2. JURISDICTION OF THE HIGH COURT
OF TANZANIA.
"The Court has unlimited Jurisdiction on
both Civil and Criminal matters within
Tanzania. In addition to the said original
and jurisdiction, the High Court of
Tanzania has an appellate, extended,
revision and supervisory jurisdiction over
subordinate Courts.
Appeals from the High Court are
preferred to the Court of Appeal of
Tanzania which is vested with powers,
authority and jurisdiction of confirming,
reversing or varying any decision made by
the High Court."
Nimeanza kwa quotation toka tovuti ya mahakama kuu just to make my self clear. Kwa maelezo hayo hapo juu na kwa jinsi nilivyofundishwa na lecturer wangu, The High Court has 'unlimited jurisdiction' i.e it has powers & authority to exercise or entertain any matter of any kind, value, nature n.k hapa Tanzania.
Swali langu ni pale ninaposoma baadhi ya hukumu za Mahakama Kuu ya Tanzania na kukuta maamuzi yanayosema "This court has no jurisdiction because the matter in question is political"
Kwa uelewa wangu mdogo ni kwamba Mahakama kuu kwa sasa imecreate exception to the general rule that The High Court has unlimited jurisdiction" Lakini nkitazama katiba yetu ya 1977 inaniambia Mahakama ndio chombo cha mwisho cha utoaji haki katika nchi hii. Je wanaokosa haki katika siasa wakaitafte wapi kama mahakama imejivua wajibu huo?
Wadau nyie mnafikiri haya maamuzi ya Mahakama ni Sahihi? Je kama mahakama haina mamlaka ya kuamua mambo ya wanasiasa je ni sahihi kuamua mambo ya wafanyabiashara, wakulima na wafanyakazi? (High court commercial, land and labour division respectively).
