Deputy President William Ruto Wednesday admitted that President Uhuru Kenyatta was misadvised in making some appointments that contravened the law.

DEPUTY president William Ruto has publicly admitted that President Uhuru Kenyatta has been misled by his advisors into making several illegal public appointments.

At the same time, it has emerged that unsuccessful presidential candidate Abduba Dida was appointed twice as chairman of Constituency Development Fund Board. One appointment has since been revoked.

Ruto told the Cheche breakfast show on Citizen TV that the advice given to Uhuru before appointing former Naivasha MP John Mututho as chair of Nacada "was not good."

He said "the same problem applies" in Dida's case and agreed with those MPs who said that Dida's appointment requires the input of Parliament.

"Those who made him sign those gazette notices will have to answer for them. We will be asking them tough questions," he told Citizen TV's Cheche breakfast show.

Mututho's appointment in November had to be revoked and taken back through the National Assembly before he was re-appointed by the President.

Ruto nevertheless defended Uhuru saying that he got it right in most of the appointments. At the end of December the President made 36 appointments to various state bodies and parastatals.

Both Jubilee and opposition MPs have criticized the President for appointing retired civil servants and failed politicians, rather than selecting technocrats through an i9ndependent selection process.

The appointment of former Public Service chief Francis Muthaura as chairman of LAPPSET has drawn particular criticism.

Yesterday, it emerged that the confusion over the appointment of Dida to the CDF chairmanship was caused by his double appointment.

Waiguru, the Cabinet Secretary in charge of Devolution and Planning initially appointed Dida on December 24. The gazette notice 15728 was dated December 27.
Then on December 31, Uhuru appointed Dida to the same position through gazette notice 15759. Both notices also revoked the appointment of Jeniffer Barasa, the current chair of the CDF board.

The two gazette notices appointing Dida for a eight months are identical but quote different laws to justify the appointment. Uhuru's notice cites the State Corporations Act and CDF Act while Waiguru only cited the latter.

Following Uhuru's second appointment of Dida, Waiguru revoked her appointment through notice 112 dated January 3, 2014.

"It is notified for the information of the general public that Gazette Notice No. 15728 of 2013, issued under section 5 (4) of the Constituencies Development Fund Act stands revoked," Waiguru's notice stated.

However the CDF Act says the Cabinet secretary shall appoint the Chairperson of the Board from a set of four board members.

The CDF Act also states that the names and curriculum vitae of persons nominated as members of the board "shall be submitted to parliament for approval before appointments are made."

Uhuru's notice quoted the CDF Act but juxtaposed it with the State Corporations Act where Section 7(3) the president sweeping powers to "issue directions and to remove a board."

"The president may, if at any time it appears to him that a Board has failed to carry out its functions in the national interest, revoke the appointment of any member of the Board and may himself nominate a new member for the remainder of the period of office of that member or he may constitute a new Board for such period as he shall, in consultation with the Committee, determine," sub-section (3) says in addition.

The committee referred to is the State Corporation Advisory Committee. However the Act only allows the President to "nominate" and not to appoint.

It is not clear how Waiguru and Uhuru came to duplicate their appointments, or whether Attorney General Githu Muigai was involved in the appointment.
The appointment has been rejected by some MPs who argue that Uhuru did not follow the law.

Yesterday, Dida said he is qualified to do the job and welcomed parliamentary vetting if the president nominates him.

"If the president found that I am capable to do the job, who am I to doubt myself? That should have been enough to settle the matter," he said.
He said he had not yet received any official communication concerning his appointment but thanked Uhuru for "having confidence in me."

Dida asked Uhuru "to always follow the constitution" and said, "The administration has so far done pretty well and Kenyans need to give them time."

The advise given was not good, the president corrected the thing (Mututho). Give credit to Mututho. Parliament agreed.

NAIROBI, Kenya, Jan 8 – Sources in State House have admitted that President Uhuru Kenyatta is facing a dilemma over the recent parastatal appointments that are turning controversial.

According to the reliable sources, a senior official in State House went ahead and advised the President to make the appointments without taking the legal implications into account.

"That person was advised not to forward the names to the President but it was like they succumbed to pressure and did just that. I don't know what will happen next," said the source.

Among the notable names whose appointments are raising debate is Abduba Dida who was appointed the Constituency Development Fund (CDF) Board Chairman and Samuel Poghisio, who was named the Kenya Civil Aviation Authority Chairman.

Dida's academic credentials and the process of his appointment without Parliament's involvement have been questioned, while Poghisio's appointment should have been made through an open and competitive process.

The appointment of The National Alliance Secretary General Onyango Oloo as the Chairman of the Lake Basin Development Authority has also met criticism owing to the fact that he still holds and plans to remain a party official.

Deputy President William Ruto, while speaking on Citizen TV's Cheche show on Wednesday morning, said that the officials behind the ‘mess' would be held to account.

"It should not happen and I am sure that even those people who made the President do the signing of the gazette notice without proper diligence must be asking themselves questions and we will also be asking them very hard questions," said Ruto.

The National Authority for the Campaign Against Drugs and Alcohol Abuse Chairman John Mututho was appointed in a similar fashion before the President revoked the appointment after the backlash that came from Parliament owing to the fact that he had not been vetted by Parliament as required by the Constitution.

The source however said that whether or not the President would cave in to the public pressure was uncertain.

Our sources also explained that the appointments were made using the State Corporations Act which governs all public bodies including the Constituency Development Fund without considering the arising legal bottlenecks.

This locked out public participation which is unconstitutional and allowed the President to appoint public officials without seeking Parliament's approval which is also unlawful.

"The CDF Act is more superior to the State Corporations Act so the appointments should not have been made under it. It is actually illegal to invoke the State Corporation Act," revealed the sources.

The CDF Act would have allowed public participation and removed the confusion that followed the gazettement of Dida's appointment.

While the Act gives the line Cabinet Secretary (Planning and Devolution's Ann Waiguru) the responsibility of appointing the Board's Chairman and gazettement of the names, the State Corporations Act gives the President overriding mandate.

Waiguru had gazetted Dida's name on December 24, last year, but about seven days later on December 31, the President gazetted the same name.

And on January 3, this year, Waiguru revoked her gazettement.

This means Dida remains the Chairman of the CDF Board just as the other chairmen remain the heads of their institutions.
