Suala hapa ni nani mwenye mamlaka ya kutoa mamlaka ya maandamano ya kisheria?huwezi kutegemea serikali inayolalamikiwa na maandamano hayo ikubali kuyabariki kufanyika..je ikiwa serikali imepiga marufuku, basi kuandamana kutakuwa kosa?..ikiwa serikali haina uwezo wa kuthibitisha hatari itokanayo na kufanyika kwa maandamano, basi ni dhahiri kuwa inakiuka haki ya watu kuelezea malalamiko yao kwa njia ya maandamano..

NAIROBI, KENYA - Former UN Secretary-General Kofi Annan agreed Thursday to take over talks to end the deadly turmoil linked to Kenya's presidential election, after days of international pressure resulted in nothing more than a fresh round of accusations from both sides.


The Dec. 27 election returned President Mwai Kibaki to power for another five-year term, with his opponent, Raila Odinga, coming in a close second after a vote tally that foreign observers say was rigged. More than 500 people have been killed in the ensuing violence.

Kenya's rival sides said Friday they had agreed to take action to end monthlong violence from a disputed presidential election. Kofi Annan, the former UN secretary general who is mediating, said the sides had agreed to tackle within a week the most pressing issues. Both sides called for illegal militias to be disbanded and for the investigation of all crimes connected to the violence. A document signed by both sides said an agreement might require "adjustments" to the constitution -- suggesting a power-sharing deal that would give Raila Odinga a new position of prime minister, while Mwai Kibaki remains as president.

The top U.S. envoy to Africa called the month of post-election violence in Kenya "ethnic cleansing" and said Wednesday that Washington was reconsidering hundreds of millions of dollars in aid to the country. Jendayi Frazer said neither President Mwai Kibaki nor his chief rival, opposition leader Raila Odinga, is doing enough to stop the bloodshed that has claimed more than 800 lives since the disputed Dec. 27 presidential vote. Much of the violence has pitted other tribes, including Odinga's Luo, against Kibaki's Kikuyu who are the largest ethnic group.
