Maureen Mudi. 2 December 2011
FIVE Somali men arrested in Manda during the Lamu Cultural Festival on suspicion of having links to terror activities have been charged in Mombasa. The suspects, who were earlier arraigned in a Lamu court but did not take plea after the court failed to get a Somali interpreter, faced charges of being unlawfully present in the country.
Ali Mohammed, Ahmed Omar, Abdullahi Mohammed, Mohammed Abdi and Jama Mohamud Adan, appeared before principal magistrate Joyce Gandani. They were charged that on November 25, at Manda Bay in Lamu West District, being Somali nationals, they were found unlawfully present in Kenya without any authority or permit.
The court was further told that the suspects were found on the same day at Manda Bay area, while being excluded persons, failed to report their entry to the nearest immigration officer at the point of entry to Kenya. Yesterday, when the charges were read to them, only one suspect pleaded guilty.
The magistrate directed that the case be handled in the afternoon after which all the suspects pleaded guilty to the charges. The suspects were brought under tight security from Lamu, onboard a Mpeketoni police station Land Rover, and locked up for the night before being arraigned in court.
Police had claimed that the suspects arrived at the Manda Bay area on board a speed boat then alighted and proceeded on foot to an unknown destination moments before they were arrested.
They were kept in custody at the Lamu Police Station and arraigned the next day in court, with the Prosecutor, Caleb Mutonyi, asking the court that the case be adjourned to ensure that the police conducted more investigations. The PM directed that a ruling over their sentence be given today.
