I agree with Uhunye on this. Who will be the judge of JSC. It can't have the power to recommend appointment of judges without external scrutiny.

Maybe the president has intelligence against the judges. Its high time we learn to tolerate the presidents choices as wel6. This is the true basis of checks and balances.

I like justice Ngugi but he looks fishy

Judge Ngugi is a criminal who takes bribes and should be nowhere near any court of law. He's wanted by the US.
 
It is high time we respect the constitution. The constitution is not a piece of toilet paper. Nobody has a right to violate the constitution. Not even the president. This constitution was passed by 67% of Kenyan voters. Kenyans in their wisdom decided that JSC will appoint the judges and Uhuru's role will be that of a rubberstamp. And that is final. If Uhuru doesn't like it, he should put it in the BBi bill and bring it to Kenyans through a referendum.

Kenyans are the ones who will decide either to change or not to change that clause. Uhuru has no power to violate the constitution. And he is behaving just like other African dictators who don't obey the law. Uhuru's govt has violated court orders more than 10 times. Including court orders that Miguna Miguna should not be deported or that Soldiers who were tortured in 1982 should be paid. So Uhuru just doesn't respect the courts. And he is a bad example to the next president.

He is teaching the next president to also disrespect the courts. African presidents think they are kings. Muhammadu Buhari was very angry a few days ago when twitter deleted his tweet that was misleading people and he decided to ban twitter from Nigeria. Now millions of Nigerians cannot access twitter because a single president who cannot control his emotions got his tweet deleted.

This is the same with what Uhuru is doing. BBI got blocked and he became emotional and now 6 judges have not been appointed. If he has any information regarding the judges he should forward that info to JSC. Otherwise it is completely asinine for Uhuru to say he has some info and fail to share it with JSC. Hivi ndivyo katiba huwa inavunjwa halafu tunarudi enzi za Moi. I don't support this shenanigans that this president is doing.

Why are you lying? Uhuru did not fail to appoint the six judges because of BBI.
 
When these judges were being interviewed, their names were sent to NIS for background checks as is the custom for any high office appointee. NIS found no gross misconduct. EACC also cleared them, KRA cleared them. The attorney general himself who is also a member of the JSC never raised this issue or brought any evidence during the interview.

And then now we are being told that NIS found dirt on them. Sawa, let's say that this is true. If NIS has evidence against them, this is the process that GoK or anyone else has to use when they have an issue with a judge.

And if the president has concerns about issues of national security being discussed in front of the media, the law allows for the proceedings to be held in camera and the JSC members can sign oath of secrecy forms.

So kwa kifupi, hauwezi kukosoa JSC wakati rais mwenyewe hajawahi peleka kesi dhidi ya majaji hawa kwa JSC.
