This is so sad, very sad... Imagine kwamba mkataba unatubana kwa miaka 25. Hatuwezi kubadilisha anything, hawa wezi wa CCM need to be captured and prosecuted under Tanzania law.

Hakuna other side of the coin hapa. Facts zimewekwa wazi. Mkataba sio siri tena. Labda cha kuongezea ni kuwa waliouvujisha mkataba WACHUKULIWE HATUA ZA KISHERIA. Takukuru dili hiyo, siri za serikali lazima zilindwe kama katiba inavyolindwa.

Mtuambie mmeutoa wapi huo mkataba?!

I like this. Kama Karamangi anauthority ya kusue kuhusu kuchafua jina letu, why cant Tanzanian sue him against entrapment of non sense contracts? I like this movement.... let see how things will go on his sueing.

THE Minister for Energy and Minerals, Mr Nazir Karamagi, yesterday said that he has directed his lawyers to file a case against Karatu Member of Parliament, Dr Wilbroad Slaa.

Mr Karamagi told reporters at the ministry’s conference room that he has decided to legal action against Dr Slaa and others for accusing him of embezzling public funds.

“I have a reputation to maintain and a name to clear thus I have decided to take legal action against Dr Slaa, Mwanahalisi newspaper and Printek, the printer of the weekly newspaper”, he said.

The minister caused outrage during the press conference after he had initially refused to take any questions from journalists saying that he was there in his personal capacity and not as a minister.

Despite agreeing to take some questions, he still refused to reply to any questions regarding recent reports that the Buzwagi mine contract had many shortfalls including that of omission of an important clause.

He said that he would a different meeting with reporters to talk about ministerial issues next week. On his impending case, he said that he came to the decision after an evaluation of the allegations against him and consultations with his superiors and his lawyers who have not objected to his decision.

According to Mr Karamagi, the suit he expects to file will also aim at seeking justice against all those who did and are still continuing with a campaign to tarnish his image as a citizen of the country and judge him before being taken to court.

“It is not a secret that the allegations by Dr Slaa did not only aim at tarnishing my image but also to portray me as an individual who should not and cannot be entrusted with any leadership role in the society”, he said.

The minister, however, would not say when the case would be opened, in which court and would also not name his lawyers who the nature of the case itself and what exactly he would be demanding.

Baada ya kusoma hiyo habari ninashawishika kukubaliana na Mwanakijiji na Nurujamii kwamba move ya Karamagi ni kujisafisha jina kiaina na hataenda mahakamani.

Kwa mtu makini hawezi kuita press conference kabla hajajua kwamba atashitaki wapi na wanasheria wa kampuni gani ambao wata-handle hiyo kesi yake. Kwa hiyo huyu jamaa aliita press conference kujisafisha na kutishia wengine wanaoendelea kuandika news za kumhusu wasiendelee na ndiyo maana akasema kwamba atawashitaki wale walio fanya hivyo na watakaoendelea kuandika habari za kumchafua. Inawezekana hilo limekuja baada ya kuona Mkataba wa Buzwagi umevuja na kwamba madhambi yake mengi yanazidi kuanikwa. Kitendo cha yeye kusema atawashughulikia na wale watakaoendelea kuandika news za kumchafua inalenga kutishia media house zilizo na news za ziada zisiandike, lakini mahakamani hatakwenda!

Mwanakijiji alisema kwamba huyu jamaa anafanya hayo kwa shinikizo kutoka juu. Nimeshindwa kumwelewa aliposema kwamba ameamua kwenda Mahakamani baada ya consultations na wakubwa wake (superiors), je hao wakubwa wake ni akina nani? JK au EL? Na kwanini a-seek consultation kwa hao wakubwa wake? Hizo ni dalili za shinikizo tu na hiyo gia ya kwenda mahakamani anatuzuga tu!

Hapo ndio mnakosea kwa kutoangalia upande wa pili wa shilingi.
Waliosaini hawana tatizo. Tatizo ni wale walioutoa kwa umma wa wadanganyika!, hawa watu wanahatarisha usalama wa nchi! wanavujisha mikataba ya siri, serikali inaweza kushtakiwa na Barrick, na vigogo wakakosa mkate wao wa kila siku!
 


hapana, kila mkataba husainiwa na mwanasheria wa serikali pembeni. pia hakuna mkataba wowote unaweza kusainiwa bila consent ya rais. ndiyo maana Slaa akawaunganisha rais, mwanasheria mkuu na waziri husika kama victims.
 

Jana nilikuwa ninajiuliza, je huo mkataba unaweza kuwa ulitolewa ili kuongeza shinikizo la Karamagi kujiuzulu mwenyewe pasipo kulazimishwa na mtu? Sikupata jibu. Mikataba ikisainiwa huwa inahifadhiwa wapi na nani yuko responsible kuhifadhi hiyo mikataba?
 

Hapa ndipo watanganyika tunaposhindwa kuonyesha utashi wetu hata pale watu wengine wanapotuonea huruma. Huwezi kunieleza kuwa kwa hali ilivyo sasa ya utata wa mkataba huu na usaini wake, kuna mtu anaweza kija na wazo la kulaumu waliowezesha upatikanaji wa mkataba huu. Labda hatujui tunachokitaka. Mimi nadhani waliotoa mkataba huu wanataka kupima uwezo wetu katika kung'amua mambo na kuchukua hatua.
 

Kwa maelezo haya, lazima kuna mtu atamwaga unga huko serikalini!!!

Vipi mazuri ya serikali yameisha tayari? au!
 
Kwa hali ilivyo ningeshauri Dr. Slaa na kambi ya upinzani waitishe mkutano mapema wiki hii ili umma uonyeshe support yao kwa kuchanga fedha kwa ajili ya kumsupport Dr Slaa na wote waliotajwa kushitakiwa kwa ajili ya utetezi na zichangwe palepale. Halafu litolewe tamko la UMMA kulaani Ufisadi unaofanywa na viongozi.........To me this can help to prove to people like Karamagi and his fellows that, they are trying to defhe iend themselves from the public and not mere single person.

it has been rampantly spread by the bogus contractors and other listed corrupt guys to drag Dr. Slaa to court on the ground that he has defamed them. to me I see no logic over it and perhaps they are using the word defamation to puzzle people who are not aware with this terminology.

Defamation is defined as a statement made towards the plaintiff/complainant which reflect of his reputation so as to loower him in the estimation of the right thinking membersof the societyor which tends to cause the claimant to be shunned and avoided
hence the complainants will be required to prove the following element in order the judgment to be in their side.

1. the statemnet was defamatory,
2. was directed to the plaintful/claimant
3. that there was a publication.

this is what either karamagi or his gangstars try to cover (a shame) without looking what the accused is to prove before the court.

here are some issues that Dr. slaa will be required to show so as to verify that it is not defamation.

1. privellege; there are certain occasions which are so important that those makingstatements upon them are notliable for defamation, even though their statements are untrue and even malicious. here dr. slaa will adhere to quallified prevellege.

qualified prevellege is a statement when although false, it has no element of malice. and here it is the complainant to show that malice exists, something too difficult for these guys.

three statements should co-exist to make it a case of the qualified previlege.

a)there must be a fit occasion to make it a statement
b) statement must be related to the occasion
c)it should be made with proper motive not malice

today the qualified previlleges has been extended to substancial reports of proceedings of administrative tribunals, lical authorities, public inquiries, official register, traders, professional or public meetings and public notices.

Dr. used the same authoritied such as the Auditors, and parliamrntary proceedings.

from all these, it is obvious that Dr. Slaa's judgment is at his hand.

hapo juu ulisema unasubiri website irekebishwe. muda gani itachukua ili tuuone huo mkataba wa buswagi. mbona inageuka kupewa maelezo tu na sio huo mkataba. au wizara imetoa maagizo tena kwamba tusiuone!!
 
Mkataba kama gazetini hapo unaonyesha ukurasa wa kwanza tayari kuna watu wanao. Nafikiri itachukua muda kidogo wataweza kuweka pdf. yake kwani sio wote wenye uwezo wa kufanya hivyo kiulaini lakini Gazeti la Kulikoni wanao ndio sababu unaona hata sahihi zinaonekana ingawaji kwa tabu tabu, lakini ninavyohisi kabla ya Friday tutaona umewekwa.
