This happens when you think you know while you know not....
As much as Lazaru Nyalandu talks about his desire for the doctrine of separation of powers of the three arms of government namely the judiciary, the executive and the Parliament there is nothing in the proposed "Katiba mpya" which he clamours for had made any attempt to safeguard those pillars of democracy. His biggest problem is to assume the proposed "katiba mpya" had resolved the weakened provisions of the doctrine of separation of powers. The gospel truth is the proposed "katiba mpya" has worsened the existing provisions of the doctrine of separation of powers.
Apart from positions of Chief Justice and chief secretary the rest of presidential appointments will not be subjected to the checks of Parliament.
Moreover, neither member of the bench nor of Parliament will be restrained from holding executive positions.
The appointment committee of the NEC will be headed by chief justice, Speakers of both Houses and their deputies, AGs from both sides of the union among others who are direct presidential appointees in one way or the other and are sponsored by the ruling party in our present circumstances is CCM.
If this is not bad enough the Chief Justice will head a bench which will be a final arbiter of presidential disputes which may include disputes questioning the integrity of the decisions of the NEC appointments Committee which he heads generating a hydra of conflicts of interest.
So clearly, Lazaru Nyalandu either has not read the proposed "Katiba mpya" or if he has he did not learn much of substance...
