THE judges yesterday admitted the Waki Report as evidence against Deputy President William Ruto and journalist Joshua Sang in their trial at the ICC.
Trial Chamber V(a) ruled that the report was relevant to the background of the case facing Ruto and Sang at The Hague-based court.

In their ruling however, they rejected seven transcripts sourced from the Waki Commission, saying that they were of a testimonial nature and not admissible at the ICC. The Waki Commission's official name is the Commission of Inquiry on Post Election Violence (CIPEV). It was the international commission of inquiry established by the Mwai Kibaki administration in 2008 to investigate the violence in Kenya following the 2007 presidential poll.

The judges also rejected admission into evidence of the Kenya National Commission on Human rights (KNCHR) Report on the post-election violence, a gender-based violence report from the Waki Commission and a status report on IDPs. They also rejected an internal memorandum from the Department of Information related to the KASS FM programme 'Lee Nee Emet'.

They added that the document has been supported by the testimony of Witness 13, who referred to the methodology of the CIPEV in the elaboration of the report.
Ruto and Sang had objected to the admission of the report, arguing that it could "usurp the Chamber's truth and fact-finding function."

On the memo on Kass FM, the judges said that the testimony of Witness 13 did not enhance the document's reliability.

The judges said that they had already ruled the KNCHR report, the gender violence report by the Waki team and the IDP report as inadmissible.

A former Waki Commissioner, Gavin McFadyen, testified for the Prosecution in public at the ICC on July 10 and 11, 2014. His testimony focused on the Waki Commission and its work.

The Prosecution sought to introduce selected portions of the Waki Commission report and several transcripts in connection with his testimony.

The judges have now admitted into evidence (as an exhibit) portions of the Waki Report which do not go to the acts and conduct of the accused.It is primarily background information regarding the Commission's mandate and its methodology, the historical context of the PEV, IDPs and deaths/destruction, the Rift Valley and the Media.

The fact that the Chamber has admitted an exhibit does not mean that it will necessarily be relied upon or given much weight in the final analysis. The Chamber rejected the admission of the other 11 documents, including the testimony of people who appeared before Waki. They said that if they were to accept them, this would have violated the accused's right to cross-examine witnesses.

Meanwhile, confusion surrounds the last witness against Ruto and Sang, with reports that the prosecution is considering dropping him. The witness, currently housed in a European country, is reported to have refused to testify and made fresh demands.

The witness was to take the stand on February 23, when the trial against Ruto and Sang resumes, but it is no longer clear whether this will happen. The witness, whose statement was among those used to confirm the case, has demanded that his entire family be moved to Europe before he testifies.

According to sources familiar with the case, the ICC had asked the government of the country he is now based in to help get him to The Hague.

However, the government is said to have written back to the court, saying that it had no law that can be used to force the witness.

The government also failed to send a representative to a status conference held last week to discuss the issues surrounding the witness.
