RETIREMENT BENEFITS
85-(1) Where a public servant's service is terminated on grounds other than disciplinary, he shall be granted his retirement benefits in accordance with the law applicable to the grant of those benefits for the time being in force. (2) Public servants retirement benefits shall be governed under; (a) the Public Service Pensions Fund for all public servants other than those employed in the Local Government Authorities; (b) the Local Authority Provident Fund, for all public servants employed in the Local Government Authorities; (c) the National Social Security Fund for public servants in the Operational Service; (d) the Government Employees Provident Fund.
86.- (1) Where a public servant is transferred from one service to another within the Public Service, his terminal benefits, in respect of the serYice he is transferred from, may be frozen and shall be payable on his retirement on grounds allowing payment of terminal benefits. (2) The public servant transferred pursuant to the provisions of subregulation (I) of this Regulation shall decide whether to continue with his membership in the scheme he was formerly governed with vr join and contribute to the scheme governing the sc1vice to which he is tr an sf erred. 114 Public Service Regulations GN. /lio. 168 (contd.)
87. The benefits payable under these Regulations are any benefits payable under any law providing for the grants of any pension, compensation, gratuities or other allowances to persons in respect of their service as public servants to their widow, widowers, children, dependants or personal representatives of such persons in respect of that service. 88. Subject to the provisions of Regulation 19 of these Regulations, a person who is engaged on contract shall, on terminatiop of his service, be paid a gratuity payable either in accordance with the terms of contract he entered in, or in accordance with the provisions of the laws applicable for retirement benefits in force for the time being. 89.-{l) It shall be the duty of both employer and employee to keep employment records for the purposes of reference for calculation of the employee terminal benefits. (2) Employment records kept by both employer and employee shall be regarded as original copies duly signed by authorised person. (3) Where there is no possibility to get hold of employment records from the employer's end, records in custody of the employee shall be used for any purpose provided that such records are in the original form.
88. Determinant ya mafao ya mtumishi yoyote wa umma yanakuwa determined na nature ya ajira yake kama ni permenent na pensionable au contract. Kitendo cha Mzee wako kulipwa milioni 2 tuu ni taarifa ya awali kuwa ajira yake kabla ya kuteuliwa kuwa DC ilikuwa ni contract, hivyo siku alipoteuliwa DC, ile ajira yake ya awali ilikwishwa. Alipaswa kupata mafao yake ya muda aliotumikia umma hadi alipopata uteuzi wa UDC.
Huo UD aliteuliwa kipindi cha Mwinyi na kuwa DC miaka yote ya Mkapa, JK ndio akaja kumtema.
Baada ya kuwa DC kwa miaka 16, ma RC na ma DC ni political posts, they are not pensionable bali hulipwa gratuity kila baada ya miaka 5, hivyo hakuna pensheni yoyote kwa miaka yake yote 16 ya UDC ila gratuity alikuwa anapata, muulize vizuri tuu gratuity alipeleka wapi but its not much.
Baada ya kutoteuliwa na JK alipolekwa Maendeleo ya Jamii, alikwenda kuanza upya kwa sababu kabla ya UD contract take ilikwisha, hivyo hizo milioni mbili ndio mafao yake baada ya kuanza upya.
Kama kabla ya UDC alikuwa pensionable, na barua anazo, then alikuwa ni kada ya chini sana, alipoteuliwa DC, ile ajira ili free kwa miaka 16 ya uDC, alipo achwa ndipo akaja kuifufua, hivyo malipo hayo ya milioni 2 ni malipo ya tangu ajira ilipofufuliwa hadi anastaafu, pensheni yake kabla ya uteuzi wa DC ilikuwa inalipwa hazina maana mifuko ya PSPF, LAPF na GEPF ilikuwa haijazaliwa.
Mimi ni mfano wa Ma DC 5 waandishi wa habari, ambao wote waliteuliwa from Newsrooms, Betty Mkwasa, Shabani Kissu, Ahmed Kipozi, Muhingo Rweyemamu na Jacline Liana.
