Raila blames IEBC for poll loss, calls for shake up of electoral body

NAIROBI, KENYA: Former Prime Minister Raila Odinga wound up his campaign secretariat with a stinging attack on the electoral body over his loss in the March 4 elections.

At a luncheon hosted by Raila at Carnivore restaurant, the PM claimed the Independent Electoral and Boundaries Commission (IEBC) CORD a win, saying it should not be allowed to conduct the next polls as it is currently constituted.

"IEBC as currently constituted should not be allowed to conduct the next elections. We want an institution that can serve the country; let's have an institution that can stand the test of time," said Raila.

To remove a commissioner (s) from the electoral body, one has to first present a petition to the National Assembly.

Gross misconduct


If the House approves the petition, the President appoints a tribunal to probe the allegations and make recommendations.
The President shall then act within 30 days based on the recommendations.

The circumstances under which one can originate a petition border on serious violation of the Constitution or any other law, gross misconduct, physical or mental incapacity to execute office duties, incompetence or bankruptcy.

It is these grounds that the tribunal investigates before making recommendations to the President.

Raila, who thanked members of the secretariat for making sacrifices during the campaigns, claimed even if re-run poll was conducted,Jubilee Coalition would have won, saying the outcome had been pre-determined. "IEBC is the problem, it is not the people," said Raila.

Raila, who was in an exuberant mood, however, said the country must move forward.

"I grew up in a different Kenya, the country has transformed," said the former PM.

His statement comes after the Director of Public Prosecutions Keriako Tobiko asked the Ethics and Anti-Corruption Commission (EACC) to probe IEBC on procurement irregularities of electronic equipment.

In its ruling on the presidential poll petition, the Supreme Court concluded it was likely the procurement of electronic system was marred by competing interests.

The anti-graft agency has started investigating allegations of corruption into the procurement of election equipment.

Ethics and Anti-Corruption Commission chief executive Halakhe Waqo on Thursday said preliminary investigations into tender deals by the Interim Independent Electoral and Boundaries Commission (IEBC) started following the Supreme Court's order.

Though the Supreme Court only ordered investigations into procurement of the voter identification devices and results transmission system, the EACC was also looking into allegations of irregular sourcing of 9,750 biometric voter registration kits.

"The Ethics and Anti-Corruption Commission wishes to confirm that it has commenced preliminary investigations into procurement processes by the IEBC," Mr Waqo said.

"The investigations were precipitated by intelligence information to the effect that procurement was not transparent and may have been flawed," said the anti-graft chief.

Mr Waqo appealed to Kenyans with information that could assist to divulge it.

The Supreme Court, in its judgment in a petition filed by former Prime Minister Raila Odinga, said the acquisition of the voter identification devices and results transmission system was marred by impropriety or even criminality.

Though the IEBC tendered for over 30,000 voter identification devices, suppliers Face Technologies only delivered 5,000 and on election day, the machines failed to work.

Members of the tender team that handled the voter identification devices and results transmission system procurement from Face Technologies, a South African firm, are not publicly known.

Ms Praxedes Tororei chaired the first committee that processed the Sh3.9 billion biometric voter registration kits tender before resigning in a huff with nine other members of her committee.

In some of the letters exchanged with top IEBC officers, Ms Tororei cited external interference in the work of her committee.

Former Prime Minister Raila Odinga on Thursday criticised the electoral commission, saying it could not be trusted to conduct another election as currently constituted.

Mr Odinga said the Independent Electoral and Boundaries Commission (IEBC) presided over an election that had numerous malpractices, which should not be allowed to happen in future.

“Let this be the last time that we go to an election and end up with what was witnessed in the last General Election,” said the former PM when he hosted a luncheon for members of his presidential campaign secretariat in Nairobi.

He was accompanied by Bungoma Senator Moses Wetang’ula and more than nine Cord legislators.

He said even if they had gone for a rerun, they would have lost it as the IEBC had already ordered for more ballot papers, to be distributed in the strongholds of his opponents, which would have been used to rig the polls.

Stand test of time

“We cannot go back to an election with the IEBC as is currently constituted. What happened to me today will happen to someone else tomorrow. Let’s have institutions that stand the test of time,” he went on, perhaps calling for the commission to be reconstituted before the next General Election.

Mr Odinga spoke just a day after the Director of Public Prosecutions ordered the Ethics and Anti-Corruption Commission to investigate the procurement of election equipment.

The DPP, Mr Keriako Tobiko, said the order was due to the recommendations of the Supreme Court that IEBC officials involved in procurement irregularities be investigated. (READ: Corruption squad set to probe IEBC)

On Wednesday, the Supreme Court judges recommended investigation and possible prosecution of electoral commission officials who may have been involved in impropriety during the procurement of the equipment.

But on Thursday, the former PM did not have kind words for the Supreme Court Judges either. He criticised the manner in which they delivered the judgment that upheld IEBC’s declaration of Mr Uhuru Kenyatta as the country’s fourth President.

He said the judges “were even afraid to read their judgment as it is in common practice. They only signed it and left”.

Mr Odinga said his lawyers had cited several contradictions in the judgment, which they will be revealing in due course.

The former PM told his supporters that everything that happened during the poll was now water under the bridge and Kenyans must now move forward.

“When one window of opportunity closes, another automatically opens. This is what we must focus on. But sadly, we spend most of our time knocking the doors that have already closed,” Mr Odinga said.

Usimzuzue, its not politically convenient to say uhuru was voted by more than two tribes.
