Prime Minister Raila Odinga has filed a fresh application seeking to compel the Independent Electoral and Boundaries Commission (IEBC) to allow a forensic audit of its IT system.

Mr Odinga filed the application under certificate of urgency at the Supreme Court claiming the information contained in the electoral commission’s IT system will be crucial in the main petition he has filed challenging the declaration of Uhuru Kenyatta as winner of the March 4 presidential elections.

Mr Odinga, through lawyer George Oraro, argues that the electoral commission has been giving conflicting and confusing reasons for the failure of the electronic system, which the court needs to be informed before they hear the petitions challenging the presidential election outcome.

“IEBC has given conflicting reasons for failure of the Electronic Voter Identification (EVID), Biometric Voter Registration (BVR) Results Transmission System (RTS) and Results Presentation System (RPS) and other electronic systems and there is urgent need for parties to place empirical forensic evidence to assist the Supreme Court in making a decision,” said Mr Oraro Tuesday.

To facilitate the forensic audit, he wants an order for the preservation of all Media Access Control (MAC) and Internet Protocol (IP) addresses for all mobile devices used for electronic voter identification at each of the 33,400 polling stations across the country.

He also wants a preservation of all the Satellite Mobile Telephone handsets used for result transmission, all SIM Cards, laptops, desktop computers, and all the actual servers on which the electronic data transfer for the IEBC occurred.

Mr Odinga further seeks an order for the IEBC to disclose confidentially to the Supreme Court a catalogue of the names of users and passwords assigned to each user at each of the IEBC offices, places of operation and each of the 33,400 polling stations.

“The commission should also avail all receipts and invoices for each of the hardware or software materials they purchased to conduct electronic and manual transfer of results,” said Mr Oraro.

Mr Oraro said the Supreme Court needs to be informed of the real reasons of the IEBC’s electronic voter transmission failure and its impact on the outcome of the presidential elections to enable the judges reach an informed decision over the dispute.

The application is scheduled to be heard Wednesday morning when the six Supreme Court Judges meet for the first time for a mention of the three petitions filed challenging the outcome of the presidential elections.

Mr Oraro said they were forced to seek the information due to the IEBC’s failure to stick to its promise it made to all political parties that the electronic system will be secure and free from manipulation.

“Prior to the elections, the IEBC assured all stakeholders that the system will be transparent, free from manipulation and that not only would there be no un-authorised persons voting but that the transmission of results would be simple, fair and insulated from manipulation by any person,” said Mr Oraro.

I've said it before that the IEBC came off shady as hell especially after they pulled a switcheroo in the middle of the night by deciding to announce the rest of the presidential results when earlier on they had promised the whole world that they would finish that exercise the following morning.

And it's chairman..oh boy. What can else can I say about him!? It's like he was on a string.

I wish that happens, at least the World will know the shady tactics played there.
My concern is; will that be successful without involving foreign experts and on time? Maana jamaa atakuwa keshaanza kuchakachua system hizo..
 
I once said that Raila would never be a Kenyan President in anyway and he doest not suit in those shoes. He is such a power monger, a revangeful person who claims always to be innocent but with full of rage and stains.

Once again i bet, RAILA ODINGA WILL IN NO WAY BE A KENYAN PRESIDENT. Hafai kabisa mtu huyu. Even the KENYAN voters have said it!

Petition puts Raila’s respect at risk, Muslim leaders claim

Prime Minister Raila Odinga risks losing the respect of the local and international community, Muslim leaders at the Coast have warned.

Kenya Muslims National Advisory Council and Council of Imams and Preachers of Kenya said Raila should drop the petition against the declaration of Uhuru Kenyatta as President-elect at the Supreme Court and concede defeat.

Speaking at the weekend, Kemnac chairman Sheikh Juma Ngao and CIPK organising secretary Sheikh Khalifa Mohamed said Cord should instead focus on how to join hands with Uhuru work together for the benefit of the country.

Sheikh Khalifa said the Cord leaders should guard against their tongues saying they can easily provoke violence amid the tension as the country awaits the verdict of the court.

“Before the elections, everyone said they would concede defeat if they lose. Now some people do not want to concede,” Sheikh Khalifa told a press conference at their Mwembe Tayari offices.

Cord filed their petition on Saturday that seeks to prove that the elections were marred by irregularities and that Uhuru was unfairly declared winner of the presidential race.

Sheikh Ngao yesterday asked the Supreme Court to consider the over 40 million Kenyans who will be affected by their decision. He expressed concern that another general election will be costly for Kenyans and a waste of resources.

“The IEBC did a commendable job. But this petition will paint them in bad light. The international observers would have said so if the elections were rigged,” said Sheikh Ngao.

Kenyans care. History has it that Raila has never conceded in any democratically held elections be it at the party level or at the national level. Let me jog your memory a little bit

After the 1992 General elections and after his party candidate who was also his father came in a distant fourth -Raila then the director of elections in FORD-K disputed and rejected the results . He routed the idea on 1 million man match to state house to Matiba but Matiba opted the Courts way.

In 1994 during the tussle over FORD -K leadership after having lost to Wamalwa Kijana in a free and fair party elections Raila precipitated a tribal split and left with a sizeable number of Luo Mps to NDP.

In 1997 General Elections Raila came in a distant 3rd and there after did a press conference refusing to accept election results and calling for mass action.

In the runnup to 2002 G.E. and after dissolving his party NDP to merge with KANU after sensing defeat in vying for the KANU presidential nominee position he refused to accept themode of nomination and left KANU for NARC

No need to elaborate how he was a thorn in the flesh in his party NARC from 2003 till 2007 - If this isnt stubbornness then what is ?

The most famous refusal to accept Presidential results outcome was ofcourse the 2007 G-E. where he called for Mass action which led to post election violence.

In 2013 elections looking at his past experience we were sure and even predicted to that effect that If Raila was beaten by Uhuru he wont concede and boy oh boy did he disappoint ? Further we are predicting that he will refuse to accept Supreme Courts ruling ,dont be blinded by his statements that he will respect and abide by the ruling didnt he talk of the same on IEBC , didnt he make press advertisements saying if beaten he will concede .Raila is on record saying he respects and has confidence with IEBC and its chairman Isaak Hassan before the elections but when he lost the narrative changed , why so ? what is constant is Raila when beaten can never accept to concede in any democratically held elections.


 
From What I have gathered Raila has never gotten any respect from His detractors and i doubt whether it will change any time soon whether he pursues legal means or not

Tuesday March 19, 2013 - Friends of Raila (FORA) lobby group have told Prime Minister Raila Odinga to drop his petition, before he is embarrassed by the Supreme Court at the end of the verdict.

Speaking to journalists on Monday at a Nairobi hotel, the Director of Mobilisation in FORA Charles Wambugu said CORD lost the election to Jubilee, saying a petition is a waste of time and money since CORD are heavily relying on rumours instead of tangible evidence.

He said CORD did not campaign as aggressively as President –elect Uhuru Kenyatta and his Deputy William Ruto who had the energy and resources to oil their campaign machinery to the end.

"We could not match Jubilee's campaign because while we were lobbying for funds, they were traversing the country on a serious vote hunting mission," Wambugu said.

Wambugu said even if there is a run –off the PM will still be defeated since the tribal arithmetic still favours Jubilee Coalition.

He urged his boss to concede defeat and work with the new government to avoid further embarrassment!
