MCA charged with uttering offensive words against Uhuru

A member of the Kisii County Assembly has been charged in court for allegedly undermining President Uhuru Kenyatta in public.

Kiogoro Ward representative Samuel Aboko Onkwani was charged with uttering offensive words against the President.

The court heard that the MCA committed the offence on August 28, 2013, at Kerera Location in Kisii County without a lawful excuse.

He was charged with undermining the authority of a public officer contrary to Section 132 of the Penal Code.

Before Principal Magistrate Kibet Sambu, the court heard that the words uttered by Mr Aboko were calculated to bring into contempt the lawful authority of Mr Kenyatta who is a public officer, namely the President of the Republic of Kenya.

On the said date and function, Mr Aboko was allegedly quoted saying: “Those close to President Uhuru Kenyatta should advise him to stop smoking bhang.”(sic).

The accused, who was represented by advocates Gideon Nyambati and Isaiah Mosota, denied the charges.

His lawyers asked the court to release him on a reasonable bond.

They also sought to be supplied with witness statements and recordings intended to be used as evidence to the claims.

“My Lord we pray that this court releases our client on a reasonable bond, we also ask that we be supplied with witness statements,” said Mr Nyambati.

The prosecution said that it was not possible to supply the defence with the said documents because the investigating officer had not supplied the same to the court.

The court ordered that the accused person be released on a Sh50, 000 bond and a surety of a similar amount or a cash bail of Sh20, 000.

The case will come up for mention on May 14, 2014 and hearing will commence on June 3, 2014.

50 thousand only for a fine is too little. He would have parted with a cool 50 million Kenya shillings. What happened to the hate speech commission? No more summons from them. 50,000? Even me a walalhoi I can raise that money. What about a corrupt extortionist politician spewing insults in public rallies

50 thousand KES is equivalent to almost 1 million TZ shillings!
 
wonder if it still exists or was it a self serving commission? using a platform like that is like saying the constitution is not clear on the conduct of an MCA in public. It is understandable that it does not exist anymore because there were no post election violence this time around. But such utterances may be a buildup to something mega in future.

Lets be serious with some of these phrases we are using here. Where is hate speech in this piece if I may ask?
FYI, what has been said is not an insult but a known fact about the KE president. It's no big deal to smoke weed
and even Jomo Kenyatta did it. This act of summoning this Kisii chap does not augur well for Uhuru Kenyatta as
it reeks of intimidation just like the days of one Arap Moi.

is really puttting him in a tight corner. The man loves to hang and indulge...this presidency thing is

And why would the court be interested to know that. The guy insulted the presidency, so he is on his own. The is no absolute freedom to expression. Nenda hapo Posta afu mtusi Jakaya kwa sauti tuone kama una mapumbu ya vyuma.

you don't know lawyers! If GOK wants to be embarrassed they should go forward and press charges and then you will see what it means an accusation being proven true!
