When it comes to political meddling of the DPP powers we see our sister not guiltless as she appointed Kighoma Malima junior to be a Tanga Region RC at a time he was facing criminal prosecution for assaulting a police officer and obstruction of justice.

So as far as she was concerned, Malima deeds were not felonies. So her presidential appointment was prejudicial and quite unfortunate because she will find her moral integrity questioned here and there particularly of biasedness and disrespect of the law. An impartial appointer would have restrained herself from judicial interference, but she did not!

The message she is sending across her political allies are above the law

1. Nchi zote Malawi na Zambia zilipata uhuru mwaka 1964 na zote hutumia pesa aina ya Kwacha. Marais wake wote, Dk. Kamuzu Banda (Malawi) na Dk. Kenneth Kaunda (Zambia) walizitumikia nchi zao katika nafasi za urais kwa muda mrefu na asili zao zinatatanisha, hawaeleweki kama ni Wamalawi na Zambia. Wote Muluzi na Chiluba waliwataliki wake zao kwa sababu ya kukosekana uaminifu kwenye ndoa.
3. Wote, Muluzi na Chiluba waliwapeleka watangulizi wao mahakamani (Dk. Banda na Dk. Kaunda).
4. Bakili Muluzi alimpendekeza Bingu wa Mutharika kuchukua nafasi yake, wakati Frederick Chiluba alimpendekeza Levy Mwanawasa kuchukua nafasi yake na wote waliwafanyia kampeni wakati wa uchaguzi.
5. Wote Mutharika na Mwanawasa walishinda uchaguzi na kuwa marais wa tatu katika nchi zao.
6. Muda mfupi baada ya kuchaguliwa kuwa marais, wote Mutharika na Mwanawasa walishindwa kuwabeba (kuwavumilia) watangulizi wao Muluzi na Chiluba. Wote wawili, Mutharika na Mwanawasa waliwapeleka watangulizi wao (Muluzi na Chiluba) mahakamani kwa makosa ya kujihusisha na rushwa. Sasa inavutia zaidi; Muluzi alishtakiwa na utawala wa Mutharika. Chiluba alishtakiwa na utawala wa Mwanawasa.
7. Bingu wa Mutharika alishinda kipindi cha pili cha uongozi, Mwanawasa alishinda kipindi cha pili cha uongozi. Mutharika alimchagua Joyce Banda kama Makamu wake wa Rais. Mwanawasa alimchagua Rupiah Banda kama Makamu wake wa Rais.
8. Mutharika alifariki akiwa madarakani katika kipindi chake cha pili kwa matatizo ya moyo (Cardiac Arrest). Mwanawasa pia alifariki akiwa madarakani katika kipindi chake cha pili kwa matatizo ya moyo (Cardiac Arrest).
9. Joyce Banda alichukua madaraka kutoka kwa Bingu wa Mutharika kutokana na kifo hicho. Rupiah Banda alichukua madaraka kutoka kwa Levy Mwanawasa kutokana na kifo hicho. Marais wote hawa waliochukua madaraka kutoka kwa marehemu waliitwa “Banda”!
10. Baada ya miaka 3, Rais Banda wa Zambia alishindwa kwenye uchaguzi na mpinzani wake Michael Sata. Banda wa Malawi naye ameshindwa kutetea kiti chake na mpinzani wake Peter Mutharika

As much as we are glad of the finding of the High Court but we hotly dispute its remedies.

We say the violations of the principles of natural justice as established by the High Court that the plaintiff was "condemned unheard of" therefore the only lawful remedy is to revoke the decision of the TLS disciplinary committee and permanently reinstate her advocacy rights of practice promptly while barring the respondents from ever resuscitating the incurably vitiated proceedings.

We say so because the breaches of the principles of natural justice are not merely voidable but are void, abinitio.

This follows the principle of law which was set by SPACKMAN that states as follows:-

"Where the principles of natural justice are violated in respect of any decision it is immaterial whether the same decision would have been arrived at departures of the essence of justice, that decision must be declared a no decision."

As we have abundantly declared earlier we are in all four corners of the finding of the High Court but we are in vehement disagreement with her remedies which are contrary to clear provisions of the stated principles of law.

Once the remedies are to take a second bite of a flawed proceedings the Court is opening doors for prejudice which may lead to "double jeopardy" which is contrary to all known principles of justice.

Our legal advice:-

This decision ought to be appealed at the Court of Appeal and the respondents be ordered to reinstate the appellant rights as a registered attorney and the respondents should permanently be banned from resurrecting the same subject matter ever again to spare the plaintiff from future abuses of disciplinary procedure such as prejudice and "double jeopardy".. otherwise the High Court will be condoning the plaintiff to be punished twice which is prejudicial to all known principles of fairness in dispensation of justice.

He miscalculated his ploy just like this fool only to ask for court orders to exhume the deceased body to prove his case that Kolimba was murdered and once his plea of innocence were dismissed there was only one way the verdict will go: one year jail sentence...he obediently served his one year term deluding himself once out he will attain the Mandela Saint like stature but on day of his release he was disappointed to see nobody turned up to grace his release with a Presidential red carpet treatment. The similarities with this matter are just too striking similar to a fault...

We project this fool who believes losers in YouTube will soon find himself arraigned in a court of law and just like his fellow rumourmonger Rev. Mtikila he will fail to prove his wild wild west allegations and he will be convicted for incitement, misleading the general public and character assassination, and for his mischief he will serve one year....his death wishes will come to a cropper...nobody wants him dead but most of us wants him behind bars...for not more than a year because we are merciful people. We know he too is a victim of a sensational YouTube libellous campaign to incite, mislead and deny the real causes of death of Shujaa wa Chato.
