Justice Must 'Replace Impunity and Violence,' Says U.S.

Washington, DC — Kenyans accused of responsibility for the violence which followed the 2007 elections must answer for their crimes in front of a judicial body, the top U.S. official responsible for policy on Africa has told AllAfrica.

In an exclusive interview, U.S. Assistant Secretary of State for Africa Johnnie Carson indicated that the Obama administration would not agree at the United Nations Security Council to Kenya’s request that the pending trial of Kenyan leaders at the International Criminal Court (ICC) be deferred.

“Let me make it very clear that we are not in favor of… [a deferral],” he said. “It is time for that process of accountability through an agreed-upon legal mechanism to be established so that justice replaces impunity and violence.

“Accountability must be in a process that is open, legally responsible and binding.”

Carson said the United States believed that “the only way to heal the wounds of the past and to create the environment for peace and stability in Kenya is for those individuals who are accused of having engaged in the post-electoral violence to answer to those crimes in front of a judicial body.”

ICC prosecutor Luis Moreno-Ocampo has named six Kenyan leaders – three from each of two groups involved in the violence – as major perpetrators of ethnically-based “crimes against humanity,” including rape, murder and land seizures in post election violence in 2007 and 2008.

Prosecutor Luis Moreno-Ocampo wants Public Service head Francis Muthaura to stop chairing a key security organ.

Mr Muthaura chairs the National Security Advisory Committee, and the International Criminal Court (ICC) fears he might influence the collection of evidence from witnesses and victims of the post-poll violence.

The ICC also would like Deputy Prime Minister Uhuru Kenyatta to relinquish his position on the Witness Protection Board, on which he serves by virtue of his portfolio as Finance Minister.

Mr Moreno-Ocampo said he would write to the government to ensure that Mr Muthaura does not continue to exercise authority over the police.

“Mr Muthaura has a role as a superior of police. Before we take evidence from the police and some witnesses, we want to ensure he has no powers on the police. I will tomorrow (on Tuesday) write a letter to the government to prevent Mr Muthaura from influencing the police,” he said.

The government said Mr Muthaura will continue to chair the committee until the letter is received.

Mr Moreno-Ocampo, however, said it was up to the government to decide when the suspects who still hold government positions should resign from their jobs.

“We know that after the ruling, they are suspects and after they are charged, they will become accused. The government can also define what indictment is under its law.”

Others Mr Moreno-Ocampo holds responsible for crimes during the chaos are MPs William Ruto and Henry Kosgey, former Police Commissioner Hussein Ali and radio presenter Joshua arap sang. They have summonses to appear before pre-trial chamber judges on April 7.

National Security

Mr Muthaura chairs the powerful National Security Advisory Committee that advises the National Security Council President Kibaki chairs on issues likely to threaten the country’s security such as famine. The committee does not take any action.

Members are Vice President Kalonzo Musyoka (as minister for Home Affairs), Yusuf Haji (Defence), George Saitoti (acting Foreign Affairs) and Attorney General Amos Wako.

It also has on board Lt-Gen Njuki Mwaniki (Army Commander), Maj-Gen Harold Tangai (Air Force Commander), Maj-Gen Samson Mathethe (Kenya Navy Commander) Police Commissioner Mathew Iteere and National Security Intelligence Service boss Michael Gichangi.

It is in his role as advisory committee chair that Mr Moreno-Ocampo believes Mr Muthaura instructed the police not to use force against Mungiki fighters who killed and wounded civilians in Naivasha and Nakuru.

On Mr Kenyatta, he said: “Any person who has anything to do with witness protection should not be involved. This is likely to affect the programme.”

Mr Ocampo’s interview with journalists via video link comes against a backdrop of heated political exchanges between PNU and ODM.

On Monday, Mr Moreno-Ocampo did not want to be drawn into arguments that the ICC mission on Kenya was subject to political manipulations.

“The debate about the deferrals by the United Nations Security Council is a political debate. It is valid because the UN Security Council has powers to postpone the proceedings… I am not part of the political debate. I am not interested in anything else other than the killings. How to manage these discussions in a proper way is the duty of the leadership.”

He said that even though the judges dismissed the charges relating to the killings in Nairobi’s Kibera slums and Kisumu, his office was discussing the possibility of appealing, saying, there were technical reasons why the judges did not include the evidence.

“We are debating and we are likely to appeal before the proceedings begin,” he said.

Deputy Prime Minister Uhuru Kenyatta, Eldoret North MP William Ruto and about 50 MPs allied to them on Monday held the last round of prayers before they embark on their journey to The Hague.

The well-attended rally at Gatundu Stadium in Mr Kenyatta’s backyard marked the first time former First Lady Mama Ngina Kenyatta spoke about the summonses issued to the six Kenyans by the International Criminal Court.

The rally was marked by the invocation of the spirit of the founding father of the Nation Mzee Jomo Kenyatta and others who fought for Kenya’s independence from the British.

Mrs Kenyatta said Kenya is not ready to go back to domination under colonial rule and expressed hope that the cases against the Ocampo Six will not succeed.

“Uhuru, Ruto, Muthaura and the rest will go and come back because God sees and knows all and will render justice,” she told the crowd.

She said she will also document her life, with its connection to Kenya’s journey from the pre-independence days to the present day, in a book to be published soon.

She also prayed for her son and Mr Ruto before placing her hands on them as a speech by her husband the First President was played back to the crowd.

The Hague-bound duo also said they would harness their new-found unity to bring about peace in the Rift Valley, the epicenter of the violence they are accused of fuelling.

“You people have prayed for us, but Kenya has many challenges, which we need to tackle to avoid fighting in the future. If we are to have a nation we can be proud of, we have to fight poverty, work hard and create employment,” said Mr Ruto.

He said they would use their development records in the respective ministries they have served to create a formidable alliance ahead of the general election next year.

“Those who imagine the journey has ended should know it has just begun. They have managed to bring us together for this country,” said Mr Kenyatta.

“I believe that the unity we have seen will give us the strength to unite with our brothers from all over the country and develop this nation,” said Mr Kenyatta.

The day begun with a mass at the Gatundu Catholic Church, which was presided over by seven priests and three deacons, with the crowd later walking to the stadium where a host of preachers prayed and anointed them with oil.

Mr Kenyatta was accompanied by his wife Margaret and their children, with a host of relatives, among them former Gatundu MP Ngengi Muigai and former Kenya Airports Authority MD George Muhoho and his brother Gathecha Muhoho.

There was less of the negative language that characterized their earlier forays into Kiambu county and the Rift Valley but there were still some choice words reserved for Prime Minister Raila Odinga.

Transport minister Amos Kimunya spoke of the tribulations of Mr Kenyatta as an ODM plot to haunt him out of government the same way he was forced to exit as Finance minister over the sale of the Grand Regency Hotel.

Mr Kenyatta barely relented in his reference to Mr Odinga as a kimundu (nuisance bully).

“Raila called for mass action yet he is now the darling of the Western world. It cannot be said now that we are the ones who started the war, and those who did it are still free,” said Mr Kenyatta.

“Even if we go and are jailed for 100 years, I’ll know we have contributed to lasting peace in this country,” said Mr Kenyatta.

The Ruto-Uhuru alliance has been marketing itself as one way to bring about peace in the Rift Valley by reconciling the Kikuyu and Kalenjin communities.
