yuko huru kuwa na maoni yoyote na kutoa nje mawazo yake, na kutafuta, kupokea na kutoa habari na dhana zozote kupitia chombo chochote bila ya kujali mipaka ya nchi, na pia ana uhuru wa mawasiliano yake kutoingiliwa kati.
(2) Kila raia anayo haki ya kupewa taarifa wakati wote kuhusu matukio mbalimbali nchini na duniani kote ambayo ni muhimu kwa maisha na shughuli za wananchi, na pia juu ya masuala muhimu kwa jamii.
Ukisoma vipengele vya katiba vinaelezea wazi kuwa uhuru huo wa kutoa maoni unatakiwa usiathiri sheria za nchi
Nia ya kufanya uchochezi Sheria Na 18 ya 1950 kif. 2; Sura 455
55.-(1) Nia ya kufanya uchochezi ni nia ya:-
(a) ya kuleta chuki au kudharau au kuchocheza, kutopenda dhidi ya mamlaka halali ya Jamhuri ya Muungano au Serikali yake;
au (c) kuleta chuki au kudharau au hamasa ovu ya kuwafanya dhidi ya utawala wa sheria katika Jamhuri ya Muungano; au (d) kupandisha hali ya kutoridhika au kudharau baina ya wakazi wa Jamhuri ya Muungano; au (e) kukuza hisia za nia mbaya na chuki baina ya aina mbali mbali za watu wa Jamhuri ya Muungano.

(1) Mtu yeyote ambaye- (a) anatumia lugha chafu, ya matusi au ya usafihi kwa mtu mwingine yoyote kwa namna ambayo huenda ikaleta uvunjifu wa amani; au
Ukiangalia sheria za nchi hapo juu na ukiangalia uhuru wa kutoa maoni wanaoutaka upinzani uchwara utagundua upinzani wetu uchwara wanashindwa kutofautisha kati ya uhuru wa kutoa maoni na uhuru wa kutukana.Tanzania tuna utamaduni wetu ambao unabainisha wazi kuwa sio vizuri kutukana kuwabeza na kuwadhihaki watu waliotuzidi umri au viongozi wetu.
Sio tu ni kinyume cha dini bali hata dini na sheria za Mungu muumba mbingu na ardhi anakataaa
Qur’an chapter 4:59, “O ye who have believed, obey Allah and obey His Messenger and the people of authority amongst you. And if you disagree over anything, return the matter to Allah and His Messenger (Muhammad, pbuh) if you truly believe in Allah and the Last Day. That is the best [way] and best in result.”

Imam Al-Fudhayl Ibn ‘Iyadh (RA) said: “If I have a good prayer (that will be accepted by Allah), I will make it for the leader. We have been commanded to pray for them with goodness and we have not been commanded to curse them even if they are transgressors and oppressors. This is because their injustice would only be on their necks (as sins) and their being upright (because of good supplications for them) will be for them and for us.” (Alwajeez fee ‘Aqeedah as-Salaf)

Kila mtu na ajitiishe* kwa mamlaka zilizo kubwa,+ kwa maana hakuna mamlaka isipokuwa kupitia Mungu;+ mamlaka zilizopo zimewekwa na Mungu katika vyeo vyao vya kadiri.+ 2 Kwa hiyo, yeyote anayepinga mamlaka amechukua msimamo dhidi ya mpango wa Mungu; wale ambao wamechukua msimamo dhidi ya mpango huo, watajiletea hukumu wao wenyewe.
Hivyo wakuu naomba kuwataka ndugu zangu kueheshimu katiba na kutofautisha uhuru wa kujieleza na uhuru wa kutukana hivyo kuacha mara moja kuwadhihaki na kutukana viongozi wetu kwani kufanya hivyo ni kwenda kinyume na katiba yetu , utamaduni wetu pamoja na kwenda kinyume na Mungu muumba mbingu na ardhi

55.-(1) Nia ya kufanya uchochezi ni nia ya:-
