Of course this does not mean that right to privacy is not recognized in Tanzania. The United Republic of Tanzania (URT) Constitution of 1977 as amended form time to times defines privacy as follows:

'…Every person is entitled to respect and protection of his person, the privacy of his own person, his family and of his matrimonial life, and respect and protection of his residence and private communications…'

Article 16(2) goes further stipulating that:
'…For the purpose of preserving the person's right in accordance with this Article, the state authority shall lay down legal procedures regarding the circumstances, manner and extent to which the right to privacy, security of his person, his property and residence may be encroached upon without prejudice to the provisions of this Article…'

Article 16(1) and (2) of United Republic of Tanzania Constitution of 1977 as amended from time to time provides for right to privacy. Article 16(2) of URT constitution provides for possibility of other laws to encroach the right to privacy. The said article stipulates clearly that the law maker will enact law to stipulate how privacy right may be protected, pursued or encroached by government agents.

Kwa kifupi vyombo vya dola viliyo chini ya serilkali inayoongozwa na baba yake vimekuwa vikitumia sana hiki kifungu kukandamiza haki za binadamu. Unaenda mahakamani una-cite haki yako ya kibinadamu jamaa wana-cite Ibara ya 30(2) na kesi unashindwa. Kwa hiyo, mtoto wa kikwete ni victim wa katiba mbovu kama wananchi wengine. She is not an exception. Anachotakiwa kufanya sasa ni kumshauri baba yake ili Ibara ya 30(2) indolewe kabisa kwenye Katiba mpya ili yasije yakampata tena.

Kwa hiyo, hii ni changamoto kubwa sana kwake kuona jinsi Katiba ilivyo mbovu. Inambidi sasa nae kuwa mstari wa mblele kabisa kupigania Katiba mpya inayolinda sio tuu privacy yake bali pia privacy za Watanzania wote. Thus, wa kumlaumu sio NECTA bali ni baba yake aliyekubali kuongoza hii nchi kwa katiba ambayo haijali haki za binadamu including hata haki za watoto wake.

Kwanza hakuna definition of privacy. Tukichukua, the normal definition ni privacy, kwa kawaida ina-cover 'information about an individual'. Definition ya information ni very wide, na sio issue hapa hata kidogo. Na kwa kawaida lazima iwe information isiyoweza kuwa directly accessed by the public, kwa mfano number ya simu kwenye phonobook. Kweli ukitumia definitions zinatumika katika nchi nyingine, matokeo ya mitihani ni ‘information about an individual'. Sasa NECTA wana-practice ya miaka nenda rudi ya ku-publish results. Kwa hiyo wanaweza kusema matokeo ni argubly ‘public available information' na sio personal. Wangekuwa wanakutumia matokeo kwenye barua, kwa wewe mwenyewe kuyaona, hiyo ingekuwa private. Lakini to me, this is weak and doesnt justify their action/practice. Je wanaweza kutumia kifungu cha 30(2)? Kwa maoni yangu: hapana. Na hii ni kwa sababu katika sheria inayounda NECTA hakuna mahali popote inayowapa uwezo wa ku-publish matokeo. Unaweza kuiona hapa: The National Examinations Council of Tanzania. Hiyo ni procedure wamejiwekea wenyewe na sio sheria na ina uwezo wa kuwa challenged in court.

Powers and duties of Council Acts Nos. 4 of 1987 Sch.; 2 if 1998 Sch.
(1) The Council shall have power to do things and to act in all ways necessary for, or incidental to the purposes for which it is established.

Mimi nafikiri wengi wetu tunajibu kutokana na either chuki au tunaichukulia kisiasa (may be kwa kuwa imewekwa kwenye jukwaa la siasa na mtoa mada ameipersonalize kwa Mwanaasha) but pengine ingekuwa jukwaa la sheria tungewezaelimishana pasipo itikadi zetu.

Namshkuru EMT ameweka wazi kisheria sababu zoinazopelekea hili kuwa hivi. Katika kipengele cha privacy sijaona (au ni ukilaza wangu wa sheria) sehemu inayomuexemt mwanafunzi kutokuwa na privacy. Sawa umejua nimefeli kwa jina langu so?! Unless tuseme kuwa ni for future use kama kunikashfu baadae nikiwa kiongozi mbovu (of which hata ikitumika namba, ukiwa mdadisi utanijua tu).

Hata kama NECTA wanatoa nafasi ya wanafuzni kujaza form za consent lakini wanafunzi hawa wanaelewa maana yake? Je ni kwenye maswala ya tafiti tu ndipo consent ya kijana aliye chini ya miaka 18 inatakiwa kutolewa na mzazi?

Natangulia kwa kukubali kuwa mimi ni kilaza kwenye mambo haya so naomba kuelimishwa

Mkuu naamini kuna regulation zinazogovern uanzishaji wa NECTA na namna ya kuhandle masuala yote yanayohusiana na mitihani
Maana sidhani tuu wanaweza kuwa na policy ambayo haijawa regulation na bado wakaendelea kutumia policy kuendesha mambo yao
Naamini ipo regulation ambayo wanajua kabisa haitaendana kinyume na katiba au kinyume na sheria iliyoanzisha baraza lenyewe

Publication of Examination results has always been done through the public media from the Colonial times. In the earlier days the Newspapers [then The Standard [before 1970] and The Daily News thereafter]] used to publish the results of Form IV and VI results in Mid February of each year. Only those who passed at Div 1 to 4 were listed - complete failures were not listed.

I am sure if you go to the archives and search for The Standard of mid February 1970 you will find the results of one Jakaya Mrisho Kikwete for the 1969 Form IV results of Kibaha Secondary School and 1972 Form VI results of Tanga Secondary School. For the 1969 year for Kibaha you will also find the results of one Andrew Solo Nyerere. For the UDSM and other Universities exam results are published openly and put on public Notice boards.

The Internet is the new global notice board. So I am very doubtful if Mwanaasha Kikwete will be successful if she launches a legal case against NECTA in this regard. However, we in JF however may be legally liable for intrusion into her privacy if we continue to discuss her results in this Forum. Some of the comments appearing here are to say the least obnoxious and should be condemned. After all failing in Form IV is not the end of life - there are people who failed in their earlier school days but excelled later on in life.

I suggest the JF Moderator should remove the obnoxious statements from this thread especially those which link her failure to her genetic makeup - that is Mengelean in my opinion and should not be entertained in JF.

Wengine hapa tumesoma kwenye vyuo ambavyo matokeo ya mitihani yalikuwa yakibandikwa kwa kutumia last four digits za social security number.

Ikitokea umefanya vizuri kiasi cha kuwa kwenye dean's list wanakuuliza kabisa kama unataka jina lako liwekwe kwenye hiyo list na kuna consent form unayojaza na kutia saini yako.

Sasa katika zama hizi za information superhighway na social media ambazo watu wanaweza kuzitumia wapendavyo kuwaumiza na kuwachafua wenzao ni lazima kuwe na utaratibu mzuri unaoweza ku minimize damages kama hizo kwa wanafunzi.

It is imperative to go with the changing times.
