TWO agreements were signed between Deputy Prime Ministers Musalia Mudavadi and Uhuru Kenyatta on December 4.

The first was an addendum to the coalition agreement between Uhuru's TNA party and William Ruto's URP party that now added Mudavadi's UDF party.

But a private agreement between Uhuru and Mudavadi was signed just before that addendum was deposited with the Registrar of Political Parties at 7.30pm on the deadline of December 4. In the agreement Uhuru surrendered his candidacy for the presidency to Mudavadi.

"The agreement was signed by Uhuru's private residence on Dennis Pritt Road witnessed by Ruto in the presence of two lawyers - for Uhuru being Desiderio Oyatsi and for Mudavadi being Dan Ameyo. The only other persons being witnesses were Hon Beth Mugo and Hon Ngengi Muigai, who are both first cousins to Uhuru, and Jomo Gecaga, his nephew," said a close associate of Musalia Mudavadi.

"The question then arises, which of these immediate family members were the 'Shetani' who put pressure on him?" asked the high level UDF political analyst.

Earlier this week, Uhuru reneged on the Mudavadi presidency agreement after coming under pressure from hardline Central Province MPs and TNA delegates. Uhuru told them on Tuesday that he had been forced to sign the deal by "dark forces" and "Shetani" (Satan).

It was widely believed that Uhuru was referring to State House and NSIS. They allegedly believe that Mudavadi would be a safer candidate than Uhuru because of the complications of having a president who is absent on trial in the Hague.

The close associate, who was involved in all the negotiations, explained why Mudavadi felt so bitter about the turnaround by Uhuru. "Over the last six months, Uhuru, Ruto and Mudavadi have been consulting about a joint coalition for purposes of running a joint coalition candidate, and during that period Uhuru had consistently hinted at supporting Musalia," said the associate.

He told Mudavadi that he remembered his political sacrifice in standing by him when Uhuru stood for president in 2002.

"When they met at the funeral of Saitoti, Uhuru leaned off and said to Tessie, Musalia's wife, "you can see your husband is going through this difficult challenge. Don't worry I will be there to protect you when he has to run into the den of lions when seeking the presidency," he said.

"About two months ago, when the moves to support the ethic communities over the ICC matters started growing up, they slowed down the consultations they had been having with Musalia. Uhuru and Ruto announced they were going to form a coalition with a joint ticket for president and deputy president. And they prepared to formalise the coalition with just two parties," he said.

"Musalia got in touch with Ruto about what was happening. Ruto's explanation was that 'this thing is more than politics for us, it's life and death and we are bonded together like we are joined at the hip,'" he said.

Musalia and UDF leaders then started looking for other groups "to have an alternative coalition to Uhuru and Ruto, to bring together people who are a force for stability," he said. The main potential partner they negotiated with was Perter Kenneth and his KNC party.

On the night of December 3, the day before the legal deadline to file coalition agreements with the Registrar of Political Parties, Peter Kenneth met Raphael Tuju of the PPP and Eugene Wamalwa of New Ford Kenya.

He advised them that it would be advisable to have as many parties in the 'third force' as possible. "The completion of the coalition agreement between UDF and KNC which was under preparation was then deferred to the next day, December," said Mudavadi's associate. The coalition was due to be announced at Freedom Corner in the morning.

However the Mudavadi team failed to make contact with Kenneth on that Tuesday morning while Eugene announced he was going to hold a press conference at the Norfolk.

"Meanwhile from about 11.30am, Ruto and Uhuru were trying to call Mudavadi who refused to take their calls. His lieutenants advised him that these might be delaying tactics to lock him out of the new coalition," said the associate.

"By midday, Mudavadi had still not got any response from Kenneth. At 12.45 he agreed to take the call from Uhuru who said that he and "my bother Bill' urgently needed to see him and were coming to his residence."

Kenneth then called Mudavadi to apologise for not returning his calls because he had been at a Rotary lunch and had left his phone outside. "But it was already too late," said the associate.

At around 2.30pm Gideon Moi and Nick Salat arrived at Mudavadi's home in Riverside in Nairobi. They said they were willing to sign the UDF draft for a coalition. They were shown to a side room.

"A blue Range Rover then arrived chauffeured by Bill Ruto and his only passengers were Uhuru Kenyatta, (Chirau) Mwakwere, and (Najib) Balala," said the associate.


"Uhuru asked Mudavadi 'are you ready to be president? Will you be ready to share power with the colleagues if they support you?" "I have reflected on my situation, consulted with my people, and I have made my personal decision to reinstate the discussions that you and I had been having," Uhuru said, according to the associate.

"Bill and I are ready to offer you to join the coalition formed by the two of us. We will make an addendum offering 1/3 of all portfolios in government to your party and offering you to be the presidential candidate," Uhuru continued.

The only condition was that "since Bill remains the Deputy President", both UDF and URP should cede a percentage of their seats to TNA "as a gesture of goodwill". "MM was reflecting is this a joke, or is this real?" said the associate.

Uhuru suggested that the addendum could be signed by the chairmen and secretary-generals of the three parties. "Then we will sign a second agreement by which I surrender my candidature for the presidency to you, but only submit the addendum to the Registrar of Political Parties after that has been signed," the associate reported Uhuru as saying.

Mudavadi walked out, consulted his lieutenants, and then returned to agree to the deal and stop his other negotiations. The chairmen and secretary generals of UDF, URP and TNA were then sent to Laico Regency to work out the final details of the addendum.

The three principals and their lawyers left Riverside and drove to Uhuru's home on Dennis Pritt road. Party representatives also went to the Registrar's office at Anniversary Towers to make certain she did not close the office before the addendum was submitted.

"Word was passed to UDF representatives at Laico and Anniversary Towers to drag your feet until the presidential agreement is signed and sealed. That is why the submission was only done at 7.30pm after the second agreement had been signed," said the associate.

On Wednesday morning on Citizen TV, Ruto confirmed that he had been present when Uhuru signed the deal promising the presidency to Mudavadi.

Deputy Prime Minister Musalia Mudavadi has hit out at Uhuru Kenyatta and William Ruto after the two rushed to announce that they had agreed to part ways with him.

Musalia angrily reacted to the announcement by Uhuru and Ruto that they had ‘mutually' agreed by consent to part ways and allow the UDF leader continue with his presidential campaigns after collapse of their negotiations.

The DPM through his spokesman's Kibisu Kabatesi said he had already severed ties with the two; a decision he was to announce in Nyeri but they rushed to pre-empt the announcement.

Musalia says he decided to quit since he cannot work with leaders who cannot honour simple commitments but chose to live in ‘deceit and deception'.

"We would like the public to know that the hurried announcement is a feeble attempt to pre-empt Hon. Mudavadi's announcement today in Nyeri severing a partnership that has been characterised by endless comedy of errors rather than serious leadership," Kibisu said.

The statement accused the TNA and URP leaders of dishonesty adding that the Sabatia MP had already informed the couple of his decision to severe ties on serious grounds of dishonour, and lack integrity and commitment by the couple.

"Reports that Hon. Uhuru Kenyatta and Hon. William Ruto have purportedly "dropped" Hon. Musalia Mudavadi from the Jubilee Coalition paint the couple as dishonourable heartless and cheeky to the extreme. Their claim is impolite and an abuse of the collective intelligence of Jubilee Coalition supporters and Kenyans who are aware of legal provisions governing political coalitions,"Kibisu said.

Uhuru and Ruto had earlier on told journalists at the URP presidential campaign secretariat that the UDF leader was no longer part of their jubilee coalition.

Ruto said; "We have had intense consultations from yesterday which extended to this morning and have resolved by mutual consent to let our partners UDF proceed with their campaigns and us (TNA and URP) proceed with our programmes."

"Given our inability to agree on the way forward, we have agreed as gentlemen not to distract our plans as we disengage and allow our brothers in UDF to continue on their own," Uhuru added.

The two were addressing journalists at URP Presidential secretariat moments after receiving assistant ministers Mohamed Mohamed (Energy) and Mohamed Gabow (Special Programmes) who quit ODM for URP. The leaders who defected were joined by former Mandera central MP Billow Kerrow and a host of aspirants mainly drawn from Mandera County.

Musalia is said to have told off Ruto and Uhuru on Thursday evening saying he was willing to take a gamble and be on his own instead of working with ‘people who are dishonesty and lack integrity' even after they sought to convince him that they can choreograph the NDC to nominate him as the coalition candidate.

The two had met him on Thursday evening at a private apartment in Westlands area but failed to convince him to stay in the alliance. They parted ways after failing to strike a balance and requested for another meeting yesterday morning to try and unlock the stalemate.

However, yesterday morning the DPM refused to meet them and insisted he was heading to Nyeri for a UDF rally. Uhuru then got wind that he was going to announce the ‘divorce' but rushed to Ruto's office to make the announcement jointly.

A public standoff between Musalia and Uhuru over how to pick a Jubilee Alliance presidential candidate has been in the media headlines with secret deals between the two coming to light.

Uhuru had agreed to back Musalia for the ticket, but rescinded his decision insisting that the two face each other at joint nominations while claiming he was coerced by dark forces to make the commitment.

This was in reference to Uhuru's arm-twisting after he beat about-turn and rescinded a promise what the UDF team considers flimsy grounds; the devil's influence.

Yesterday's announcement ended a political engagement between TNA/URP and UDF which lasted exactly sixteen days having begun on the evening of 4th December 2012.

Uhuru and Ruto had days earlier unveiled their alliance which was cemented on 3rd December with their pact deposited at the office of the Registrar of Political parties.

However, the following day Prime Minister Raila Odinga, Vice President Kalonzo Musyoka and Trade Minister Moses Wetang'ula announced their Cord alliance; which appears to have sent panic in the Jubilee alliance with the two leaders accompanied by MPs Chirau Mwakwere and Najib Balala dashing to Musalia's Riverside Drive home.

Unknown to his peers, Uhuru had a ready written document committing himself to drop out of the race and support Musalia as the jubilee candidate. The DPM later disowned the document claiming it was the work of evil forces that sought to undermine the UP/TNA agreement.

During yesterday's press briefing, the Gatundu south MP defended his actions saying he meant well for the country and its unity when promising to step aside for the Sabatia MP.

"Because our principal calling is not about individuals and we were willing to concede positions for the sake of unity and reconciliation but we now sincerely wish him well," he added.

The DPM refused to answer a straight question of whether he had duped Musalia and only answered to the affirmative when asked another question of whether the ‘devil that misled' him has been overcome.

The Gatundu South MP took a swipe at main rivals Cord alliance saying ‘the ODM ship was sinking and no Cord can hold it together."

The jubilee leaders announced that they will be in Tononoka, Mombasa today for a rally before returning to Nairobi where they will have a delegate's conference to endorse their line up tomorrow (Sunday).

"If the issue was "democratic" for Mudavadi to be nominated through "delegates", how democratic is it to "endorse" Uhuru at a makeshift unknown delegates' conference?" Musalia scoffed at the planed NDC.

UDF Party on Friday said that Deputy Prime Minister Musalia Mudavadi severed links with Jubilee coalition on serious grounds of dishonour and lack of integrity by Uhuru Kenyatta and William Ruto.

Mr Mudavadi, who was on a tour in Nyeri County on Friday said he was not bitter with his Jubilee colleagues and that doors for reconciliation were still open.

Mr Mudavadi told Nyeri residents that Deputy Prime Minister Uhuru Kenyatta approached and pledged to support him for the unity of the country but wondered why he could not keep his promise.

""My friend came to me saying we must unite the country and remove stereotypes and suspicions among our people. I have always stood for peace, unity and against ethnic divisions and so I agreed it was time Kenya forged ahead under a Jubilee generation', he said narrating the events of December 4 that lead to the formation of the Jubilee Coalition.

"I have no animosity between myself and Jubilee principals. The door is still open for reconciliation," he added.

UDF also dismissed the 'dropping' of Mr Mudavadi by Jubilee painted Mr Kenyatta and Mr Ruto as "dishonourable and cheeky to the extreme."

"Their claim is impolite and an abuse of the collective intelligence of Jubilee Coalition supporters and Kenyans who are aware of legal provisions governing political coalitions," said the statement.

It added, "It is the mark of their traditional dishonourable ways that these fellows find fun in lying to the public."

UDF claims that announcement was a feeble attempt to pre-empt Mudavadi's announcement on severing ties with Jubilee on Friday while on a tour in Nyeri.

UDF says Jubilee leaders cannot therefore claim to have 'dropped' Mr Musalia because had already walked out on "grounds of fraudulent misrepresentation."

"If the issue was 'democratic' for Mudavadi to be nominated through 'delegates', how democratic is it to 'endorse' Uhuru at a makeshift unknown delegates' conference?"

"If they thought they had schemed to prevent Hon Mudavadi from ascending to the presidency, they bet on the wrong car because Hon Mudavadi continues his campaigns for the presidency on UDF ticket undeterred," added the statement.

The problem with anti-democratic elements like Musalia is they actually do not have a solid footing politically nationally, they have procrastinated so much of their energy, careers, and financial resources serving under cartels and regimes. Now he befits the nature of an oppositionist. Too bad the game of politics is run on a separate set of rules and he has on a second occasion fallen out of a coalition making his political future is bleek

Ni kweli kupungua kwa wapiga kura kujisajili ni ujumbe tosha kuwa wakenya wameamua kuipa shughuri zao nafasi ya kwanza juu ya mengine. Nikitazama anga za siasa za Kenya, bado uchaguzi wa urais unasukumwa sana na uwezo wa mtu binafsi kujikampeinia na kumobiliza kura atakazozichukua. Hivi tu maoni/au opinion polls bado si a strong indicator kuwa ushindi. Huenda uchaguzi ujao utabainisha maneno ninayosema. Vilevile uhuru amepata mashinikizo kutoka kwa wafanyabiashara wakubwa nchini Kenya kumwachia Mudavadi kwa sababu ya "stability" ya kenya................kwa maana ya kuwa kama Uhuru na Rutto wote wakitiwa hatiani na hague au hata kuhudhuria kesi hiyo inaamaana nchi itakuwa mikononi mwa nani?
