Joto la jiwe CONSTRUCTIVE CRITICISM is much welcome.i loath and detest corruption,i will never stand up for corruption,infact i don't take or give bribes,i know better.corruption is the single most vice that has chocked africa out of life rendering a many people to hopelessness,corruption continues to rear its ugly head in every aspect of african life,the scorge has single handedly eroded our dignity on the global arena,africans should travel and observe how we looked down upon by other races simply because we can't govern ourselves.by there outside africa we are viewed as one people plagued by poverty,disease,hunger,endless wars,terrorism,immigration.....name them.However we must discern constructive criticism from mere defamations and witch hunt,let us collectively fight the vice the proper way...WAKE UP PEOPLE

Joto la jiwe the article attached in this thread is from the standard media group,the standard media group is full of lazy journalist who oftenly churn out tonne of garbage in the form of news,traditionally their reports are poorly investigated which results to poorly executed reports like this one,don't rely on them for credible news,they are just rubbish. Look the contract to construct the three dams was structured in the form of EPC (engineer,procure & construct),in this arrangement the contractor is awarded a tender whereby he will engineer a detailed design of the project,PROCURE for funds,mobilise equipment and execute the project free from the client interfearance ,after which he will deliver complete funtioning asset to the client,the client receives the asset and is given a deformity liability grace period to access the project,if the client is fully satisfied he remits/reimburse the contractor as per the terms of the agreement.now in the case of this dams the italian contractor(CMC Di ravenna) sourced fund from intesa san paolo(an italian bank) and BNP pariba fortis a chinese owned beigium based bank,the kenyan treasury didn't provide any funds,however the bone of contention is some government officials were culpable of receiving kickbacks to award the contract to CMC Di ravenna,the collusion between the contractor and government officials is what uhuru was referring to,anybody found guilty will be punished,investigations are ongoing.the government officials took advantage of mandatory that the contractor had to be italian since italian government backed bank was providing bulk of the loan.

If the said company applied for the contract knowing that they were in a bad situation but chose not to disclose the same therefore hinting there was malicious intent, GoK could file a motion to lift stay and have GoK recover its money first before the accounts are closed.

Economics without the foundation of law, in this case international law, must be economic knowledge acquired through a natural process like osmosis. Reminds me when I had to struggle to educate a few big headed morons here about observation of due dilligence being a basic requirement in any contract of substance as clearly stipulated in Law of Contracts.
