The Court of Appeal should have quashed and set aside the Judge A.C. Nyerere and invoked its revisionary powers to appraise the terms of deed settlement in order to rule whether the respondent had adhered to its strict terms.

Admittedly, the appellants did not advance their case when individual claims were not attached in their High Court plaint.
