Today, 18 September 2013, Trial Chamber V(a) of the International Criminal Court (ICC), seized with the case The Prosecutor v. William Samoei Ruto and Joshua Arap Sang, issued a special reminder on the importance of witness protection and of possible sanctions for an act or attempted act that is considered an offence against the administration of justice.

Speaking at the beginning of this afternoon's hearing, Presiding Judge Chile Eboe-Osuji stated that "it is an offence against the administration of justice in this Court, pursuant to Article 70 of the Rome Statute, for anyone to do anything intentionally that would amount to corruptly influencing a witness, obstructing or interfering with the attendance or testimony of a witness, or retaliating against a witness for giving testimony in a case before the Court". Article 70 provides that, for such conduct, the Court may impose a term of imprisonment not exceeding five years or a fine.
Judge Eboe-Osuji added that such conduct "may also amount to contempt of Court" and stressed that "any revelation of the identity of a witness whose identity has been protected by this Court amounts to an offence in [the ICC]. So too will any attempt to engage in any such revelation". The Chamber called on everyone inside and outside the Courtroom, as well as members of the press, bloggers, social media members or participants and their websites or other online presence "to desist from doing anything that would reveal or attempt to reveal the identity of protected witnesses or to engage in secondary dissemination of such wrongful and illegal information". The Presiding Judge concluded the special reminder by stating that "such conduct will be investigated and the culprits will be prosecuted".

Mkuu, i thought they are already doing that. Ruto is in the Hague as is Sang. Uhuru's date is yet to come in November. I have not heard anyone of them say they will avoid the process.

Until now,,,almost a month since the commencement of this Hague thing,,,we are
yet to be shown how the deputy president instigated violence,,in the rift valley.


I expected to see receipt of purchases like guns and bows,,,to see real witnesses
who can say on his face,,Ruto's,,that,,,' you sent us to go and kill'.

We wanted,,real,,witnesses who were in those meetings,,that planned killings.

But what we see is,,pure comics,,,,witnesses who cannot be seen.

The ODM is one being constantly named,,in the Hague and the judges by now
knows that the overall leader of this ODM is none other than mr Raila Odinga.


People were very blind or pretended to be,,,they thought that they could
separate William Ruto from the only Odm of 2007,,with an intention of
hanging him alone.

That is why,,,no one needed any miracle,,to defeat them,,,during the last
general elections,,,,for these people,,,hebu ni wachie,,hapo,,,,,

If this case was conducted,,in a professional way,,,by people who were
for pure justice and not taking that political route,,,,it is Raila,,himself
who should be standing,,,along side William Ruto.

But,,,,Koffi Anan,,could not allow,,that.

Another thing,,,,this ICC court is worse than any court i have heard
or seen in my short life i have been in this damning world.

Witnesses giving evidence behind blinds,,at least,,even those
Mullahs court in Afganistan could do better than this ICC joke.

Deputy President William Ruto blames senior State officials for his tribulations at The Hague

Deputy President William Ruto claimed top PNU officials and close confidants of retired President Kibaki fixed him over the 2007 post-election violence that landed him at The Hague.

In a surprise move at the ICC Wednesday, Ruto’s defence team said the officials, two of whom are in top positions in President Uhuru Kenyatta’s Administration, linked him to the election chaos.

Ruto’s counsel Shyamala Alagendra linked Interior Principal Secretary
Mutea Iringo, Senior Political Adviser to President Uhuru Nancy Gitau and former Justice minister Martha Karua to the scheme to nail Ruto.
In President Kibaki’s Government, Ms Gitau served as Director of Political Affairs in the Office of the President while Iringo was Deputy Permanent Secretary, Ministry of Internal Security.

Cross-examination

Ms Alagendra said after the bloodletting that followed the bungled 2007 presidential polls, the three top government officials led the conspiracy that Ruto was the architect of violence that rocked the Rift Valley.

During cross-examination of the third prosecution witness, Alagendra said the officials coached and bribed witnesses who would later testify before the Commission of Inquiry on Post-Election Violence that was led by Justice Philip Waki in August 2008.

“Madam witness, did you hear that some PNU and government officials wanted to link Mr William Ruto to the violence?” Alagendra asked during cross-examination.

And the female witness, who was part of Warembo na Kibaki lobby group that was drumming support for Kibaki’s bid for a second term, replied: “Yes”.

Ms Alagendra: Did you know that they wanted to blame Mr Ruto regardless of the truth?

Witness: Yes

Ms Alagendra: That they wanted to fix him (Ruto) even though he had nothing to do with it?

Witness: Yes

According to Ruto’s defence, the government, in a well-calculated move, went to the North Rift ahead of the Commission of Inquiry on Post-Election Violence that was led by Justice Philip Waki to coach and bribe witnesses. It is the same witnesses, they insisted, that later nailed Ruto before the Waki Commission on August 6 and 7, 2008.

The counsel said that witnesses who testified before the Waki Commission were later taken into a witness protection programme under the watch of Iringo, who was then Deputy Permanent Secretary, Ministry of Internal Security.

“Did you know that for some witnesses who testified or gave a statement to the Waki Commission, the monies for their witness protection was being disbursed by Mutea Iringo and Nancy Gitau?” asked the lawyer. The witness said she was not aware.

President Uhuru Kenyatta retained Ms Gitau and Iringo in his government and both work at Harambee House. The lawyer said those who were involved in the identification of witnesses to fix Ruto were Stephen Tarus, Abraham Limo, Bethwel Rutoand William Rono.

She also revealed that before the Waki Commission landed in Eldoret, a group of lawyers associated with PNU went in advance to take their statements.

Among the lawyers that the counsel identified included
Mr Kamotho Waiganjo, a commissioner in the Commission for the Implementation of the Constitution (CIC), Mr George Morara, Mr Peter Maundu and Mr Njenga Mwangi.

“Madam witness, this group of lawyers that was with Mr Maundu was associated with PNU, is that correct,” asked Ms Alagendra.

And the witness, who is testifying with her face concealed and voice distorted to protect her identity, replied in the affirmative.

The revelations yesterday could be music to the ears of former Prime Minister Raila Odinga and his supporters.

This is because Jubilee leaders have always claimed that Raila and his ODM brigade fueled Ruto’s woes at the
ICC. “I want to confirm to the House that the owners of the ICC have walked out. The owners of the ICC project have walked out,” said Majority Leader Aden Duale in reference to CORD MPs as Parliament voted to sanction Kenya’s withdrawal from the Rome Statute.

Alagendra yesterday said that while ODM was struggling to prove that their presidential victory was stolen, PNU was getting evidence that ODM triggered the bloodshed.

“You will agree with me madam witness that what was happening at the time is that ODM was very eager to show that PNU had rigged the election,” said the lawyer. The witness agreed.

But on Tuesday, the witness had insisted that Ruto was received with hostility and called murderer when he visited internally displaced people (IDPs) at Eldoret showground after the violence.

She said the IDPs believed that Ruto engineered the violence. But according to Ruto’s defence, it was former Vice-President Kalonzo Musyoka and Kibaki who were given a hostile reception at the showground in April 2008. But the witness admitted that there were supporters of President Kibaki in the 2007 election who voted for Ruto as Eldoret North MP.

The witness, identified only as 189, said there were a number of Kikuyus who supported Kibaki for the top job but preferred Ruto as their area MP.

Deputy President William Ruto on Wednesday accused the inner core of former President Kibaki of seeking out witnesses in his case at the ICC.


The plan, his lawyer said, was to fix Mr Ruto as the sponsor of the violence that erupted after the 2007/08 General Election.


Defence counsel Shyamala Alagendra told the court that the plan was carried out by senior officials in the Kibaki administration, lawyers sympathetic to PNU, some of whom, he said, even offered cash and protection to witnesses who would testify against Mr Ruto.


Ms Alagendra listed those in the plan as former Gichugu MP Martha Karua, who was at the time the Justice minister, Mr Mutea Iringo, then the Deputy Permanent Secretary for Internal Security and Ms Nancy Gitau, who was President Kibaki's political affairs director.


The defence said Mr Iringo oversaw a witness protection scheme, which also disbursed cash to those who would testify against Mr Ruto during the Waki Commission hearings.


PNU, Ms Alagendra said, used lawyers Kamotho Waiganjo, currently a member of the Commission for the Implementation of the Constitution (CIC), Mr Njenga Mwangi, Mr Peter Maundu and Mr George Morara, who was in the Vijana na Kibaki lobby group that also included Mr Joseph Njoroge, Mr Evans Gor Semelang'o, Mr Jack Wamboka and Mr Thomas Mbewa.


This group of lawyers, the defence proposed and the witness confirmed, were "associated in some way with PNU" and went to Eldoret in advance of the Waki Commission to procure witnesses who would testify against Mr Ruto. The Waki Commission was in Eldoret between August 5 and 6, 2008.

"What was happening at the time was that ODM was eager to show that PNU had rigged the elections," Ms Alagendra said.


But on the other hand, she said, PNU wanted to demonstrate that ODM was behind the violence that rocked the country.


"In order to demonstrate that ODM was behind the violence they put together a group of people who would assist them locate witnesses to say ODM was the cause. There was a group of people who came to Eldoret. The group was made up of PNU and government officials. PNU was trying to gather evidence that it is ODM that caused the violence," Ms Alagendra posed to the witness, who declined the proposition.


According to the defence, the lawyers and government officials who were identifying witnesses to present to the Waki Commission were assisted by former Cabinet minister Stephen Tarus, Ms Karua, Mr Abraham Limo, Mr Iringo, a Mr Bethwell Ruto and a Mr William Rono.


The defence said the witnesses PNU identified were taken to a witness protection programme which was under Mr Iringo.


Defence: Did you hear that the aim of some PNU officials was to blame William Ruto for the violence?

Witness: Yes.

Defence: Regardless of the truth, madam witness?

Witness: Yes.

Defence: Even though he had nothing to do with it?

Witness: Yes


The defence was cross-examining Witness 189 for the second day yesterday. She is the third prosecution witness since the trials of Mr Ruto and Mr Joshua arap Sang started on September 10.


The defence also sought to dismantle the prosecution's theory that it was only Kalenjin youths who were armed with bows and arrows.


The defence played a video clip of Mr Ruto, former ODM treasurer Omingo Magara and Mr Chris Bichage arriving in a helicopter at Wilson Airport after they were attacked and seriously injured in Nyamarambe, Kisii.


The Nyamarambe incident was dubbed a fundraising meeting which was attended by former minister and Nyaribari Chache MP Simeon Nyachae and Ford People's Henry Obwocha who the defence said had instigated the violence meted out against the then ODM leaders.


The defence said the Nyamarambe incident was a clear demonstration that not only PNU campaigners had been attacked but also ODM campaigners.

It also sought to demonstrate to the court that both PNU and ODM had supporters from all the ethnic groups.


According to Ms Alagendra, the Kibaki Tena lobby group was chaired by Mr Lee Karuri while other officials were Agricultural Finance Corporation boss William Kirwa, Mr John Kipkorir Too, who was in the PNU presidential elections board and coordinated campaigns in the North Rift and Mr Ken Nzioka, who was the PNU director of elections.


Defence: Am I correct to say PNU was reaching out for the vote of every Kenyan?

Witness: Yes.

Defence: PNU wanted the Luhya, Kalenjin, Kisii, Luo votes. Am I right?

Witness: Yes.

Defence: ODM too wanted all the votes?

Witness: Yes.

Defence: That ODM wanted to portray itself as the party of all ethnicities?

Witness: Yes.

Defence: You will agree with me that there were other prominent Kikuyus in ODM?

Witness: Yes.

Defence: Am I right to say that in 2007 it wasn't unusual for an individual to support (President) Kibaki and at the same time support Raila (Odinga)?

Witness: Yes.

A section of Gikuyu Embu and Meru Association (GEMA) leaders have expressed their dissatisfaction over how Deputy President William Ruto is handling the International Criminal Court (ICC) case he is facing at the Hague based court

In a night meeting on Tuesday at a Nairobi hotel, the leaders said they didn’t expect the Deputy President to differ with President Uhuru Kenyatta on the deferment of the Kenyan cases at the ICC.

They said Ruto should have heeded the call of the President and avoid a Press Conference saying this may be the beginning of split of the Jubilee alliance.

Speaking at a press conference at a hotel a stone’s throw from the Hague-based ICC, Ruto said the recent attack on a Nairobi mall had prompted Kenya to call on the UN Security Council to postpone the case for a year.


The Hague, Wednesday. Kenya’s Deputy President William Ruto said today he was committed to his International Criminal Court trial despite calls for it to be postponed, provided he could be excused to “fight terror”.
Speaking at a press conference at a hotel a stone’s throw from the Hague-based ICC, Ruto said the recent attack on a Nairobi mall had prompted Kenya to call on the UN Security Council to postpone the case for a year.
“Kenya has already filed with the UN Security Council for a deferral in the case,” said Ruto, who faces three counts of murder, deportation and persecution for his role in the deadly aftermath of Kenya’s presidential polls in late 2007.
“But more preferably, we would want to ask the court’s decision to grant us excusal from continuous attendance,” Ruto said.
Judges in July ruled that Ruto could be excused from parts of his trial, but suspended that decision a month later after the prosecution appealed.
A ruling on the matter is still pending, but that decision has been overshadowed by the September 21 terror attack and siege of Nairobi’s upmarket Westgate Mall which left at least 67 people dead.
The African Union on Saturday said it would urge the UN to suspend ICC cases against African leaders under an article in the court’s founding treaty, the Rome Statute, which allows for cases to be suspended for up to a year.
The suspension is however linked to the UN Charter’s Chapter VII, which refers to threats against the peace, breach of peace or an act of aggression.
Ruto and Kenyan President Uhuru Kenyatta now “believe that there are legitimate reasons for the deferral of this case -- to give Kenya the best possible chance to handle the serious challenges in our region, the world and our country, the matter of global concern about terrorism.”
“It is... clear that the President of Kenya and myself as his deputy need every space to be able to deal with this challenge, as we pursue the interest of justice,” Ruto said.
“Balancing that interest with our responsibilities to run the country,” he added. (AFP)
Ruto went on trial last month, the highest-ranking serving official to do so before the ICC, on charges of masterminding some of the 2007-8 post-election violence in Kenya that left over 1,000 people dead and several hundred thousand displaced.
Ruto, 46, and Kenyan radio boss Joshua arap Sang, 38, stand accused of stoking the worst violence in the east African country since independence in 1963.
Both Ruto and his one-time foe and now political partner Kenyatta, who also goes on trial on November 12 on similar charges, have pledged their cooperation with the court and are maintaining their innocence. (AFP)
