(34) باب مَا جَاءَ فِي بِئْرِ بُضَاعَةَ
Narrated AbuSa'id al-Khudri:
The people asked the Messenger of Allah (ﷺ): Can we perform ablution out of the well of Buda'ah, which is a well into which menstrual clothes, dead dogs and stinking things were thrown? He replied: Water is pure and is not defiled by anything.
حَدَّثَنَا مُحَمَّدُ بْنُ الْعَلاَءِ، وَالْحَسَنُ بْنُ عَلِيٍّ، وَمُحَمَّدُ بْنُ سُلَيْمَانَ الأَنْبَارِيُّ، قَالُوا حَدَّثَنَا أَبُو أُسَامَةَ، عَنِ الْوَلِيدِ بْنِ كَثِيرٍ، عَنْ مُحَمَّدِ بْنِ كَعْبٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ رَافِعِ بْنِ خَدِيجٍ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ، أَنَّهُ قِيلَ لِرَسُولِ اللَّهِ صلى الله عليه وسلم أَنَتَوَضَّأُ مِنْ بِئْرِ بُضَاعَةَ وَهِيَ بِئْرٌ يُطْرَحُ فِيهَا الْحِيَضُ وَلَحْمُ الْكِلاَبِ وَالنَّتْنُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " الْمَاءُ طَهُورٌ لاَ يُنَجِّسُهُ شَىْءٌ " . قَالَ أَبُو دَاوُدَ وَقَالَ بَعْضُهُمْ عَبْدُ الرَّحْمَنِ بْنُ رَافِعٍ .

The Prophet went out to answer the call of nature and asked me to bring three stones. I found two stones and searched for the third but could not find it. So took a dried piece of dung and brought it to him. He took the two stonesand threw away the dung and said, "This is a filthy thing."

It was narrated from 'Abdullah bin Mas'ud:
"The Messenger of Allah went to the toilet and said: 'Bring me three stones.' So I brought him two stones and a piece of dung. He took the two stones and threw the dung away, saying: 'It is impure.'"

وَعَنِ ابْنِ مَسْعُودٍ - رضى الله عنه - قَالَ: { أَتَى اَلنَّبِيُّ - صلى الله عليه وسلم -اَلْغَائِطَ, فَأَمَرَنِي أَنْ آتِيَهُ بِثَلَاثَةِ أَحْجَارٍ, فَوَجَدْتُ حَجَرَيْنِ, وَلَمْ أَجِدْ ثَالِثًا. فَأَتَيْتُهُ بِرَوْثَةٍ. فَأَخَذَهُمَا وَأَلْقَى اَلرَّوْثَةَ, وَقَالَ: "هَذَا رِكْسٌ" } أَخْرَجَهُ اَلْبُخَارِيّ ُ (119) .

Question
I am usually out at school most of the day and I have to use the bathroom, I can't just go home to make Istinjah. Should I make Wudu and pray or should I miss the prayer and make it up later?.

Praise be to Allaah.
When a person relieves himself, he must cleanse himself of impurities either with water – which is best and most perfect – or with something other than water which will remove the impurities, such as toilet paper, fabric, stones or something else.
Shaykh Ibn ‘Uthaymeen said:
When a person relieves himself, he must do one of the following three things.
1 – He may purify himself with water, which is permissible. The evidence for that is the hadeeth of Anas (may Allaah be pleased with him) who said: “The Prophet (peace and blessings of Allaah be upon him) used to relieve himself, then another boy and I would bring a vessel of water and a short spear [to use as a sutrah for the prayer he was going to do after doing wudoo’] and he would cleanse himself with the water.”
(Narrated by al-Bukhaari, 149; Muslim, 271)
The reason for that is that the basic way of removing impurities is to use water. Just as you use water to remove any impurities from your foot, so too you use it to remove any impurities resulting from relieving yourself.
2 – He may purify himself using stones. Doing istijmaar or removing impurities with stones is sufficient. This is indicated by the words and actions of the Messenger (peace and blessings of Allaah be upon him). With regard to his words, Salmaan (may Allaah be pleased with him) said: “The Messenger of Allaah (peace and blessings of Allaah be upon him) forbade us to use less than three stones for the purpose of istijmaar.”
(Narrated by Muslim, 262).
With regard to his actions, Ibn Mas’ood (may Allaah be pleased with him) said: “The Prophet (peace and blessings of Allaah be upon him) went out to answer the call of nature and asked me to bring him three stones. I found two stones and searched for a third but could not find one. So I took a piece of dried dung and brought it to him. He took the two stones and threw away the dung and said, ‘This is a filthy thing.’”
(Narrated by al-Bukhaari, 122).
The hadeeth of Abu Hurayrah, which states that he gathered some stones for the Prophet (peace and blessings of Allaah be upon him) and brought them to him in his garment, put them down next to him then went away (narrated by al-Bukhaari, 154) indicates that istijmaar (using stones to cleanse oneself after relieving oneself) is permissible.
3 – Cleaning oneself with stones then with water.
I do not know of any report to this effect from the Prophet (peace and blessings of Allaah be upon him), but there is no doubt that this is more effective in cleaning.

Based on this, you have no excuse for not praying or for delaying the prayer beyond the appointed time because you are not able to do instinja’ (wash with water after relieving yourself), because you can remove the impurity and cleanse yourself of it using tissues and the like. Everyone can carry some tissues with him in his pocket to clean himself with. Moreover, it is not clear from the question what is stopping you from cleaning yourself with water after relieving yourself, especially since you say, “Should I make wudoo’ and pray or miss the prayer?” What that means is that water is available, so you can bring some water to the toilet and use it to clean yourself. If you do not do that then you have to remove the impurity using tissues and the like, then do wudoo’ and pray. It is not permissible for you to delay the prayer until the time for it has passed.

I heard that the people asked the Prophet of Allah (ﷺ): Water is brought for you from the well of Buda'ah. It is a well in which dead dogs, menstrual clothes and excrement of people are thrown. The Messenger of Allah (ﷺ) replied: Verily water is pure and is not defiled by anything.
Abu Dawud said I heard Qutaibah b. Sa'id say: I asked the person in charge of the well of Bud'ah about the depth of the well. He replied: At most the water reaches pubes. Then I asked: Where does it reach when its level goes down ? He replied: Below the private part of the body.
Abu Dawud said: I measured the breadth of the well of Buda'ah with my sheet which I stretched over it. I them measured it with the hand. It measured six cubits in breadth. I then asked the man who opened the door of garden for me and admitted me to it: Has the condition of this well changed from what it had originally been in the past ? He replied: No. I saw the color of water in this well had changed.
حَدَّثَنَا أَحْمَدُ بْنُ أَبِي شُعَيْبٍ، وَعَبْدُ الْعَزِيزِ بْنُ يَحْيَى الْحَرَّانِيَّانِ، قَالاَ حَدَّثَنَا مُحَمَّدُ بْنُ سَلَمَةَ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ، عَنْ سَلِيطِ بْنِ أَيُّوبَ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ رَافِعٍ الأَنْصَارِيِّ، ثُمَّ الْعَدَوِيِّ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ، قَالَ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم وَهُوَ يُقَالُ لَهُ إِنَّهُ يُسْتَقَى لَكَ مِنْ بِئْرِ بُضَاعَةَ وَهِيَ بِئْرٌ يُلْقَى فِيهَا لُحُومُ الْكِلاَبِ وَالْمَحَايِضُ وَعَذِرُ النَّاسِ . قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " إِنَّ الْمَاءَ طَهُورٌ لاَ يُنَجِّسُهُ شَىْءٌ " . قَالَ أَبُو دَاوُدَ وَسَمِعْتُ قُتَيْبَةَ بْنَ سَعِيدٍ قَالَ سَأَلْتُ قَيِّمَ بِئْرِ بُضَاعَةَ عَنْ عُمْقِهَا قَالَ أَكْثَرُ مَا يَكُونُ فِيهَا الْمَاءُ إِلَى الْعَانَةِ . قُلْتُ فَإِذَا نَقَصَ قَالَ دُونَ الْعَوْرَةِ . قَالَ أَبُو دَاوُدَ وَقَدَّرْتُ أَنَا بِئْرَ بُضَاعَةَ بِرِدَائِي مَدَدْتُهُ عَلَيْهَا ثُمَّ ذَرَعْتُهُ فَإِذَا عَرْضُهَا سِتَّةُ أَذْرُعٍ وَسَأَلْتُ الَّذِي فَتَحَ لِي بَابَ الْبُسْتَانِ فَأَدْخَلَنِي إِلَيْهِ هَلْ غُيِّرَ بِنَاؤُهَا عَمَّا كَانَتْ عَلَيْهِ قَالَ لاَ . وَرَأَيْتُ فِيهَا مَاءً مُتَغَيِّرَ اللَّوْنِ .

Verse commentary
the meaning of `ummiallah said,
وَمِنْهُمْ أُمِّيُّونَ
(and there are among them ummyyun people) meaning, among the people of the book, as mujahid stated. ummyyun, is plural for ummi, that is, a person who does not write, as abu al-`aliyah, ar-rabi`, qatadah, ibrahim an-nakha`i and others said. this meaning is clarified by allah's statement,
لاَ يَعْلَمُونَ الْكِتَـبَ
(who know not the book) meaning, are they not aware of what is in it.ummi was one of the descriptions of the prophet because he was unlettered. for instance, allah said,
وَمَا كُنتَ تَتْلُو مِن قَبْلِهِ مِن كِتَـبٍ وَلاَ تَخُطُّهُ بِيَمِينِكَ إِذاً لاَّرْتَـبَ الْمُبْطِلُونَ
(neither did you (o muhammad ) read any book before it (this qur'an) nor did you write any book (whatsoever) with your right hand. in that case, indeed, the followers of falsehood might have doubted) (29:48).also, the prophet said,«
إِنَّا أُمَّةٌ أُمِّيَّةٌ لَا نَكْتُبُ وَلَا نَحْسِبُ، الشَّهْرُ هكَذَا وَهكَذَا وَهكَذَا»
(we are an ummi nation, neither writing nor calculating. the (lunar) month is like this, this and this (i.e. thirty or twenty-nine days.)this hadith stated that muslims do not need to rely on books, or calculations to decide the timings of their acts of worship. allah also said,
هُوَ الَّذِى بَعَثَ فِى الأُمِّيِّينَ رَسُولاً مِّنْهُمْ
(he it is who sent among the ummiyyin ones a messenger (muhammad ) from among themselves) (62:2).the explanation of amaniad-dahhak said that ibn `abbas said that allah's statement,
