Rais kupitia WIZARA (ni muhimu sana - Waziri ndo anafanya implimentation) ana uwezo wa kusimamia matumizi ya pesa, uwezo huu unaishia ndani ya executive arm of government - Wizara zote, body za serekali kama vile huduma center..... Lakini mamlaka yake yanaishia hapo.Hapo ndipo ninapochanganyikiwa, inawezekana ama wakenya mlio wengi humu ndani hamuijui vizuri katiba yenu, au katiba yenyewe ndiyo mbaya. Rais wa nchi amepewa jukumu la kusimamia na kuendeleza uchumi wa nchi, serikali ndiyo yenye jukumu la kusimamia ukusanyaji na usimamiaji matumizi bora ya mapato ya nchi, sasa inawezekanaje serikali ikiongozwa na rais iwe na jukumu la kukusanya na kubuni vyanzo vya mapato lakini isiwe na uwezo wa kusimamia matumizi yake.
Kwa mfano umesema hapo juu kwanza udhibiti huo hautowagusa wabunge na wafanyakazi wa mahakama, wao watatumia pesa kadri apendavyo sasa hili limekaaje?, Pili katika andiko ulilonitumia hapo juu, linasomeka kwamba serikali imeamua kufuta shughuli na safari zisizokua na umuhimu sana, ili kukusanya pesa za uchaguzi, ila uchaguzi ukipita na pesa zikisharudi, watarudisha hizo shughuli zisizokua za lazima ili ziendelee kutafuna pesa, je unataka kuniambia baada ya uchaguzi hakuna mambo mengine muhimu zaidi zinazoweza kufaidika na hizo peza, kwanini mzirudishe tena kwenye safari za viongozi, semina na kununua furniture za viongozi, tena wanaagiza toka nje ya nchi?

Rais hufanya nageti yake ya ile miradi anataka kufanya na pesa ngapi anahitaji, Mahakama hufanya bajeti yake, wizara ya Ulinzi hufanya bajeti yake, Alafu Bunge hua inaketisha kilamtu chini na kuwauliza kwanini wanahitaji hizo pesa na vipi watatumia hizo pesa na pia watafanya nini kuhakikisha pesa watakazo pewa watazitumia vizuri.....kwahivyo kupiti hayo mamlaka, bunge ndo linauwezo wa kuhakikisha makama na wizara nyengine za serekali zinatumia pesa vizuri..
Kwa mfano hapa; Mahakama iilazimika kujieleza mbele ya kikao ja bunge ambacho kilikua live on tv kwanini walikua wanaitisha ksh 300 millioni kununua ndege ambayo itakua ni ya matumizi ya mahakama pekee...
Judiciary put to task over plan to buy plane
MPs Tuesday asked the Judiciary to explain why it intended to buy a fixed-wing plane for Sh300 million when it would be cheaper to rent one on a need basis.
The aeroplane is one of the items in the budget for the Judiciary which has proposed to spend Sh24.1 billion in the coming financial year — Sh17.1 billion on recurrent and Sh7 billion on development expenses.
Chief Registrar Gladys Shollei appeared before the parliamentary Budget Committee chaired by Mbeere South MP Mutava Musyimi to explain why the Judiciary wants to buy rather than hire an aeroplane.

Wakati wizara ya fedha inaandaa bajeti ya nchi, lazima iandae na kuonyesha ni maeneo gani itapata pesa, kwa mfano utasikia anasema, serikali imeazimia kuongeza kodi kwenye sigara, na kuondoa marupurupu ya watumishi wote wa umma, watumishi wa uma ni pamoja na wabunge na mahakimu, sasa bunge linaweza kuipitisha hiyo bajeti au kukataa na kutaka kipengele cha marupurupu yao kirudishwe.
Utakumbuka juzijuzi hawa wabunge wapya wa Kenya walitaka kukataa viwangu vipya vya pesa vilivyopendekezwa na tume ya kurekebisha mishahara ya Kenya, baada ya tume hiyo kurekebisha mishahara ya watumishi wote wa Kenya, lakini Uhuru Kenyatta akasema hatukubaliana na wabunge na hatorudisha marupurupu yao?, rais anao uwezo huo wa kuyaondoa ama kuyaongeza, anachohitajika ni kupeleka mswada bungeni, kupunguza au kufuta safari za nje, sio kitu kilichopitishwa bungeni, hilo ni jambo la kiutendaji sio la kisheria, rais anao uwezo wa kumzuia mtu yeyote yule bila idhini ya mtu yoyote na atakua hajavunja katiba yoyote ile.
Kuhusu safari za nje kuingiza pesa, sisi tulikua na rais mkata mitaa kana Uhuru Kenyatta, anaitwa Jakaya Kikwete, tunajua faida na hasara zake, sasa hivi tunaye huyu uncle Magu, tunajua faida na hasara zake, kwahiyo wala usipate kazi ya kutuambia umuhimu wa safari za rais.
Kwanza sio kweli kwamba marupurupu hayawezi kupunguzwa kama bado mtu yupo kwenye nafasi yake, wewe unadanganya ili uweze kuonekana inafamu mambo kumbe uelewa wako ni mdogo sana, kwa sababu viwango vya mishahara vilivyorekebishwa na hiyo tume yenu vimehusu nafasi zote, sio tu wale wakuchaguliwa ambao kipindi hicho walikua wanamaliza muda wao, zimehusu watumishi wote wa uma wakiwepo wakurugenzi wa wizara na mashirika ya umma ambao kipindi chote wapo madarakaniKufika hapa sijui kama lengo lako ilikua ni nini, ulikua unauliza swali kwasababu unataka maelezo au ulikua unauliza swali ili ukosoe kwasababu halifanani na vile unavyofikiria.......
Inaonekana umeandika maelezo kulingana na vile unavyoelewa vyombo vya dola vya nchi yeyote, yani general understanding... Inaezekana hivyo ndo inafanyika huko kwenu lakini hapa Kenya kuna body ambazo hazigusiki kikatiba na rais hana mamlaka yeyote juu yao.... Penine nikueleze na mifano ndo uelewe manake kufikia hapa kama bado hautaelewa basi sijui nisemeje........
Hata hio tume ya mishahara ya SRC ni tume ambayo rais hana mamlaka juu yake, hayo marupurupu ambayo rais amesema yapunguzwe kutoka kwa watumishi wa uma haiwezi ikawagusa SRC manake hao pia ni 'independent commision'...
Na ukiangalia SRC walivyofanya, walipunguza marupurupu ya wabunge kama bunge llilikua limeshavunjwa, wabunge wanaolipwa mshahara bila marupurupu ni wamechaguliwa upya kwahivyo technically, wabunge hawajapunguzwa mishahara.....Manake kisheria mfanyikazi wa uma hawezipunguziwa mshahara au marupurupu akiwa bado anashikilia offisi....
Hivyo hivyo ndo bodi zengine ziko, hauwezi ukawapunnguzia marupurupu kama kado wanashikilia ofisi. na kama ni independent body basi hata rais hana mamlaka ya kuwaambia jinsi vipi watatumia petroli ya gari au kama ni vipi watarembesha maua ndani ya ofisi zao , au kama wataeka marashi ya bei ghani ndani ya choo, manake katiba inasema hakuna mtu ana mamlaka ya kuwaambia ni vipi watafanya kazi zao na ni wapi watasafiri au hawatasafiri.
Alafu kuhusu wabunge kujiongezea mishahara na rais kusema atakataa.... Bunge ni special case, manake kando na SRC ni bunge pekee ndo lina uwezo wa kuongeza mishahara, na kawaida, bunge hua likipitisha mswaada ni mpaka rais atie saini ndi mswaada huo uwe sheria, hapo ndo mamlaka ya rais yanaingia, Lakini kama wabunge wameamua ni lazima mshahara uongezwe wanaweza kupitisha huo mswaada hata baada ya rais kukataa kutia sign, wanauwezo wa kuregesha mswaada huo bungeni na kuita wabunge wote (angalau 2/3 ya wabunge) na kuupigia kura na kuupitisha bila idhini ya rais.. Au pia wanaeza kufanya rais 'hostage' wakamtishia kichinichini kwamba hawatapitisha bajeti ya mwaka ujao kama rais hatatita saini nyingeza za mishahara, ghafla wiki ijayo ukaona rais amelegeza na kukubali kuongeza mishahara na marupurupu ya wabunge..
Hii ndo katiba ya Kenya, soma vizuri... Hio executive order ya Rais ya kupunguza marupurupu na matumizi ya pesa haigusi hizi 'constitutional bodies'
248. (1) This Chapter applies to the commissions specified in clause (2) and the independent offices specified in clause (3), except to the extent that this Constitution provides otherwise.
(2) The commissions are—
(a) the Kenya National Human Rights and Equality Commission;
(b) the National Land Commission;
(c) the Independent Electoral and Boundaries Commission;
(d) the Parliamentary Service Commission;
(e) the Judicial Service Commission;
(f) the Commission on Revenue Allocation;
(g) the Public Service Commission;
(h) the Salaries and Remuneration Commission;
(i) the Teachers Service Commission; and
(j) the National Police Service Commission.
(3) The independent offices are—
(a) the Auditor-General; and
(b) the Controller of Budget.
249. (1) The objects of the commissions and the independent offices are to—
(a) protect the sovereignty of the people;
(b) secure the observance by all State organs of democratic values and principles; and
(c) promote constitutionalism.
(2) The commissions and the holders of independent offices—
(a) are subject only to this Constitution and the law; and
(b) are independent and not subject to direction or control by any person or authority.
(3) Parliament shall allocate adequate funds to enable each commission and independent office to perform its functions and the budget of each commission and independent office shall be a separate vote.

(7) The remuneration and benefits payable to or in respect of a commissioner or the holder of an independent office shall be a charge on the Consolidated Fund.
(8) The remuneration and benefits payable to, or in respect of, a commissioner or the holder of an indepenedent office shall not be varied to the disadvantage of that commissioner or holder of an independent office.
CHAPTER 10 – JUDICIARY

160. (1) In the exercise of judicial authority, the Judiciary, as constituted by Article 161, shall be subject only to this Constitution and the law and shall not be subject to the control or direction of any person or authority.
(2) The office of a judge of a superior court shall not be abolished while there is a substantive holder of the office.
(3) The remuneration and benefits payable to or in respect of judges shall be a charge on the Consolidated Fund.
(4) Subject to Article 168(6), the remuneration and benefits payable to, or in respect of, a judge shall not be varied to the disadvantage of that judge, and the retirement benefits of a retired judge shall not be varied to the disadvantage of the retired judge during the lifetime of that retired judge.
CHAPTER 15 – COMMISSIONS AND INDEPENDENT OFFICES

Human rights activist Maina Kiai was Sunday morning stopped at the Jomo Kenyatta International Airport by immigration officials who were demanding for his clearance to travel.
It took the intervention of Director of Iimmigration Services Maj-Gen Gordon Kihalangwa to have Kiai cleared to proceed with his trip to Amsterdam.
Kihalangwa said Kiai was not on their watch list and is not a government official to require clearance from any party to leave Kenya.
“It was a routine procedure and concern from an immigration official at the JKIA desk. He was allowed to leave after I talked to him,” said Kihalangwa.

Independent Electoral and Boundaries Commission (IEBC) commissioner Roselyn Akombe was on Wednesday detained by officials at the JKIA shortly before a trip to the US.
The commission said in a tweet the officials apologised for the incident but did not give more details on the incident.
Dr Akombe who is traveling to US for an official meeting was delayed at JKIA by officials who have since apologized. She returns on Sunday,” the tweet read.
Reports indicate that Akombe was removed from the flight and her luggage was offloaded.
But IEBC communications manager Andrew Limo said Akombe was scheduled to travel on Tuesday night to attend an official meeting in New York.
He said JKIA officials were unaware that Akombe is an independent commissioner and demanded clearance.
As a result, Akombe missed her flight and was rescheduled to leave on Wednesday morning.
Akombe is among commissioners who played an active role during the tallying of the August 8 general election results at the Bomas of Kenya.

Umechanganya SRC na rais kama watu wamoja, umesahau kwamba bodi ya SRC pia ni independent commission ambayo ndo bodi imepewa mamlaka ya kuangalia mishahara ya wafanyikazi wa uma.... na bodi hii nayo ikikosea basi mfanyikazi yeyote alie punguziwa mshahara kinyume na sheria anaweza kwenda kotini aregeshewe mshahara ule ule hadi ile siku atafutwa au kujihuzulu.. kulingana na international labor law ambayo kenya ilitia saini.

Katika kutimiza majukumu yake ya kuliletea taifa lake maendeleo, kudhibiti matumizi mabaya ya fedha za nchi, ni miongoni mwa mbinu mojawapo ya kuleta maendeleo, rais anao uwezo wa kuhakikisha matumizi ya pesa za nchi yanaridhisha, yawe yanafanywa na jaji au mbunge au mtu yeyote yule, haiwezekani jaji ajipangie safari ovyo ovyo nje ya nchi bila ushaidi kwamba safari zake hizo ni za kikazi, kila jaji anayetaka kusafiri ni lazima apate approval ya CJ, kama rais haridhishwi na jinsi CJ anavyosimamia fedha wanazopewa, rais anao uwezo wa kumuuliza na kumuomba mkaguzi mkuu wa hesabu akawafanyie auditing japo vyombo vyote hivi, ya mahakama, na Bunge vipo independent, kumbuka independency hiyo ni katika kutimiza yale majukumua yao yalioainishwa kikatiba, lakini bila kuzuia muimili mwengine kufanya kazi yake kikatiba, kazi ya excutive ni kusimamia matumizi bora ya rasilimali za nchi, sasa haiwezikani tena Bunge au Mahakama wawe ni kikwazo kwa serikali isiwahoji pale inapoona wao wanatumia vibaya pesa ya nchi.
