The Constitution Of Kenya 2010,
Chapter 14
240. (1) There is established a National Security Council.
(2) The Council consists of—

(a) the President;

(b) the Deputy President;

(c) the Cabinet Secretary responsible for defence;

(d) the Cabinet Secretary responsible for foreign affairs;

(e) the Cabinet Secretary responsible for internal security;

(f) the Attorney-General;

(g) the Chief of Kenya Defence Forces;

(h) the Director-General of the National Intelligence Service;
and
(i) the Inspector-General of the National Police Service

Now, here below are the members as it stands by now..

I am a disgruntled Kenyan when security appointments are made on a tribal basis...this is alarming if true, maybe Kabaridi can confirm if this is the structure of the advisory commitee on entirity and plus;
Confirm that this armophous body is pegged on the constitution and not a hot air committee.
I know of the National Security Council chaired by the presidency.
When was the National Security Advisory Commitee created, is it legal with a constitution backing and does it otherwise usurp the powers of the presidency and the parent national security council functions?

That is the real structure of NSAC. It is constitutional organ, under the New Constitution dispensation. National Security Advisory Council replaces the National Security Council (under the former constitution). Kabaridi can add something here..!

Its even not making sense, national security advisory committee is chaired by head of public service, Mr. Kimemia.
The National Security Council is chaired by the presidency.
When was this NSAC outfit created, its definitely not in the Kenyan constitution, atleast am not aware this far, i havent seen an act of parliament that created it, i dont know who permitted this group to exist outside the constitution and usurp powers of the presidents' led National Security Council.....
However, political gatherings might polarise this nation; i leave that to CORD but who created this outfit? If it is disobeyed, what will be the consequences coz trust me Raila will disobey it....what happens next? Find a legal backing asap....

My fingers were too fast to type, how comes this outfit is chaired by head of public service and not the presidency, when was the president allowed to subjudicate his tasks to a juniour officer ie head of PS whom wasnt elected, but appointed.......
Me thinks this outfit is unconstitutional to the latter

Well,under the current Constitution the PS is the Secretary to the council. That's for sure. Though Mr Kimemia had Chaired the Council before,now i dont know if The constitution allow that.
 
Just from perusing my copy of the costitution 2010 and therein exists nothing like the "National Security Advisory Commitee". ukwelikitugani, rao will defy this outfit on a legal standing if he chooses to go thru. Otherwise ata kama ni tribal composition he cant dare defy.
Kabaridi, you have officially been summoned, hehe...hii kitu iko kwa katiba gani na ya nani..my copy identifies a NSC chaired by the presidency, hii ingine ya Kimemia iliundwa aje and why is it usurping powers of the presidency led by NSC.

Well,under the current Constitution the PS is the Secretary to the council. That's for sure. Though Mr Kimemia had Chaired the Council before,now i dont know if The constitution allow that.

This much i agree, secretary to the council, NSC, but he is a chairman of NSAC (not in the constitution)......
If he chaired NSC then we have a very big problem, atleast how i interpreted the constitution. The presidency only and solely can chair such a gathering. No provisions for absentism.

238. (1) National security is the protection against internal and external threats to Kenya's territorial integrity and sovereignty, itspeople, their rights, freedoms, property, peace, stability and prosperity, and other national interests.

(a)
national security is subject to the authority of this
Constitution and Parliament;

(b)
national security shall be pursued in compliance with the law
and with the utmost respect for the rule of law, democracy,
human rights and fundamental freedoms;

...Every kenyan has a right to attain elective offices and assuming we were to adopt the office of the PM into the new constitution it would have been a disaster. A desparately ailing economy that is to achieve double digits under such a government is impossible. We cannot achieve such growth because the kenyan economy is quite small to accomodate such a government. The very vocal at the PMs for instance the usual culprits john mbadi, jakoyo midiwo etc.. in addition to corruption and several conflicting decrees under the coalition governments executive and PM's office was equally burdensome and a hindrance to progress. In the future when we can boast of a double digit economy, the office of the PM will be key. We have seen people exercising their soverign power with the utmost discipline recently in ushering in a new constitution in a referundum, and a just concluded democratic poll, and what people need is a decentralized system of government though we are yet to encounter its challenges. All these noises at the national level will subside very soon to the counties and that may affect the liberties or free will of those people to choose their leaders democratically!!

meanwhile you can see under this section of the constitution that gives the kenyan people power to exercise their power and hence communal ties strenghthened....

THE CONSTITUTION OF KENYA

Otherwise you dont know how far the Intelligence and security organs are mandated. Okay look here

the communities within
Kenya; and
(d) recruitment by the national security organs shall reflect the
diversity of the Kenyan people in equitable proportions.

Kabaridi, my issue wasnt the tribal composition of that committee but all the same, the same constitution u quote urges all apointments to have the face of the nation, in the spirit of the new cinstitution i find the committee defective on a srcondary consideration.
Anyway, tribal maneno aside which aint an issue as pertained to ma query;
What constitutional clause mandates the existence of 'national security advisory committee'. Why does the commitee usurp powers of the NSC?
Be articulate and specific as much as possible.

If you ask me the very reason why there are a lot of interests as regards to NSAC confidentiality is whether it can be open to manupilative forces from the political arena. This is the sole reason why the posts are a subject of debate of who is who where. otherwise if it about power and power to the people my earlier inference is self explanatory

Nisaidie uweke hapa Provincial Commissioners ili ujue nini naongea. Zaidi, hivi unelewa Nguvu za hivyo vyombo vya usalama? they got some sort of farfetched VETO..
