Courts could tear up BAE plea bargain

The £30 million plea bargain between the Serious Fraud Office and BAE Systems could be ripped up by the courts.

SFO director Richard Alderman is understood to have reshaped the groundbreaking pre-packaged 'guilty' deal with the defence and aerospace giant over allegations of improper payments in Tanzania to take account of strong criticisms from a judge in a similar case in March.

On that occasion, Lord Justice Thomas, sitting at Southwark Crown Court, south London, said a fine agreed by the SFO with Anglo-American chemical firm Innospec was 'wholly inadequate' and he approved the deal only reluctantly.

He made it clear that in this particular case Alderman did not have the legal power to agree to the plea bargain, adding: 'A suggested agreed sentence is not only impermissible, it can raise false hopes.' He said that in all cases 'it is for the court to decide on the sentence'. Innospec had pleaded guilty to paying bribes abroad.

With the SFO's plea bargain with BAE having been struck in February, Alderman is understood to have studied the Innospec judgment in depth to see what effect it may have.

It is thought the SFO has now changed the presentation of the BAE package to make it clear to the court that it is merely a 'framework' rather than a done deal.

The SFO hopes that by respecting the court's right to decide the sentence it has cleared the way for the plea bargain to be approved.

Under the arrangement, BAE would pay a £30 million penalty for accounting irregularities in relation to payments made in Tanzania during the sale of an air traffic control system. The judge would decide how much would be paid as a fine and how much given as compensation to the people of Tanzania.

But while the SFO believes the judge could raise the size of the total penalty, BAE understands that the court would be likely to vary only the proportion of the £30 million paid as a fine.

As with the Innospec case, it is thought that the BAE matter will be heard at Southwark Crown Court.

The bargain was part of a transatlantic settlement in which the US Department of Justice would levy a £250 million fine over BAE's dealings in Saudi Arabia.

As part of the settlement, the Americans will impose an 'ethics monitor' on BAE - a British subject who will have a veto over the company's hiring of sales agents worldwide. This is designed to reduce the risk of dubious commission payments.

Financial Mail has learnt that BAE has drawn up a shortlist of candidates.

Mimi noana kuna haja ya kumuadabisha huyu Hosea manake naona yeye ndio amekua chanzo kikubwa cha rushwa badala ya kuzuia rushwa. Nani atasahu story ya Hosea ya kufoji mashitaka ya mauaji na kusababisha muadnishi wa gazeti ya the Family Mirror kufungwa?

Huyu jamaa ni natural born fraudster...! But i guess his days are numbered...!
