THIRD SUNDAY OF EASTER YEAR A

FIRST READING
“It was not possible for him to be held by death.”
ACTS 2: 14, 22 - 33

[On the day of Pentecost,] Peter, standing with the Eleven, lifted up his voice and said, “Men of Judea and all who dwell in Jerusalem, let this be known to you and give ear to my words. “Jesus of Nazareth, a man attested to you by God with mighty works and wonders and signs which God did through him in your midst, as you yourselves know — this Jesus, delivered up according to the definite plan and foreknowledge of God, you crucified and killed by the hands of lawless men. But God raised him up, having loosed the pangs of death, because it was not possible for him to be held by it. For David says concerning him, ‘I saw the Lord always before me, for he is at my right hand that I may not be shaken; therefore my heart was glad, and my tongue rejoiced; moreover my flesh will dwell in hope. For you will not abandon my soul to Hades, nor let your Holy One see corruption. You have made known to me the ways of life; you will make me full of gladness with your presence.”’ “Brethren, I may say to you confidently of the patriarch David that he both died and was buried, and his tomb is with us to this day. Being therefore a prophet, and knowing that God had sworn with an oath to him that he would set one of his descendants upon his throne, he foresaw and spoke of the resurrection of the Christ, that he was not abandoned to Hades, nor did his flesh see corruption. This Jesus God raised up, and of that we are all witnesses. Being therefore exalted at the right hand of God, and having received from the Father the promise of the Holy Spirit, he has poured out this which you see and hear.”

The Word of the Lord.

RESPONSORIAL PSALM
Psalm 16: 1 - 2a and 5, 7 - 8, 9 - 10, 11 (R.) 11a.

R/. Lord, you will show me the path of life.
Or:
Alleluia.

Preserve me, O God, for in you I take refuge.
I say to the Lord, “You are my Lord.”
O Lord, it is you who are my portion and cup;
you yourself who secure my lot. R/.

I will bless the Lord who gives me counsel,
who even at night directs my heart.
I keep the Lord before me always;
with him at my right hand, I shall not be moved. R/.

And so, my heart rejoices, my soul is glad;
even my flesh shall rest in hope.
For you will not abandon my soul to hell,
nor let your holy one see corruption. R/.

You will show me the path of life,
the fullness of joy in your presence,
at your right hand, bliss forever. R/.

SECOND READING
“You were ransomed with the precious blood of Christ, like that of a Lamb without blemish.”
1ST PETER 1: 17 - 21

Beloved: If you invoke as Father him who judges each one impartially according to his deeds, conduct yourselves with fear throughout the time of your exile. You know that you were ransomed from the futile ways inherited from your fathers, not with perishable things such as silver or gold, but with the precious blood of Christ, like that of a lamb without blemish or spot. He was destined before the foundation of the world but was made manifest at the end of the times for your sake. Through him you have confidence in God, who raised him from the dead and gave him glory, so that your faith and hope are in God.

The Word of the Lord.

ALLELUIA
Luke 24: 32.

Alleluia.
Lord Jesus, open the Scriptures to us; make our hearts burn with love when you speak to us.
Alleluia.

GOSPEL
“They recognised him in the breaking of the bread.”
LUKE 24: 13 - 35

That very day [the first day of the week], two of the disciples of Jesus were going to a village named Emmaus, about seven miles from Jerusalem, and talking with each other about all these things that had happened. While they were talking and discussing together, Jesus himself drew near and went with them. But their eyes were kept from recognising him. And he said to them, “What is this conversation which you are holding with each other as you walk?” And they stood still, looking sad. Then one of them, named Cleopas, answered him, “Are you the only visitor to Jerusalem who does not know the things that have happened there in these days?” And he said to them, “What things?” And they said to him, “Concerning Jesus of Nazareth, who was a prophet mighty in deed and word before God and all the people, and how our chief priests and rulers delivered him up to be condemned to death, and crucified him. But we had hoped that he was the one to redeem Israel. Yes, and besides all this, it is now the third day since this happened. Moreover, some women of our company amazed us. They were at the tomb early in the morning and did not find his body; and they came back saying that they had even seen a vision of angels, who said that he was alive. Some of those who were with us went to the tomb, and found it just as the women had said; but him they did not see.” And he said to them, “O foolish men, and slow of heart to believe all that the prophets have spoken! Was it not necessary that the Christ should suffer these things and enter into his glory?” And beginning with Moses and all the prophets, he interpreted to them in all the Scriptures the things concerning himself. So they drew near to the village to which they were going. He appeared to be going further, but they constrained him, saying, “Stay with us, for it is towards evening and the day is now far spent.” So he went in to stay with them. When he was at table with them, he took the bread and blessed and broke it, and gave it to them. And their eyes were opened and they recognised him; and he vanished out of their sight. They said to each, other, “Did not our hearts burn within us while he talked to us on the road, while he opened to us the Scriptures?” And they rose that same hour and returned to Jerusalem; and they found the Eleven gathered together and those who were with them, who said, “The Lord has risen indeed, and has appeared to Simon!” Then they told what had happened on the road, and how he was known to them in the breaking of the bread.

DNA REQUIREMENT IN SEXUAL OFFENCES CRUCIAL IN THE ADMINISTRATION OF CRIMINAL JUSTICE.

It has come to our attention that the defence of lack of DNA in the sexual offences is not considered as a point of law while it is.

Court of Appeal decisions on the same have waved away this defence when it was not raised during the trial, while the same Court has regularly ruled point of law can be raised at any time.

So, disregarding DNA defence during an appeal implies the Court does not deem DNA as a point of law that can be raised at any time during proceedings!

OUR TAKE.

There is a need to enact an amendment on sexual offences Act to spell out DNA is a point of law.

Such an amendment will necessitate both the prosecutors and the Defendants to embroil themselves on the issue in equal footing.

We see Defendants in sexual offences being condemned to life sentences for the rest of their days without having committed the offences.

We also beam where there are wrong convictions room for review after discovery of new evidence constricted by precedents which overrule introduction of new evidence such as DNA which have the potential to exonerate a wrongly convicted person.
.

We also peek at overdependence on eye witnesses and oral evidence vulnerable to manipulation such as coaching to sway the courts one way or another.

Even in murder cases, DNA evidence is crucial in certain cases to place the murderer at the crime scene and yanking away falsely accused from the same.

The technology of DNA has made leaps and bounds, and its inclusion in our criminal justice system will improve the quality of decision making.

he attack on the victim's credibility features in ground four. The first appellate judge is faulted for sustaining conviction without assessing the victim's credibility. Having heard opposing arguments from the learned state attorney and examined the record of appeal we can't mince our words that this ground must fail for three reasons. First, it was not one of the appellant's complaints before the first appellate court neither does it involve a matter of law for which this Court would have jurisdiction mandated by section 6(7) (a) of the AJA. Secondly, credibility is not inthe domain of an appellate court but the trial court which sees witnesses12

as they testify and assess their demeanour in the witness box. See for instance: Siza Patrice v. Republic, Criminal Appeal No. 190 of 2010 (unreported), Third, consistent with our decision in Shabani Daudi v.Republic, Criminal Appeal No. 28 of 2010 (unreported), the first appellate judge evaluated PW3's evidence and was satisfied that she was unshaken as to what 'Koro' did to her on the material date and broke the news to her mother moments after her return from her errands on the basis of which, PW2 inspected her and found her pants wet with sperms. As seen earlier, what PW3 told her mother was confirmed to be true upon a medical examination by PW4 later in the day. In the final analysis, we have found no merit in this ground and dismiss it as well...

Our concern is if the victim was dripping with sperms does it not make any sense for the DPP to find out whose sperms belong through the DNA rather than the whole criminal case pinned on oral evidence which can be twisted to suit certain aspirations against the accused?

The full decision is hereby attached.

The availability of DNA results would have removed the shadow of doubt of whether the convicted was guilty or innocent.

And, lack of a law which compels the DPP office to collect the DNA evidence and store it for as long as it takes leaves a lot of doubts of whether the defence of innocence was unfairly thrown away, and the Court wrongfully convicted an innocent man.

We need DNA evidence to be incorporated in our shaky criminal justice system where, from prima facie assessment, courts may be sending to the gallows or life imprisonment innocent individuals.

Mitt Romney to run?

He may be silent, and nobody talks about his presidential ambitions for now, but the two term Governor of Massachussets and the current senator of Utah may be what the Republican party needs to win the W.H.(White House).

We say so because the US presidential race is littered with candidates who have too much garbage that they may turn off independents who tip the presidential scales one way or the other.

Both Trump and Biden are embroiled in criminal legal minefields, which are disillusioning many independent voters. Consequently, the duos' presidential stakes are in the dustbin so to shout it aloud

Our beloved Florida Governor Messr Ron DeSantis' lack of the grips in foreign policy, his flipflopping on the biggest war in Europe since the Second World War and his hostility or denial of African American history captured in a new school curriculum that he has abolished in Florida has significantly lowered his chances of leaping to the W.H. The more interviews he take the more voters will conclude he is still a project in the furnace: too weak on national security and without political ambit beyond Florida borders. In fact, he is still a greenhorn needing time to burnish his political wherewithal. However, he could be a serious pick in consideration for veepstakes regardless of whomever wins the Conservative presidential primaries. And, we are now placing him there for his own good.

Mitt Romney appeal to the independents raised the possibility that he could be the next president of the United States [emoji631].

So, accosted with second thoughts, we are now putting Senator Mitt Romney on the top of the pack as the real deal having credible chance to succeed scandal ridden Joe Biden at the Oval Office.

Joe Biden now has to look back at his shoulder because there will be a serious leadership challenge in his own political party after Robert Kennedy Jr has announced he will challenge him in the Democrats' primaries for the presidential ticket. Those two southern states have karger African American voters who should give Biden quick victories and momentum he badly need......whether that momentum will sway voters in subsequent states is unclear

Chances of Robbie unseating Biden in the primaries are remote in particular because of deliberate shifting of the Democrats' first primaries to North and South Carolina from whiter yet smaller states of Iowa and New Hampshire where Joe Biden has never won a primary despite four attempts!

We are beginning to walk with a spring in our stride knowing as legal troubles mount for both Biden and Trump, and as our friend Messr Ron DeSantis keep shooting himself on the knee, Mitt Romney presidential dreams may gain traction.

After all, he lost to Obama in 2012, and he requires no introduction. Mitt Romney looks to be heading to bigger things for reasons beyond his dints.

OUR MAJOR PROJECTION.

Mitt Romney will announce his presidential candidacy before fall ....he will be gunning the presidency through the Republican party, and if he does so and this is really a big IF, he will be unstoppable and unbwogabble........However, his Achilles heel is the MAGA (Make America Great Again) Trump supporters who have a no love lost with Romney in particular after his impeachment vote against Trump in the Senate. But, MAGA sole reason of unwavering support will be sternly tested if Trump legal problems tarnish his candidacy beyond repair.

THIRD WEEK OF EASTER YEAR A

FEAST OF SAINT MARK, EVANGELIST

FIRST READING
My son, Mark, sends you greetings.
1ST PETER 5: 5b - 14

Beloved: Clothe yourselves, all of you, with humility towards one another, for “God opposes the proud, but gives grace to the humble.” Humble yourselves therefore under the mighty hand of God, that in due time he may exalt you. Cast all your anxieties on him, for he cares about you. Be sober, be watchful. Your adversary the devil prowls around like a roaring lion, seeking some one to devour. Resist him, firm in your faith, knowing that the same experience of suffering is required of your brotherhood throughout the world. And after you have suffered a little while, the God of all grace, who has called you to his eternal glory in Christ, will himself restore, establish, and strengthen you. To him be the dominion for ever and ever. Amen. By Silvanus, a faithful brother as I regard him, I have written briefly to you, exhorting and declaring that this is the true grace of God; stand fast in it. She who is at Babylon, who is likewise chosen, sends you greetings; and so does my son Mark. Greet one another with a kiss of love. Peace to all of you that are in Christ.

The Word of the Lord.

RESPONSORIAL PSALM
Psalm 89: 2 - 3, 6 - 7, 16 - 17 (R.) 2a

R/. I will sing for ever of your mercies, O Lord.

Or:
Alleluia.

I will sing for ever of your mercies, O Lord,
through all ages my mouth will proclaim your fidelity.
I have declared your mercy is established for ever;
your fidelity stands firm as the heavens. R/.

The heavens praise your wonders, O Lord,
your fidelity in the assembly of your holy ones.
For who in the skies can compare with the Lord,
or who is like the Lord among the heavenly powers? R/.

How blessed the people who know your praise,
who walk, O Lord, in the light of your face,
who find their joy every day in your name,
who make your justice their joyful acclaim. R/.

ALLELUIA
1st Corinthians 1: 23a - 24b

Alleluia.
We preach Christ crucified; the power of God and the wisdom of God.
Alleluia.

GOSPEL
“Preach the Gospel to the whole creation.”
MARK 16:15 - 20

At that time: [Appearing to the Eleven,] Jesus said to them, “Go into all the world and preach the Gospel to the whole creation. He who believes and is baptised will be saved; but he who does not believe will be condemned. And these signs will accompany those who believe: in my name they will cast out demons; they will speak in new tongues; they will pick up serpents, and if they drink any deadly thing, it will not hurt them; they will lay their hands on the sick, and they will recover.” So then the Lord Jesus, after he had spoken to them, was taken up into heaven, and sat down at the right hand of God. And they went forth and preached everywhere, while the Lord worked with them and confirmed the message by the signs that attended it.

The Gospel of the Lord.
