Zanaki, hivi unajua kwa nini madaktari hawatakiwi kimaadili kumfanyia upasuaji ndugu wa karibu (mke, mtoto, mume, n.k)?
 
Ok, ndivyo ilivyo, sababu kubwa ni kuondoa mgongano wa maoni na mitazamo wakati wa upasuaji. Ndo maana hata daktari mtoto wake akiumwa hamtibu, anampeleka kwa daktari mwingine, na wakati mwingine hata kama awe bingwa namna gani haruhusiwi kwenye chumba cha upasuaji, atangojea nje kama wengine!! Sasa, haina maana pale inapodibi na hakuna jinsi basi asitoe huduma ya kwanza!

Hakuna anayekataa kampuni ya Dr. Mkono kushiriki katika kumtetea Dito (si wanao wanasheria wengine)? Tatizo ni Mbunge mwenyewe na kama ulivyosema mgongano uko dhahiri. Hivi leo Nimrodi akichaguliwa kuwa Waziri wa Usalama wa Raia, je aendelee kutetea kesi hii? Hakuna sheria inayomkataza!!!

(1). Hapa hatubishani isipokuwa tunajaribu kuiangalia hii unusual kesi kwa upeo tulionao, kwa kuzingatia mazingira ya kisiasa na kisheria tuliyonayo, and this is not a waste of valuable time, kama unavyoshauri mwishoni mwa maoni yako, NO!, katika majadiliano haya tunajifunza mengi sana, kwanza kuhusu kesi yenyewe na wanaoishiriki,

(2). Mbunge Mkono hajawahi kujihusisha na kesi yoyote ambayo ni High profile, kwa mfano kesi za wahaini, au wahujumu uchumi, ambazo so far katika historia ya nchi yetu ndio zilizokuwahi kuwa kesi kubwa, the matter of fact hii ni kwa mara ya kwanza wanachi wengi hata wanamsikia kuwa ni mbunge, au yupo anyway! Kwa hiyo kusema eti ni mwanasheria ndio maana ameamua kujiingiza katika hii kesi, sina uhakika na hiyo point maana tungeshamsikia huko nyuma, tena hasa Mwalimu alipokuwa hai, Mbunge au wakili Mkono alikuwa wapi?

(3). Mkono hajawahi kuutaka uwaziri, angeutaka angeshaupata, maana huyu mzee ndiye aliyempa JM ndege yake kwa ajili ya kuzunguka bongo nzima ktafuta zile signature za CCM, za urais, na JK alipomuambia JM ampatie majina ya anaowataka kuwemo kwenye cabinet, kati ya majina aliyoyatoa la Mkono halikuwemo, na ni kwa sababu Mkono mwenyewe hajaamua ila siku atakapoamua kuwa waziri atakuwa, kwa hiyo na hili nalo nina wasi wasi nalo kuwa Mkono amejiingiza kwenye hii kesi kwa sababu ya ki-spoon na JK, hapana!

(4). Kumtetea Blaz Dito ni haki ya Dito na Mkono pia, lakini Mzee Zanaki hebu niambie leo anaonekanaje mbele ya taifa, yaani Mbunge Mkono, juzi tu alikuwa anapiga kelele kwa viongozi wa Wilaya moja huko Musoma kuhusu kodi ya madini, kuwa ni ndogo sana na wanaiumiza serikali, leo tena anamtetea mhalifu anayeshitakiwa na serikali ile ile aliyokuwa akiitetea against viongozi wa wilaya, does it make a sense kwako?

(5). JK hamuhitaji Mkono kule Musoma, mana ana watu wake tayari kina Wassira, mwenyekiti wa CC mkoa, kina Mahanga hahitaji wapambe tena huko, na hata akihitawahitaji Mkono atakuwa ni mtu wa mwisho duniani kuurukia huo upambe na JK, maana Mkono sio Mr. Yes hata siku moja ndio mana kujiingiza kwake kwenye hii kesi bado kwangu kinaendelkea kuwa kitenda wili kigumu, lakini nitalala macho mpaka nizipate!

Now back to the case, hivi kweli bondia Matumla wa bongo anaweza kupambana na Tyson wa US? I mean what is there kwa Mkono kuingia kwenye hii kesi? What?
 
Nashukuru kwa mchango wako mzee,lakini naomba nieleweke hivi,haya mimi ni maoni yangu binafsi,na kama unavyosema hapa tunajifunza kama Mwanakijiji alivyonipa somo la wapasuaji.

Nafikiri ndio uzuri wa forum kama hizi kuwa kila mtu ataweka mtazamo wake kwa kitu fulani kwa jinsi anavyoelewa yeye.Mimi mtazamo wangu ni huo niliousema,na kweli kabisa sioni sababu nyingine yeyote ambayo inaweza kumfanya Mkono kuingia kwenye hii kesi.Kwanza mimi naamini kabisa labda naye alikuwa anacheki kwanza nani ataingia kabla ya yeye kuivaa,maana alijiingiza baadae kidogo.

Labda angeingia advocate ambaye hana jina kubwa na yeye asingekuwa na interest,labda kaona kuwa Tenga atapata umaarufu sana na yeye hawezi kupitwa,we are all speculating here.

Mzee Es,ninakuhakikishia kuwa Mkono alianza kuutaka uwaziri toka enzi za BM. Na yeye hesabu zake wakati ule zilikuwa ni uwaziri wa fedha.

Alivyoondolewa Mbilinyi yeye alijua angeupata. Unfortunately he wasnt very popular with that Prez.I'm sure leo hii kama Salim angekuwa rais, Mkono angekuwa waziri. Hakuna mtu ambaye hataki uwaziri.

Unajua Mkono kuwa trustee wa Mwalimu Nyerere Foundation ilikuwa ni kazi ya Butiku, Mwalimu mwenyewe alikuwa hataki, lakini kwa sababu Mwalimu alikuwa anamsikiliza sana Butiku akaliachia,yote hio ni kwa sababu Mkono alitaka kuwa karibu na Mwalimu.

Butiku ilibidi afanye hivo maana Mkono alishamsaidia sana huko nyuma toka akiwa mkuu wa mkoa Mara,na hata ile nyumba anayokaa pale Oysterbay ya NHC,iko kwenye jina la Mkono.Kwenye uwaziri sio siri anautaka sana,sema Mkono ni jeuri,he wont kiss ass to get what he wants.

Kinachuuma sisi hapa ni kuwa hii ni kesi ya mwenyekheri kamuua mlalahoi,na wenyekheri wengine wanajitokeza kumtetea mwenzao.Mimi binafsi kitendo kile kimeniuma kama yule Mbonde ni ndugu yangu,hilo halina mjadala.

Lakini pia ninajaribu kuliangalia hili kwa mapana zaidi. Mfano tukichukulia matatizo ya umeme,si watu wakaona ni deal wakaleta Richmond ambayo kuna fununu kuwa kuna mtoto wa kiongozi wa juu serikalini yuko kwenye hio deal,huyo kajitengenezea pesa kutokana na matatizo ya umeme.

Tukija hili,Mkono nae kaona dili ya kujitengenezea umaarufu kwenye matatizo pia!

Ndio kama nilivyosema kabla zote hizi ni personal interests tu,kama kilivyo kila kitu katika hii nchi.
 
Hivi, kama Hassan ndiyo angemlimpua Ditopile, hivi mnafikiri Nimrodi Mkono angejitolewa kumtetea bwana Hassan... I doubt it!
 
Nimekuwa nafuatilia mawazo ya wenzangu tofauti ktk issue hii,lakini bado nashindwa kuelewa kwa dhati kwamba tunapingana kwenye nini?Naomba ikumbukwe kuwa "Bro Dito anashtakiwa na Jamhuri ya Muungano wa Tanzania kwa KUUA"Sasa iweje leo kiongozi mwenzie wa Bunge la Jamhuri anasimama against Jamhuri hiyo kumtetea muuaji?

Mimi sina tatizo lolote na huyo Bwana Mkono kwa sababu najua kuwa ni wakili,kinachogomba hapa yeye ni Mbunge!Kama kweli anataka kufanya kazi yake ya uwakili ajivue Ubunge wake!

Hawa watu tunawaangalia kwa macho madogo ni wasomi,wajanja na wana akili ya kututeka na kutuburuza.Kwa mtindo wowote kuwepo kwa Mkono kwenye kesi ya Dito ni kupindwa taratibu za Uendeshaji Mahakama huru.

Nashangaa sana kwa nini wasomi wetu hawalioni hili!

Ditopile lawyers protest delays

THE defence in the murder case against former Tabora Regional Commissioner Ukiwaona Ditopile Mzuzuri (58) has given the state two weeks to complete investigations, failure of which they will take the matter to the High Court.

Dr Ringo Tenga, lead counsel in the defence team, protested that the state was infringing on the rights of the accused by unnecessarily delaying the investigations.

"We want the investigations to be completed so that we can apply bail. We will move the court to refer the case to the High Court if by next mention on January 15, the investigations will not be completed," he submitted.

However, the law does not allow people accused of murder to be released on bail. But Dr Tenga responded that it was up to the High Court to rule on the matter.

Dr Tenga said the accused was arrested over two months ago in connection with the alleged murder of a driver of a commuter bus, Hassan Mbonde (33), but no progress has so far been recorded in regard to investigation.

"What the prosecution is telling us here is pure administrative matters. In actual sense, there is no any progress. For that matter, our client will continue to languish in remand custody. We expected the file should have been taken to the DPP Director of Public Prosecution)," he said.

Dr Tenga was reacting to a submission by Assistant Commissioner of Police (ACP) Charles Kenyella, who had told the court that the file was with the Zonal Crime Officer (ZCO).

ACP Kenyella said the file would later be taken to the Director of Criminal Investigations (DCI) for further action. "If the DCI would be satisfied by the evidence he would refer the case file to the DPP for decision or opinion," he told the court.

ACP Kenyella submitted that it was too early for the defence to accuse the prosecution of infringement on the rights of the former RC. He said taking into account the nature of the charges, investigations could take up to six months.

The magistrate, however, said he was not impressed by the submission by the prosecution, saying investigation of a case should be conducted on its own merit instead of blanket generalisation that murder cases took long to be disposed of.

"You are required to speed up the investigations. By next mention you should come here with proper explanation on the progress of the case," the magistrate said and adjourned the case for another mention on January 15.

In the case, the prosecution claims that Ditopile killed the driver of a commuter bus on November 4, at the junction of New and Old Bagamoyo roads in Kinondoni District by shooting him with a pistol.

That is the part that interests me... is there any lawyer here? is this the standard operating procedure of any murder case in Tanzania? I mean:

a. Take the file to the ZCO
b. Take the file to the DCI
c. Take the file to the DPP
d. Take the file back to the lower court
e. Take the case to the High Court for hearing!

Or are we expecting the grand illusion.. something like.. the DPP has issued a nul prosequi and case is the dropped.. why "the family is not interested in pressing for the prosecution o Mr. Mzuzuri"

Anyway, where was our famous Dr. Nimrod Mkono?.....
 
Mkono is hospitalised in India,alifanyiwa operation mid december.
 
Some mind-boggling questions:
How long is the prosecution team required to complete the investigation? How long can a person remain in custody before his or her case is heard in the appropriate court of justice?

Any explanation from a learned brother or lady please?

Utaratibu kwa kesi za mauaji ni kweli ndio huo uliotolewa hapo juu. Tofauti na kesi zingine zinavyoendeshwa na waendesha mashtaka ambao ni polisi, kwenye mauaji wanasheria wa serikali ndio huo prosecutors. Ndiyo maana inabidi faili lipitie kote huko ili waweze kujipanga. Kama ni mzuri au ni mbaya hiyo ni habari nyingine.

Mwanasiasa,
Sheria inataka ndani ya siku sitini upelelezi uwe umeshakamilika na kama bado mwendesha mashtaka anaweza kuomba kuongezewa muda ili kukamilisha upelelezi kutegemea na sababu anazotoa. Wanahaki ya kumtetea mteja wao lakini mpaka hapo hakuna kilichokiukwa.

Sababu wanayotoa eti wanataka kwenda kuomba dhamana mahakama kuu, wakati sheria iko wazi kosa la mauuaji halidhaminiki. Huu ni ujanja tu ili kesi isikilizwe mapema kifanyike cha kufanyika. Ni watu wangapi wana kesi za mauaji na wamekaa mahabusu wengine zaidi ya miaka mitano na hatusikia hawa mawakili ambao ni court officials wakisemea ucheleweshaji wa upelelezi?

Ditopile inquiry ready for hearing

THE investigations into a murder case against former Tabora Regional Commissioner (RC) Ukiwaona Ditopile Mzuzuri (58) have reached a final stage, the prosecution told the Kisutu Resident Magistrate's Court in Dar es Salaam yesterday.

Assistant Commissioner of Police (ACP) Charles Kenyella told Senior Resident Magistrate Sivangilwa Mwangesi that the police case file has been referred to the Director of Criminal Investigations (DCI) for final perusal.

"The file will be sent to the Director of Public Prosecutions (DPP) for other legal opinions or directions. We, therefore, pray for another mention date," Mr Kenyella further informed the court.

However, Prof. Jwani Mwaikusa, who is defending Ditopile together with advocate Cuthbert Tenga, expressed their disappointments on the prosecutions' submissions.

"What the prosecutions have told us here reflect no any new development as the file is still in police hands. We expected to be told that the file has been moved to the DPP," he said.

Prof. Mwaikusa, insisted their earlier request that the prosecution should expedite their investigations and ensure that the file reaches the DPP the soonest possible.

ACP Kenyella, however, informed the court that they were handling the case professionally and they could in no way jump to send the file to the DPP before being scrutinized first by the DCI.

The magistrate adjourned the case for another mention on January 29. In the last court session, the defence counsel gave the prosecution two weeks to complete the investigations, failure of which they would take the case into the High Court.

They protested that the state was infringing on their client's constitutional rights by unnecessarily delaying the investigations into the case despite of being held in connection with the murder since November last year.

In the case, the prosecution claims that Ditopile killed a driver of a commuter bus, Hassan Mbonde (33), on November 4, last year, at the junction of New and Old Bagamoyo Roads in Kinondoni District by shooting him with a pistol.
