Nairobi Governor Evans Kidero and Women Representative Rachel Shebesh will not be charged with assault and creating disturbance respectively.

The High Court on Friday blocked Director of Public Prosecution Keriako Tobiko from pursuing charges against the two.

Justice Isaac Lenaola also ordered that they pursue reconciliation and report back to him within 13 days.

On Wednesday, the DPP wrote to CID boss Ndegwa Muhoro directing that the two be charged following a public altercation on September 6, 2013.

Ms Shebesh had filed a complaint at the Parliament police station claiming that Dr Kidero slapped her.

Dr Kidero also filed a report at the Central police station alleging that it was Ms Shebesh who first hit him in the groin.

He however later apologised to Ms Shebesh, terming his reaction ‘unfortunate' and the incident ‘ugly'.

Where is the law here? Does it mean the DPP has no power to bring forth prosecution against a suspect if the Judge decides that the victim and the suspect can only reconcile yet a law was broken? This is so wrong, If the DPP has a case, the case need to heard else we are in the territory of the law favouring only those with the ear of the judge through the back door!!

The Kenyan justice system is wanting, the case wasn't even heard before the Judge,the law seem not to be applied accordingly. I wonder if the court was in order for blocking a case forwarded by the prosecution. It's more to do with feelings of the Judge than the application of the process of the law. It is so unfortunate that it seems like we adopted systems that we are only good at mimicking.

Mrs.Shebesh, in the name of all women DON'T DO IT. Do not be another statistic just like 99% of Kenyan women. Even if it means losing your political career so be it. People have lost lives in pursuit of what they believe in. I don't wish that on you. Sometimes you have to draw a line. Kidero crossed that line. Remember you are women's representative. What message would you be sending to women if you reconciled out of court? If he was your husband I would try to understand. Just DON'T. Let the law take it's course. Thank you.

I thought you can only be apprehended for assault if the victim files charges, not seen it happening so why is it that the dpp is approving charges?
Btw i elected these two politicians and they have been nothing but a disgrace but thats not to say i welcome the display of dirty linen in courts.
 
there has to be something wrong with shebesh. i thought the judge wanted to save the county image some agony though
based on her desicion to proceed with charges looks she is not working alone.

they failed to work professionally and it all ends up in court me thinks this leads something bigger , lol clamour 4 headlines, and you are right her pride is at stake

The courts have no jurisdiction to stop criminal proceedings and judicial powers of ordering "abitration" are constrained to civil suit and this being a criminal one the Hon. Judge just overstepped his mandate and ought to be investigated............

Theories take us to nowhere. Practical terms advise us that video evidence has deliberately conspired to work against Kidero and sooner than later Nairobians will be heading back to the polls electing another Governor....................unfortunately byelection works in favour of those already in power.....................mwenye nacho ataongezewa tu hakuna namna hapo.

Kidero, if he is smart - I truly doubt he is- he has to apologize in public rather than hiding behind criminal shubbery which can not be substantiated by video evidence. In fact where there is documentary evidence as such therefore oral evidence is not permitted. Kidero can not hide his mischief through unsubstantiated claims of sexual assault..............period.
 
whats the rationale of pursuing this case anyway. What would be the final results? Do you mean you want him jailed for a slap? Then what? Reconciliations has for history been our mode of dispute settlement and in so doing people's relationship could be strengthened and preserved. Not each and every case requires legal battle.

Reconciliation is beter than creating enemity!!
Life is long process, we sometimes cross the lines!!
