Dear Comrades,


In December 2014, about 70 chadema contestants were barred from contesting elections for various reasons. They then filed petitions in the Karagwe district court. A lawyer, Mathias Rweyemamu, assisted them in the drafting of the petitions. But thereafter the layer almost abandoned them due to, among other reasons, the ongoing special hearings in the court of appeal which will end on March 06, 2015. For this reason the petitioners have no reliable legal assistance now.

As a result, some cases which had already been filed are being dismissed for various reasons. Under one category of the dismissed cases the court had ordered separation of parties who were joined under one petition but the petitioners did not know how to amend the petition which entailed the joinder of parties.

And in the second category of dismissed cases the respondents submitted their reply but no counter-reply was submitted by the petitioners to the court. Legal illiteracy is the issue. They orally request the court Magistrate to extend time until after March 06, 2015 when their lawyer would have completed his routine at the court of appeal. But the magistrate refused to grant their prayer.

This District Magistrate, Faustine Paul Magorya, is very quick to act against the chadema petitioners but in favour of CCM. He is obviously biased. Unfortunately he is also the District Court Registrar.

Thus, the petitioners are looking for legal aid under these circumstances. They first want an assistance in court proceedings for the remaining cases. And secondly, they want to know if they can appeal against the biased dismissals as made by the man Faustine Paul Magoryo. The Copies of the relevant petitions are hereby attached for our attention. Please advise accordingly.
