The spokesman was, however, dismissed last evening by Cord deputy minority leader Jakoyo Midiwo, who said two former presidents who had the same status as the former PM, had not returned anything to the government.

were there any constitutional amendments regarding raila retaining six government vehicles..there was just a pension scheme and security detail from the state that were to be given to him same to the former vp, but how come the former vp is not overshadowded by the same controversy of refusing to return vehicles??.

Which I think is corruption and a form of impunity for an aspiring leader or president kukwamilia mali ya umma. Has Raila lost motivation??, has he lost the faith??? why cant he respond positively with govt order to release state vehicles. Let him return vehicles. if he starts such behaviors AGAIN wakenya watamnyima kura kwa mara ya tatu mfululizo.

State denies former Prime Minister Raila Odinga is holding onto cars

Updated Sunday, July 28th 2013 at 18:51 GMT +3
By Tobias Chanji

Kwale, kenya:The Government has denied that former Prime Minister Raila Odinga is illegally holding onto six of its cars and described him as a respected leader.

"...right now he has no extra vehicles," was Interior Cabinet Secretary Jacob ole Lenku's stark answer as he declared on Saturday in Kwale, where he was meeting security chiefs from Kwale, Mombasa and Kilifi.

Mr Lenku's announcement contradicted Thursday's statement by Government spokesman Muthui Kariuki when he claimed Raila had refused to surrender six Government vehicles given to him when he was Prime minister.

Illegal sirens

Mr Muthui further claimed Raila had attached illegal sirens on these cars and was using them to break the law. Ironically, yesterday Lenku contradicted Muthui's claims as the spokesman who was accompanying him stood by mute.

The Cabinet Secretary said all extra vehicles given to Raila were actually taken away by the Government without stating when this happened. "All extra vehicles and security given to the former PM were withdrawn according to the law on police protection and right now he has no extra vehicle," he said and added that as a leader the Government respected Raila.

Ole Lenku did not state whether Raila has any Government cars left with him or those that he should have. Pressed for clarification by the press Muthui declined to comment.

CORD and supporters of the former premier have denounced Muthui's claims, accusing him of being highly intemperate and rude against Raila.

On Thursday Muthui claimed that Raila's "sidekicks" plotted Tuesday's heckling of Jubilee leaders at a funeral in Kisii, which President Uhuru skipped and also alleged that the former premier had refused to return six Government cars.

Yesterday Inspector General of police David Kimaiyo, Kwale governor Salim Mvurya, outgoing Coast PPO coordinator Aggrey Adoli and county commissioners accompanied ole Lenku from the three counties. On recent eviction and gang violence in Naivasha ole Lenku said due process would be followed and arbitrary expulsion and gangs crushed. He said those involved in torching of houses in Naivasha would be arrested and charged.

"Our security people have gone there to look at what happened and will arrest anybody that did that unlawfully," he said referring to the evictions. Kimaiyo claimed the Mombasa Republican Council ( MRC) that is active in Kwale has been destroyed and warned other tribal militia against terrorism.

International Center for Policy and Conflict opposes petition against Safaricom and Airtel
Updated Tuesday, July 30th 2013 at 15:13 GMT +3
By Protus Onyango
NAIROBI, KENYA: The International Center for Policy and Conflict is opposed to two constitutional petitions filed at the High Court of Kenya against Safaricom and Airtel touching on the criminal proceedings at the International Criminal Court by one indictee Uhuru Kenyatta.
“International Criminal Court (ICC) indictees Uhuru Kenyatta and William Ruto continue pretending to take high moral ground despite having been put on trial for crimes against humanity by the judges at the ICC after rigorous, open and transparent judicial proceedings,” said Ndung’u Wainaina, Executive Director of International Center for Policy and Conflict ( ICPC).
He added, “The two indictees accused of gravest atrocities known to prick conscience of humanity have perfected the art of denying everything and putting the accuser (ICC) on trial. Further, they have belittled as well as dismissed the claims of the victims and ICC as shrill exaggerations and or lies.”
Mr Wainaina termed as curious the degree of propaganda and distortion of information the two indictees have deployed in their determination mission to discredit the Court and the victims.
“The latest machinations of the Uhuru Kenyatta against the ICC and fair process of administration of justice is reflected in the ‘secret’ constitutional petition filed by his lawyers in the High Court of Kenya,” Mr Wainaina said.
He added, “The ‘secret’ petition against publicly listed communication company Safaricom and another private company Airtel is unacceptable.”
He said that in a democratic human rights society, court proceedings unless on extremely defined specifications in law are supposed to take plaice in open and rights of public participation upheld.
“Kenya situation cases before the ICC are of great importance to the public. As such Kenyan public is constitutionally entitled in accordance with Article 35 to be provided with the details of the constitutional petition and the proceedings thereof the petitions,” Mr Wainaina said.
He added that the preliminary proceedings of the petition filed by Mr Uhuru ought to have been conducted in public before the judge making decision to bar media and public.
“Further, under Article 50(8) of the Constitution clearly stipulates exclusion of press or other members of the public from any proceedings can only happen if it is necessary to protect witnesses or vulnerable persons, public morality public order or national security,” Mr Wainaina said.
He added, “From the foregoing, ICPC will take the appropriate legal action to challenge the proceedings and outcome of the petition filed by ICC indictee at High Court in order to protect public interest and victims’ rights to access information and participation in administration of justice.”
Another one for jubilee mbona safari mtakoma?

Nimeshasema hawa jamaa wataipeleka Kenya pabaya.

Muda utaongea!

In Summary

  • Atwoli, clergy and MPs describe the move as unfair and rude

Government's decision to recall vehicles assigned to former Prime Minister Raila Odinga and former Vice President Kalonzo Musyoka on Sunday came under heavy criticism.

Central Organisation of Trade Unions boss Francis Atwoli, Anglican Church of Kenya Mombasa diocese head Julius Kalu and some MPs describe the move as "unfair" and "disrespectful" of former leaders.

Bishop Kalu said both current and former leaders deserved to be treated with equal respect and dignity.

"The current leaders are at the helm because of past ones and, therefore, they should be treated with courtesy," he said after unveiling a Sh100,000 complex of his church.

Former heads of state and the prime minister among other state officials, he said, should not be belittled because they all did commendable work during their tenures.

He cautioned the Jubilee leadership against spending a lot of time squabbling over trivial matters and instead focus on fulfilling its pledges to Kenyans.

"Witch-hunting, unnecessary opposition and endless politics will not help the country move in the right direction. All these are happening where there is shortage of grace," said the clergy in his sermon to the congregation.

He called on the central government to stop holding on functions that should be carried out by county governments.

"The meaning of devolution is bringing closer essential services to the public. Therefore, the central government must devolve all functions assigned to the counties by the Constitution."

Mr Atwoli asked the government to treat Mr Odinga and Mr Musyoka with respect.

"I want to tell those being used to humiliate the two leaders that their time to retire will also come and I do not think they will be happy to undergo such ordeals," he said at Got Rateng Secondary School in Kabondo Kasipul, where he helped to raise over Sh1.6 million.

He said there were more civilised ways of asking the two former leaders to return State vehicles.

His sentiments were echoed by MPs Silvance Osele and Millie Odhiambo, both of whom said Kenya was watching those harassing the two leaders.

The order to surrender the government vehicles first came from Government Spokesman Muthui Kariuki before Interior Cabinet Secretary Joseph Ole Lenku repeated it.
