It is sad to concede that in NECTA there is no comprehensive privacy legislation. To disclose the names and results of students NECTA go against the constitution of URT . It brings bad picture to see results of other students and a daughter of President of URT being disclosed without approval from a person concern.
Of course this does not mean that right to privacy is not recognized in Tanzania. The United Republic of Tanzania (URT) Constitution of 1977 as amended form time to times defines privacy as follows:
Every person is entitled to respect and protection of his person, the privacy of his own person, his family and of his matrimonial life, and respect and protection of his residence and private communications
Article 16(2) goes further stipulating that:
For the purpose of preserving the persons right in accordance with this Article, the state authority shall lay down legal procedures regarding the circumstances, manner and extent to which the right to privacy, security of his person, his property and residence may be encroached upon without prejudice to the provisions of this Article
Article 16(1) and (2) of United Republic of Tanzania Constitution of 1977 as amended from time to time provides for right to privacy. Article 16(2) of URT constitution provides for possibility of other laws to encroach the right to privacy. The said article stipulates clearly that the law maker will enact law to stipulate how privacy right may be protected, pursued or encroached by government agents.

Kabla ya kukujibu inabidi ujue kwamba, any article in the Constitution should not be read in isolation of the others. Pia inabidi ujue kwamba, Ibara nyingi za Katiba ya sasa zinaanza na "Bila kuathiri sheria nyingine za nchi........" Katiba inakupa haki kwa mkono wa kulia, then inaichukua haki hiyo hiyo kupitia mkono wa kushoto.
Now kukujibu hoja yako. Ni kweli Katiba inatoa haki ya privacy. Hata hivyo, ibara ya 30(2) ya Katiba hiyo hiyo inasema "Ifahamike kwamba masharti yaliyomo katika Sehemu hii (sehemu ya tatu ya haki za binadamu) ya Katiba hii, yanayofafanua misingi ya haki, uhuru na wajibu wa binadamu, hayaharamishi sheria yoyote iliyotungwa wala kuzuia sheria yoyote kutungwa au jambo lolote halali kufanywa kwa mujibu wa sheria hiyo..." I am sure NECTA watakuwa wana-publish majina ya wanafunzi waliofaulu na kufeli kwa mujibu wa sheria iliyotungwa na bunge.
Kwa kifupi vyombo vya dola viliyo chini ya serilkali inayoongozwa na baba yake vimekuwa vikitumia sana hiki kifungu kukandamiza haki za binadamu. Unaenda mahakamani una-cite haki yako ya kibinadamu jamaa wana-cite Ibara ya 30(2) na kesi unashindwa. Kwa hiyo, mtoto wa kikwete ni victim wa katiba mbovu kama wananchi wengine. She is not an exception. Anachotakiwa kufanya sasa ni kumshauri baba yake ili Ibara ya 30(2) indolewe kabisa kwenye Katiba mpya ili yasije yakampata tena.
Kwa hiyo, hii ni changamoto kubwa sana kwake kuona jinsi Katiba ilivyo mbovu. Inambidi sasa nae kuwa mstari wa mblele kabisa kupigania Katiba mpya inayolinda sio tuu privacy yake bali pia privacy za Watanzania wote. Thus, wa kumlaumu sio NECTA bali ni baba yake aliyekubali kuongoza hii nchi kwa katiba ambayo haijali haki za binadamu including hata haki za watoto wake.
Pengine mtoa mada alimaanisha kuwa badala ya kuanika majina, wangeweka namba tu za mitihani ya watahiniwa! S/he might have a point here tusimpuuze. Unless tuseme sheria hiyo aloiweka hapo haiwahusu wanafunzi wa shule (ambao kama watoto, consent yao ingepaswa kutolewa na wazazi/walezi wao)
