Naomba msaada wa kisheria nimepewa NOTICE na mwenye nyumba wangu

Yaani wewe unaingia upangajii bila mkataba?? Hela uliandikiana wapi? Basi huyu mwenye nyumba alishajua kuwa huna makaratasi hivyo huwezi kupata nguvu kisheria. Wako wengi wenye nyumba matapeli. Ni fundisho, kawaida kama unapanga ni bora utafute mkataba ya upangaji utengeneze uwe na kopi na kama unahamia mahali na mwenye nyumba hana mkataba basi unampa ya kwako anasaini.

Ni kweli hayo usemayo but watanzania wengi sana hatujari mambo hayo ya mkataba tunaaminiana sana japo ni muhimu sasa kama sikua na mkataba ndio sina haki tena?
 
Hakuna ugomvi wowote na hakuwahi kunipa mkataba na mbaya alisubili nimelipa kodi after mwezi mmoja ndo akaleta notice nihame

Covenants implied in leases on part of lessee
(1) There shall be implied in every lease, other than a short term lease,
covenants by the lessee with the lessor binding the lessee–
(a) to pay the rent reserved by the lease at the times and in the manner
specified in the lease;
(b) to use any land in a sustainable manner and in accordance with any
conditions imposed on that use of that land by the lease, or with
any written law or with any provisions in a grant of a right of
occupancy of the land out of which that lease has been created and
in particular, unless the purpose for which the land has been leased
cannot be carried out without so doing, not to cut down, injure or
destroy any living tree on the land;

sect 79 79. Periodic leases(1) Where in any lease–
(a) the term is not specified and no provision is made for the giving of
notice to terminate the tenancy, the lease shall be deemed to be a
periodic lease;
(b) the term is from week to week, month to month, year to year or any
other periodic basis, it shall be treated as a term for a period equal
to its minimum possible duration;
(c) the lessee remains in possession of land with the consent of the
lessor after the term of a lease has expired, then–
(i) unless the lessor and lessee have agreed, expressly or by
implication, that the continuing possession shall be for some
other period, the lease shall be deemed to be a periodic one;
and
(ii) all the terms and conditions of the lease that are consistent
with the provisions of subparagraph (i) continue in force
until the lease is terminated in accordance with this section.
(2) Where the holder of a right of occupancy permits the exclusive occupation
of the land or any part of it by any person at a rent but without any

agreement in writing, that occupation shall be deemed to constitute a
periodic tenancy.
(3) The periodic tenancy to which paragraph (a) of subsection (1) refers shall
be the period by reference to which the rent is payable.
(4) A periodic tenancy may be terminated by either party giving to the other
notice, the length of which shall be not less than the period of the tenancy
and shall expire on one of the days on which rent is payable.
80. Short term leases
(1) A short term lease is a lease which is–
(a) made for a term of one year or less;
(b) a periodic tenancy for periods of one year or less;
(c) a lease to which subsection (2) of section 79 applies.
(2) A short term lease may be made orally or in writing.
(3) A short term lease is not a registrable interest in land but any lease of a
short term lease may–
(a) where the short term lease has been granted out of a right of
occupancy registered under the Land Registration Act Cap. 334*,
enter a caveat under Part IX of that Act to protect that lease;
(b) where the short term lease has been granted out of an interest in
land registered under the Registration of Documents Act Cap. 117*,
enter a caveat under section 32 of that Act to protect that lease.
81. Lease terminating on the occurrence

Sasa nimekuelewa maana yake ni kwamba uhame baada ya kuwa kodi yako imeisha ndo maana amekwambia ifikapo april mosi mana anajua ndo kipindi ambacho ulitakiwa ulipe tena, sasa ndugu yangu hapo huna hata haja ya kutafuta sheria ya kukusaidia, ni kwamba mwenye chake hataki tena uendeleee kuwepo na hakuna kinachoweza kumlazimsha hata serikali yenyewe haiwezi kumlazimisha uendelee kuwepo kwenye nyumba yake, anza kutafuta nyumba sasahivi, na ushukuru amekupa hata huo mwezi mzima wa kujiandaa ingekuwa mbaya zaidi kama angekushtukiza ndani wiki moja, na kwa vile anataka uondoke mwanzoni mwa mwezi wa 4 ambao ndo ungelipa kodi basi hiyo ambayo ungetakiwa kulipa hapo uiandae ili ulipe sehemu nyingine utakayopata

na usije kurudia siku nyingine kulipa kodi bila mkataba, wala bila kuwa na uhakika kwamba unaemlipa ndie mwenye nyumba tena ikibidi muende mkaandikishine serikali za mitaa, hayo mambo ya nyumba sikuhizi yamekuwa na utapeli sana
 
Sawa mkubwa ila hiyo lugha imekuja na meli tena ubaya wake ni ya kisheria tumia lugha mama kumjulisha muomba msaada.
 
Hakunipa mkataba

Marekebisho ya Sheria ya Ardhi ya 1999 yaliyofanywa 2005 yanasema hivi: Mwenye nyumba anapaswa kutoa notisi ya siku 30 kuhama. Uwe na mkataba au la notisi ni siku 30. Kama hukufanya kosa lolote anapaswa kukurudishia sehemu ya kodi ambayo imebakia. Hata hivyo kama hukufanya kosa ni lazima awe na sababu za msingi za kukupa notisi- labda anahitaji nyumba hiyo kwa matumizi yake au amebadili matumizi ya nyumba hiyo n.k. kama unaona hana sababu za msingi peleka malalamiko yako Baraza la Kata na usiporidhika na uamuzi kata rufaa Baraza la Ardhi na Nyumba la Wilaya. nako usiporidhika kata rufaa mahakama Kuu Kitengo cha Ardhi. Siku nyingine usipange nyumba bila mkataba wa maandishi.
