Well, unakumbuka Supreme Court ilitoa order ku-Scrutinize forms 34s and 36s? Pia re-tallying of suspicious 22 polling stations? Sasa imedhihirika leo asubuhi Mahakamani kuwa in those 22 polling stations Uhuru aliongezewa 6,000 votes na Raila alipunguziwa 11,000 Votes. Mind you its only in 22 polling centres. (What if in 33,000 polling centres?). Haya Forms 34 ambazo ndizo zinakuwa na results kutoka counties mbalimbali, imegundulika 10 hazipo. Je yale matokeo yaliyotangazwa (including results from those missing 34 forms) yalitoka wapi? were they complete? Haya kuna duplication of form 36.....so ....interesting!
 
Regardless of the submissions to Supreme Court by the petitioner... next time the CJ Mutunga and fellow learned colleagues shows up...the presidential results will be uphold...yeah its the presidential petition.Uganda,USA Ghana,Nigeria etc

It doest matter whether the election free and fair...or its the new constitution. No Watch this space.

Lawyers: Vote re-tallying results reveal discrepancies

Nairobi, Kenya: The results of re-tallying of votes from 22 polling stations and audit of all Forms 36 used in the March 4 election were on Friday revealed before the Supreme Court.

Lawyers representing petitioners said the scrutiny revealed there were no Forms 34 for 10 constituencies and there were errors in Forms 36.

Lawyer Kethi Kilonzo representing Africog said the scrutiny showed the Forms 34 were missing in 10 constituencies.

"Presidential results from Laikipia West cannot be verified," she said.

She said if the Forms 34 were missing, then the Returning Officer presidential results made a final decision without complete tallying from all polling stations.

Lawyer George Oraro representing Prime Minister Raila Odinga said there were grave errors in Forms 36 from seven constituencies.

He said in some instances, there were two Forms 36.

He said there were huge discrepancies in the Forms 36 used in the final tally of presidential results and added Uhuru Kenyatta could not have garnered the 50 percent plus one basing on the errors.

But the Independent Electoral and Boundaries Commission through lawyer Nani Mungai said the discrepancies in Forms 34 and Forms 36 were explained by Returning Officers in affidavits filed in the case.

Lawyer Fred Ngatia for Uhuru Kenyatta said there were clerical errors across the country but added they were not substantial.

"Voting, counting and tallying of the presidential election was done to a substantial degree of accuracy," he said.

Lawyers representing respondents in the election petition challenging the outcome of the March 4 presidential elections have said the scrutiny by the supreme court of 22 polling stations has confirmed that there was no malpractice involved in the voting and tallying of the election results.

The lawyers appeared in court today where they submitted their responses to two reports prepared by the Supreme Court after it scrutinized the 22 polling stations using form 34 and form 36 to determine the number of votes cast against the number of registered voters.

Nani Mungai, Counsel representing the Independent Electoral and Boundaries Commission said that the retally and scrutiny by the court confirms the position of the IEBC in the matter. In response to the discrepancies highlighted in five constituencies by the scrutiny, Mungai said that the IEBC had already filed evidence answering the errors in each of the five constituencies adding that the evidence provided by the IEBC indicates that these are not discrepancies.

In regard to the missing form 34s Mungai said that all the forms were provided by the IEBC to all the parties in the petition. He said that because the IEBC was given only three days to provide the forms there was likely to be some omissions, but all the forms were eventually provided by the commission.

In response to extra form 36s, Mungai said that some returning officers had made errors in the first tally of the results and new forms were provided by the IEBC for retallying when the errors were found. He said that the the IEBC provided both the forms 36s with errors and those with the corrections to show there was no mischief on part of the respondent.

Mungai denied the allegation made by Oraro, the counsel acting for Cord that the greenbooks were not provided to the courts stating that the ‘green books' were exhibited in the affidavits of returning officers and that the court has every green book used in the poll. He added that the IEBC provided thousands of green books to be used in the scrutiny by the court.

Fred Ngatia advocate for the Jubilee Alliance said the retallying by the court shows a trend that the tallying carried out by the IEBC was to a fairly high degree of accuracy. He said IEBC officials may have made one or two clerical errors but mischief cannot be attributed to a few clerical errors.

Deputy President William Ruto's lawyer, Katwa Kigen said the report by the Supreme Court do not support the issues raised by the petitioners. He said there are no form 34s missing as all the parties in the case have access to the forms.

He said that the scrutiny does not show whether there were two form 36s both signed by the returning officer. He said there was no duplication of form 36 adding that the returning officer verified form 36 before countersigning them.

Kigen added that the report does not show any malice or interior motive by the IEBC adding that it instead vindicates the respondents.

The Supreme Court will tomorrow deliver its ruling on the election petition filed by the Cord Coalition and Africog challenging the outcome of the election in which Uhuru Kenyatta was declared the President elect.

  1. Vp kuhusu kupunguza zaidi ya kura 12,000 ya RAO na wakati huo huo kura zaidi ya 6,000 kuongezewa Uhuru? Na hii imedhihirika only in 22 sampled constituencies, that is to say if re-count was done in all constituencies it means that makubwa tungeyaona zaidi ya haya hapa

Prime Minister Raila Odinga and the civil society have said the re-tallying of votes show discrepancies in the presidential results as declared by the electoral commission.

Mr Odinga's lawyer George Oraro told the Supreme Court that Forms 36 contain "grave errors".

"There are huge discrepancies in Forms 36 used in tallying final results," said Mr Oraro Friday.

"The re-tallying shows there was addition of 6,139 votes and a subtraction of 12, 530 votes when figures are tallied," he said.

He was responding to the report of the scrutiny of results from 22 polling stations ordered by the Supreme Court.

Lawyer Kethi Kilonzo for the Africa Centre for Open Governance (Africog) said, according to the report, Forms 34 were missing in 10 constituencies.

She said that in Laikipia West constituency, it was not possible to verify the number of votes cast.

Ms Kilonzo said president-elect Uhuru Kenyatta got 76,760 votes, yet this could not be verified.

She said the Independent Electoral and Boundaries Commission chairman Issack Hassan announced the final results prematurely.

"The Returning Officer of the presidential election (Mr Hassan) made the final announcement without all the results," she said.

According to the report, these are: Kilifi North, Kapenguria, Loima, Magarini, Matuga, Narok West, Kuresoi South, Likuyani, Kabondo Kasipul, Mwingi North.

However, IEBC said all Forms 34 were available on its website.

Aggregate results of Form 36 registered voters from 75 constituencies were missing, the report says.

For instance, in Mvita constituency there was no aggregate provided for votes cast. In Ganze, there were two Forms 36. In Githunguri, the two Forms 36 indicated different numbers of votes cast. In Malava, the Form 36 was incomplete.

In rebuttal, IEBC lawyer Nani Mungai said the commission had responded to the the discrepancies.

"We provided thousands of green books for scrutiny to address the allegations of having more votes that registered voters," he told the judges.

He said there was "no mischief at all" on the part of the IEBC in conducting the General Election.

Mr Kenyatta's counsel Fred Ngatia conceded there were "clerical errors" but maintained this could not affect the final results.

`The moment the Supreme Court judges ordered for a recount, I immediately came to the conclusion that their final decision will be based on the findings of the scrutiny. The question that they are already asking themselves is: are the discrepancies in the recount large enough to disqualify the election? Of course, what they are doing now is to find the constitutional basis to support the answer to the above mentioned question. Their answer will not come as a surprise to anyone who cares to be objective and non-partisan`.
 

We had the same view, Why Judges ordered recount? For which purpose? And why 21 consituencies?
How outcome of the recount will affect their decision?
