Kamati ya Bunge ya Katiba na Masuala ya Kisheria imeahirisha kusikiliza maoni ya wadau kuhusu mapendekezo ya marekebisho ya Sheria ya Mamlaka ya Nchi Kuhusiana na Umiliki wa Maliasili ya mwaka 2017 na Sheria ya Mapitio na Majadiliano Kuhusu Masharti Hasi Katika Maliasili ya nchi ya mwaka 2017.

Mwenyekiti wa Kamati hiyo, Joseph Mhagama, ameiambia The Chanzo Alhamisi hii kwamba wameomba ufafanuzi zaidi kutoka kwa Serikali kuhusu mabadiliko hayo ambayo yameibua mjadala mkubwa miongoni mwa wafuatiliaji wa mambo nchini.

Sheria hizo ni miongoni mwa sheria zilizojumuishwa katika Muswada wa Sheria ya Marekebisho ya Sheria Mbalimbali Na. 2 wa Mwaka 2023, uliokusudia kurekebisha, pamoja na sheria nyingine, sheria hizo mbili ili zisitumike katika uendeshaji wa miradi ya uendeshaji, uendelezaji na bandari.

Huku wadau wengi wakihusisha sheria hii na mkataba unaotegemea kuipa kampuni ya DP World ya Dubai, kazi ya kuendesha, kuboresha na kuendeleza bandari Tanzania.

Muswada huo uliosomwa bungeni kwa mara ya kwanza Juni 28, 2023, na Kamati ya Bunge ya Katiba na Masuala ya Kisheria ilialika maoni ya wadau kuhusu marekebisho yaliyotazamiwa kabla ya muswada huo kurejeshwa bungeni baadaye Agosti. Kamati ilisikiliza maoni ya wadau hao mnamo Agosti 16, 2023.

Sehemu ya IV na V ya muswada wa marekebisho zinapendekeza marekebisho ya sheria tajwa ili kuhakikisha kuwa utekelezaji wa sheria hizo hauathiri uwekezaji utakaokuja kufanywa katika uendelezaji na uendeshaji wa bandari.

Serikali inasema marekebisho hayo yanalenga kuwezesha bandari za Tanzania “kufanya kazi katika viwango vya kimataifa na kuvutia meli nyingi za mizigo mikubwa kuhudumiwa na bandari” za Tanzania.

Sheria hizi mbili ambazo zilipitishwa mwaka 2017 ziliwekwa kwa madhumuni ya kuhakikisha Tanzania inanufaika na maliasili zake, lakini pia inatoa nafasi ya kurekebisha mikataba mibovu.

Dk Mhagama ameiambia The Chanzo kwamba kamati yake ilipokea maoni kuhusu sehemu nne za sheria ambazo Serikali inataka kuzifanyia marekebisho, na kuacha sehemu mbili zilizoundwa ili kuipa Tanzania mamlaka juu ya maliasili zake.

“Muswada huo una sehemu sita, kamati iliona ifanyie kazi vipengele vinne tu, na kuviacha vingine viwili ili kutengeneza njia ya mashauriano na Serikali kwa lengo la kupata ufafanuzi wa maudhui ya sheria hizo mbili,” Mhagama, ambaye ni mbunge wa Madaba (Chama cha Mapinduzi – CCM), anasema.

Anasema kuwa wadau wataalikwa kuwasilisha maoni yao mara baada ya kupata ufafanuzi na Serikali pindi ikiamua kuendelea na marekebisho yaliyopendekezwa na kuongeza kuwa kamati hiyo inatakiwa “kujiridhisha” na yaliyomo kwenye muswada huo kabla ya kuamua kuendelea nao.

Dk Mhagama ameiambia The Chanzo kwamba kamati yake iliomba maelezo kutoka kwa Serikali kuhusu marekebisho ya sheria hizo mbili, huku akishindwa kueleza ni lini hasa anatarajia mamlaka kujibu hoja zilizoibuliwa.

“Serikali itakuwa hapa milele; wakati wowote watakapoona inafaa kujibu hoja tulizoibua watakuja kwenye kamati na mapendekezo yao,” Dk Mhagama anafafanua. “Si lazima iwe leo, kesho au mwakani.”

Mapendekezo ya marekebisho ya sheria hizo yanakuja wakati mjadala mkubwa wa kitaifa ukiendelea kuhusu makubaliano baina ya Serikali ya Tanzania na Dubai ili kuiruhusu DP World kuiendesha bandari ya Dar es Salaam.

Mnamo Juni 10, 2023, wabunge waliridhia kwa kauli moja mkataba huo tata ambao unaendelea kuleta mgawanyiko wa taifa, huku mgawanyiko wa maoni kati ya wafuasi wake na wakosoaji ukionekana wazi kila siku.

Serikali na chama tawala wanauelezea mkataba huo kuwa “mkataba bora zaidi kuwahi kutokea,” huku wanaharakati na vyama vya upinzani wakiuelezea kuwa “mkataba mbaya zaidi.”

Miongoni mwa waliokataa mpango huo ni Maaskofu wa Kanisa Katoliki, ambao kwenye taarifa yao ya pamoja ya Agosti 18, 2023, waliitaka Serikali kusikiliza matakwa ya wananachi ya kufuta mpango huo, wakisema, “Sauti ya watu ni sauti ya Mungu.”

“Ni lazima miradi kama hii [ya maendeleo ya bandari] iendeshwe na kusimamiwa na Watanzania wenyewe, huku wakikaribisha ushirikiano ambao wao wenyewe wataudhibiti,” Maaskofu hao 37 walisema katika taarifa yao hiyo ya pamoja.

“Hili ndilo ambalo wananchi wamekuwa wakililia ili tuweze kuboresha uwezo wetu wa kusimamia uwekezaji muhimu,” waliendelea kueleza. “Kwa sababu tayari tumeshachambua mapungufu ya jinsi tunavyoendesha bandari zetu, tunaweza kuyafanyia kazi huku njia za uchumi zikisalia mikononi mwetu.”

Sema sehemu gani ya IGA unayodhani inashida nikuonyeshe ipo covered hapo kwenye hiyo BIT ya Japan/Saudi Arabia.

Tofauti ni kwamba IGA ni specific kwa bandari, wakati hiyo BIT ni general. Lakini framework ndio ile ile for the most part.

Ukielewa mambo yote hayo na kujua msingi wa stabilisation clauses IGA sio lolote si chochote that’s just a norm today in investment protection. Nitty Gritty zipo kwenye ‘concession agreements’ ndio maana hiyo mikataba wanataka iwe siri popote duniani.

Hizo sheria za 2017 hazibadilishwi kwa sababu ya IGA (ni viazi tu kama hakina Mwabukusi wenye uelewa mdogo kudhani ile ni big deal) hiko cha mtoto tu if anything waarabu wana good intentions.

Kama umeelewa strategically kwa kusoma phase I & II DPW wanalenga nini impact yake it’s a game changer kwa uchumi wa bandari. Sababu hasa za kubadili hizo sheria za 2017 ni LNG plant ambapo mkataba inabidi uende bungeni. Ni hivi $42 billion LNG plant hiyo itakuwa the second most expensive plant in the world. Maana yake nini jamaa wana data ambazo sisi hatuna.

Tanzania ina 500,000 sq km ya potential area of ‘oil and gas’ reserves mpaka sasa only 100,000 km sq has been explored; from that there is enough reserve to recoup $42 billion investment. However utaminywa kweli in the period hili hiyo hela irudi.

Trust me wasingeweka hela hiyo for 50 cubic million of gas, faida yao ingekuwa ndogo sana. Wameshaona potential za mbele kubwa mno katika maeneo ambayo hayajaguswa so they can justify that investment na malipo ya mbeleni. Vinginevyo $42 billion investment ni gharama za plant ambazo hazilipi kabisa kwetu unless kama unasikiliza uthenge wa Zitto na Makamba na hiyo ndio sababu kuu ya kubadili hiyo sheria ili mkataba wa PSA tulioingia usiende bungeni; kuna madudu wazungu ambayo wataki public ujue that’s to say the nation is fu*cked.
