Inawezekana kuna mengi Kibaki ameyakalia ambapo hatamuruhusu Raila achukue usukani akiwa mzima.

Na hii pia inaweza kuendelea baada ya miaka mitano.

Usukani lazima ushikwe na watu wenye mwelekeo wa Moi, Kibaki sasa tutegemee Kalonzo nk.

Hii inaweza kuwa mwisho wa demokrasia nchini Kenya.

Kama wakenya wanaitaji demokrasia ni kukata mzizi ni kwenda kwenye kitovu.

Another Zimbabwe in the making, being witnessed by millions worldwide. If UK and USA can congratulate JK on sacking the BOT governer then there is something very wrong in Afrika. Kenyans should not leak Kibakis' feet, they should remove him from State house with immediate effect to rescue themselves.

Where's that noisy press? Where is our beloved members from up North.

Word of advice, they should use the name Kenya and not East Africa.

Mchezo umekwisha, Raila atafute tu njia nyingine ya kwenda State House hapo baada ya miaka mitano.

Kibaki hana nia, na wala hakuna mwenye uwezo wa kumwondoa madarakani kwa wakati huu bila ya damu nyingi kumwagika.

Hakuna upatanishi wowote utakaobadilisha hali iliyopo sasa, na ambayo Kibaki anaendelea kuisuka.

Kuna njia kadhaa anazoweza kuzichukua Raila, ambazo nyingi zitakuwa ni za kumpotezea muda tu. Njia ninayompendekezea mimi ni akubaliane na viongozi wenzake katika ODM wawe na mshikamano wa hali ya juu kabisa, huku wakifanya kila jambo kwa matayarisho ya hapo 2012. Ni lazima wawe na nidhamu ya hali ya juu, na uvumilivu mkubwa; wakijua lengo lao ni lipi.

Huko bungeni waonyeshe kazi nzuri kabisa; na isiwe kupinga tu.
 
Hakuna sababu ya kusubiri miaka mitano kwa sababu upinzani una wabunge wengi wamwondoe kupitia bunge kutokuwa na imani na rais.

KISUMU, Kenya - President Mwai Kibaki rejected demands Wednesday for a new election or vote recount while addressing countrymen who had to flee blazing homes and rampaging mobs armed with machetes and arrows in Kenya's seething political turmoil.

Continuing violence, set off by opposition claims that Kibaki stole the Dec. 27 presidential election, caused a new exodus of refugees, and little sign appeared of softening by the president or his chief rival, Raila Odinga.

More than 500 people have died in violence that in some areas pits other tribes against Kibaki's Kikuyu, the dominant people in politics and business in the East African nation of Kenya.

The vote "is finished, and anybody who thinks they can turn it around should know that it's not possible and it will never be possible," Kibaki told a crowd in the western town of Burnt Forest on his first trip to a trouble spot since bloodshed started two days after the disputed ballot.

Speaking in Swahili, he delivered a much sharper tone than in his official statements to the press, in which he focused on dialogue and harmony. He repeated his call for the top court to settle any allegations of election fixing. Kenya's high court is filled with Kibaki appointees.

Kibaki urged the thousands of refugees camped at a school in Burnt Forest not to abandon their land.

"Do not be afraid. The government will protect you," he said. "Nobody is going to be chased from where they live." But that already has happened to an estimated 255, 000 Kenyans.

On Wednesday women with suitcases on their heads, frightened children grabbing at their skirts, searched for transport to get away from Kisumu, the main western town where Odinga has strong support and those seen as government supporters have been attacked.

On the road to Nairobi, the capital, dozens of angry youths brandishing sticks burned tires to block the route. "If elections fail, violence prevails !" they shouted.

People lined up in the poorest Nairobi slums to wait for food aid because violence has cut off regular supplies of food and water. Hundreds gathered in the Kibera slum turned rowdy as volunteers tried to hand out food, and several men stole sacks of corn flour.

"There are some boys there taking all the food," said Eunice Ochien, 21, who was pushed out of line. "It isn't fair." The election dispute has brought chaos to a country long considered one of Africa's most stable democracies.

The chairman of the African Union, Ghanian President John Kufuor, was in Kenya trying to mediate a settlement with support from the U. S. and Britain. But nothing clearly showed any progress in easing the anger and distrust dividing Kibaki and Odinga.

Some indications appeared Wednesday that Kibaki hoped to resolve the crisis through direct talks with the opposition. After Kibaki met with the African Union envoy, the government issued a statement that Kibaki "assured President Kufuor that he had already initiated a process of dialogue with other Kenyan leaders." The opposition, however, insists it will not negotiate without African Union mediation.

According to a Kenyan government Web site, Kibaki won 4, 584, 721 votes, or about 47 percent, and Odinga got 4, 352, 993, or about 44 percent.

Njia hii haiwezekani. Wabunge wa ODM hawatoshi, hawafikii theluthi mbili inayohitajika. Hata wangevishawishi vyama vidogo, pia namba isingetosha. Hawana njia ya kumwondoa bila kumwaga damu.
 
Kama ni hivyo basi wamekwisha maana taarifa kutoka Kenya zinasema wafanyakazi wengi wamefukuzwa hasa kwenye tourist sector ambako wageni wamepungua sana.
 
Nadhani Wakenya wanahitaji kujifunza kwa Waisrael, kiongozi asietetea masahi ya Taifa anawekwa kwenye koma hadi mola wake atakapomwita.

Kwa nini meshkhe´, Maaaskofu na mapadri wasianzishe ibada ya kumwombea afya mbaya kiongozi aliyeiba kura na kusababisha watu kupoteza maisha?

Mimi nadhani kama diplomasia imefail kuna njia ingine ya kumuita yahwe, allah, yehova and all other names kwa wiki moja mfululizo watu waalikwe badala ya kwenda kuandamana waende msikini, makanisani kusali kumwombea mabaya wote walioiba kura na kusababisha umwagikaji wa damu.

Mimi naamini hii njia itawork tena kwa muda usiozidi 20days
 
Raila na ODM waliweza kuvumilia na kuweka pressure kwa Kibaki kwa miaka 2 toka watolewe serikalini baada ya ODM (Chungwa) kushinda referendum. Huu uchaguzi wa 2007 ulikuwa ndiyo pumzi yao.

Kwa hali ilivyo, itakuwa ngumu sana kupoteza hii pumzi na kuendelea na mshikamano huo huo hadi 2012. Inawezekana kufanyika ila itakuwa kazi ngumu zaidi.

Wanaweza pia kukubali (swallow the pride) na kuingia serikalini halafu kuiangusha serikali kutokea ndani, kama walivyofanya kwa Moi/KANU. Kwa kuwa hii ni term ya mwisho ya Kibaki (kama ilivyokuwa kwa Moi), na kwa kuwa hakuna clear leader wa PNU ambaye anaweza ku-mobilize Kibaki apologists, basi resistance ya kusukuma from within itakuwa ni ndogo compared na 2005 wakati wa referendum.

Kujiunga na serikali pia inawezekana (pamoja na kujidhalilisha kote huko; ingawaje inaelekea katika mambo ya siasa hakuna mambo ya kujidhalilisha). Lakini sioni kuwa ODM itakuwa 'effective' zaidi kwa kufanya hivyo, kuliko kuwa na upinzani mzuri utakaowashawishi wananchi waone kuwa kumbe kweli wanafaa kuchukua madaraka safari ijayo. The agreement that was to be signed to end election crisis

This is the agreement ODM says its leader Raila Odinga and President Kibaki were to sign to end the political impasse brought about by the disputed presidential election results.

It was to be witnessed by mediator John Kufuor who is the President of Ghana and also the chairman of African Union, British high commissioner Adam Wood, US ambassador Michael Ranneberger, French ambassador Elisabeth Barbier and the local head of the European Union.

However, State House has disowned it saying it was first brought to their attention Thursday afternoon by the Ghanaian delegation.

Principles of agreement

“His Excellency Hon Mwai Kibaki and Hon Raila Amolo Odinga, being committed to the maintenance of the rule of law and to sustenance of democratic governance in the Republic of Kenya,

AND BEING CONCERNED with the violence, the loss of lives and property following the pronouncement of the presidential election results, commit ourselves to a speedy resolution of the unfolding events to ensure that our great Nation returns to stability.

Numerous issues have arisen in connection with the conduct of the Electoral Commission of Kenya including the tallying, compilation and declaration of the presidential election result. Voters on both sides feel aggrieved and concerned.

We confirm our commitment to address all the issues arising from or connected to the presidential elections through a process which:-

1. (i) shall be credible, independent and impartial,

(ii) shall not be subject to control by either party, and

(iii) whose findings and recommendations we agree to be bound by.

2. The issues to be determined through the process shall include:

(i) To inquire into the conduct of the ECK and the role of the observers in the conduct of the presidential elections including the declaration of results.

(ii) The composition of ECK and remedial action which may be undertaken to ensure its independence, impartiality, capacity and effectiveness in discharge of its constitutional and statutory mandate.

(iii) To identify measures that will help to restore and sustain voter confidence in Kenya’s electoral process.

(iv) To look into the circumstances leading to the declaration of presidential election results and determine whether it is necessary to carry out a rerun of the presidential elections, and if so, provide the time-frame and modalities of carrying out such elections

(v) To make recommendation on the structure of government pending the conduct of the presidential re-run or otherwise.

(vi) We agree that a credible process acceptable to all Kenyans will be carried out by a panel of eminent African persons.

The panel will make such recommendations as are necessary to resolve the issues and concerns arising from or connected to all the referred matters.

The panel shall make their findings and recommendations within 30 days of the date of execution of this agreement, which findings and recommendations shall be binding on both parties.

Pending resolution of the outstanding problems, all Kenyans should refrain from acts of violence and maintain law and order and all internal security agencies will be required to act in accordance with the law.

In the interim, there shall be a coalition government whose composition shall be agreed upon on the basis of equal representation both in numbers and portfolio with the prior approval and endorsement by the perspective sides. The strategies and programmes of such government shall be subject to agreement of both sides.

We, the undersigned, solemnly undertake to procure Members of Parliament supporting our respective parties to enact such legislation, whether statutory or constitutional, as may be necessary to facilitate the implementation of the recommendations and of above matters if and where required
 
Kivuitu disowns poll results

The credibility of the presidential results took a further beating when the chairman of the disgraced Electoral Commission of Kenya (ECK) disowned a list published in the press on Thursday.

And Mr Samuel Kivuitu hinted — for the second time after the announcement of the disputed presidential results — of external pressure being brought to bear on his commission to act in a certain way.

In a statement iisued on Thursday, the straight-talking Kivuitu took great exception to the use of his name by the authors of the list.

"I wish to say I did not submit this report or authorise my name to be used for its publication. The use of my name is a falsification," said Kivuitu.

"It seems like some outside force has pushed for its publication otherwise whoever published it would have sought my consent for the use of my name," he said of the paid-up advertisement booked by the commission’s secretary, Mr Joel Tsola.

The announcement of President Kibaki as the winner of the disputed elections by the commission led to unprecedented chaos that have seen nearly 500 killed, thousands displaced and millions of shillings worth of property destroyed.

Opposition party ODM maintains its presidential candidate, Mr Raila Odinga, won the elections, but was stolen by its PNU rivals.

The move came even as civil society organisations filed complaints demanding the prosecution of Kivuitu, 22 ECK commissioners and some selected senior commission staff over the bungling of the elections.

Under the auspices of Kenyans for Truth and Justice, the civil society officials filed complaints with the police at Nairobi’s Kilimani Police Station.

Led by the chairman of the statutory Kenya National Commission on Human Rights, Mr Maina Kiai, the civil society organizations said: "It is our expectation and demand that the Commissioner of Police, through the Kilimani OCPD Mr Herbert Khaemba, will earnestly investigate the said persons and the offences with a view to charge the said culprits in a court of law".

Kiai added: "Failure to take action expected of him, we shall explore other avenues open to us, including private prosecution and suing the Commissioners for neglect of duty".

In his statement released on Thursday, Kivuitu wondered why the ECK rushed to publish the data at a time when serious discussions involving eminent world leaders were ongoing as a result of the events following the commission’s December 31 announcement.

However, Kivuitu said he was aware that data to that effect was being verified and when he saw its raw draft, he sought clarification on a few areas. "I was still waiting for this clarification".

ODM has contested the results of 48 constituencies, where it says the figures for the PNU candidate, President Kibaki, were inflated. But PNU denies this.

On Thursday, Kivuitu noted that the publication of the disputed results at this stage would be imprudent.

"Indeed it may be wrongly viewed as a defensive tactic by a guilty party to the dispute," he said in reference to his commission, which has been under censure from Kenyans over the manner in which it handled the tallying and announcement of the results even after complaints were raised.

Audit election results

Kivuitu explained that the ECK should encourage any efforts that could lead to a peaceful settlement of the dispute.

The ECK chairman, for the second time, reiterated that an inquiry by a competent and independent team of respectable persons could come out with the truth.

If this is cumbersome or lengthy, Kivuitu said, then a political solution should be pursued rigorously.

Kivuitu also took issue with the media for proceeding to use his name as author and authority of a matter of such magnitude without verifying his involvement.

"It is no wonder therefore that media has personalised the ECK’s announcement of the presidential election results so that announcement is now Samuel Kivuitu and not that of the ECK," the chairman said.

He emphasised that all the commissioners came to the room where the announcement was made.

Kivuitu said he had a copy of the duty roster that showed which commissioners were involved in vote tallying duties every day.

"We were gathered there to announce the results of their efforts. I never took part in any tallying or verification due to health reasons," said Kivuitu.

However, Kivuitu said after ODM raised their objections ECK told the world that they welcomed an independent audit or a court action.

Kivuitu said in order to correct another "fantasy" which media keeps on repeating, the pressure by PNU and ODM-Kenya that he announce results immediately was not made in private.

"It was made in the hall before everyone including the Press. Your efforts to privatise this fact will not change the truth," said Kivuitu.

He called for the need to make every effort to do what leads to peace and mutual edification.

Kivuitu has been known to be forthright and always speaking out his mind.

Two days after announcing the presidential results, Kivuitu admitted he announced results of the fiercely contested presidential election under pressure.

When asked whether President Kibaki won the elections, he said: "I do not know whether Kibaki won the elections".

Kivuitu said he took the presidential election winner’s certificate to State House, Nairobi, after "some people threatened to collect it while I’m the one mandated by law to do so".

"I arrived at State House to take the certificate and I found the Chief Justice there ready to swear-in Kibaki," he said.
