Njonjo Mue: Curtain Comes Down at The Hague

Today is the closing day of the ICC Assembly of State Parties meeting here in The Hague. It has been a long and gruelling two weeks. The Kenya government brought out a huge delegation led by Amb. Amina Mohammed and AG Githu Muigai and including the DPP, the Deputy Solicitor General, Kenya's Ambassador to the Netherlands and myriad officials from Nairobi, The Hague, Brussels and other missions nearby. They were variously joined by MPs and supporters like David Matsanga and Moses Kuria and Spokesman in the Presidency Manoah Esipisu.

Their brief was simple, get as many concessions from the ICC for Kenyatta and Ruto as they could. Their strategy was straight forward: Aim for the sun and hope to reach the moon - demand the ridiculous and hope to get the unreasonable.

And so it began on the opening day with angry speeches made from the floor of the plenary. Then the debate on head of state immunity on Day 2 that went late into the night where Prof. Githu Muigai seemed to lose touch with reality claiming that Kenya was responsible for the security of 250 million Africans from Djibouti to DRC.

There were various side events they attended and spoke angrily, attacking the messenger because they no longer had a monopoly over the message: Who does civil society speak for? Who paid for you to be here? Why are civil society allowed to address the ASP? At one point, during a debate on prosecuting heads of state on which I was a panellist, second tier government officials choreographed a bear knuckle frontal attack on me and when I responded to their allegations and accusations, they dramatically stormed out of the meeting leaving the international audience rather bemused.

All the while there was serious ongoing lobbying on the language of the amendments Kenya was pushing through to ensure that Uhuru Kenyatta does not appear for trial, and we pushed back as best we could speaking to state parties and pointing out the fact that Kenya was trying to amend the Rome Statute by the back door.

We have been called names on social media and fellow countrymen and women here have accused us of unpatriotic behaviour claiming we 'want our President to be jailed.' But we have been too busy defending the rule of law to respond to these attacks. We will leave history to be the judge.

And so as the curtain comes down on the ASP, we return home with a sense of satisfaction in the knowledge that since the government of Kenya has been privatized and deployed to speak for just two people, these last two weeks, we have done our best to be the voice of those who are not able to speak for themselves.

The usually witty and evasive Attorney General Githu Muigai met his match at The Hague last weekend. On the sidelines of the ongoing ASP meeting, the AG came face to face with what his Jubilee friends call the "evil civil society" and challenged them to disclose their interest in the ICC cases and who they speak for. And so as the curtain comes down on the ASP, we return home with a sense of satisfaction in the knowledge that since the government of Kenya has been privatized and deployed to speak for just two people, these last two weeks, we have done our best to be the voice of those who are not able to speak for themselves.

These two people,,,, are the president and deputy president of the,,,,Republic of
Kenya.


If you don't know this,,,,,you better,,now,,and very fast.

Why,,,,simply because,,,,everybody,,in this worlds,,knows it.

So,,for somebody to say,,that the government has been,,privatized,,
to,,eti work for two people,,,,is trying it make it look as if,,,Uhuru Kenyatta
and William Ruto,,just came from,,,unknown places,,probably from some
bush,,,and now are using the government,,to work for them.

UhuRuto are,,themselves,,the government,,,Serikali ya Kenya,,
the most top,,CEO's of this country,,,,,,,brothers and sisters,,
wake up and see well,,,,you can even wear glasses if
you have any trouble,,,,that,,,,


UhuRuto got elected the president of the republic of Kenya
with some 6,000,000 Kenyans giving them,,, a nod.

As i say many times,,,,that i voted for Uhuru Kenyatta,,,with other
Kenyans,,,if you did not,,,that is not anyone's problem,,,but what
happens is that,,the constitution of Kenya was followed to make
it possible for UhuRuto to become,,what they are.

these last two weeks, we have done our best to be the voice of those who are not able to speak for themselves.

Who are you?????Where did you come from??? How do you look????

We do not know you,,,the way UhuRuto are known,,,,,,,, in Kenya.

At least,,,even those who never voted for them,,,UhuRuto,,,,at least,,
they saw their posters,,during elections,,,,,,they are,,known,,,,but you,,,
who elected or appointed to the rolls you play now?????

Nobody can tell,,,only yourselves,,,you the,,unknowns,,,for that is
what you are.

Uhuru and Ruto,,,are not what you knew them,,sometime ago,,as private
people,,,,welcome to 2013,,that from April,,,,,,they are the president and
DP of republic of Kenya,,,every second,,hour day,,month and year til the
end of their,,terms,,and until then,,,you cannot talk,,ha ha aha,,,anything
about private,,,,,unless,,,you are asleep and you need,,some waking up,,,by
any good Samaritan.

How can 'you',,,,now claim to work for people,,,,,,when the people you work for
do not,,,,,even know you??????? You must be,,,not real,,,and so,,
a big fake.

Now,,after all,,,,the president of Kenya and his deputy,,,will no longer
be required to attend those damning trials at Hague,,in person,,it
will be done,,through a Video link or through their lawyers.

This is a victory,,,,for Amina Mohamed and Githu Muigai,,,the secretary,,
foreign Affairs,,and the Kenyan attorney general,,,a victory for the,,
African Union,,,for without AU,,,,things would have been,,difficult.

The AU and Kenya,, were bargaining for more,,,but this one,,is not
bad,,,,now,,that Besouda or bintsodas or both,,,, knows who
is the boss.

Her big 'headnessness' na kukosa adabu,,,, has been put it's own place,,,
she knows now that Uhuru Kentatta is not her in her level and that,,she is
very junior to Uhuru Kenyatta,,,,,in this,,universe.

To those who swore that,,Uhuru Kenyatta must appear before
those courts,,or face,,,eti arrest or sanctions,,,,,,,

The US has welcomed a decision by ICC member states allowing Kenya’s leaders to skip part of their trial
at The Hague.The US ambassador to the United Nations, Ms Samantha Power, said “the remarkable efforts
of the Assembly of State Parties members, including the Kenyan delegation”, had produced an outcome that
“protects the rights and interests of both victims and defendants while allowing the judicial process to proceed
without delay.”

Human Rights Watch and Amnesty International criticised the consensus decisions reached by the Assembly of
State Parties, saying, they entrenched inequality.


Amnesty International said this was “the first time a distinction for persons with official capacity has been recognized
in international trials for crimes under international law”.


Human Rights Watch said Mr Kenyatta and Mr Ruto might still be required to attend their trial sessions.

See the intetion of these people,,,their's is not to look for justice for anybody,,,their
main aim was to see Uhuru Kenyatta,,in a court room,,,,humiliated and them
clapping their foolish hands in joy.

It will never happen,,,they think that things will change and their dreams comes true
and see Uhuru in that damning court.
