OTTAWA — Prime Minister Justin Trudeau says Canada will abide by all rulings of the International Criminal Court, after the war crimes tribunal in The Hague issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, his former defence minister, and a Hamas military chief.

The ICC issued the warrants Thursday after the court’s top prosecutor accused Netanyahu, Yoav Gallant and Hamas’s Mohammed Deif of war crimes and crimes against humanity during the months of devastation in Gaza and Lebanon since the Oct. 7 massacre in Israel last year. The court relies on countries that support it to arrest suspects accused of war crimes so they can face trial at The Hague.

At a news conference Thursday in East Gwillimbury, Trudeau said Canada is among the ICC’s founding members and that it is important for all countries to obey international law.

“We stand up for international law, and we will abide by all the regulations and rulings of the international courts,” Trudeau said, when asked if he would allow Netanyahu and Gallant to be arrested if they come to Canada.

“This is just who we are as Canadians,” he said.

The prime minister went on to say the “terrible situation” in the Middle East needs to be resolved. He called for more humanitarian aid to flow, for Hamas to stop fighting and release the remaining Israeli hostages its fighters captured on Oct. 7, and for more progress toward the creation of a Palestinian state alongside Israel.

Netanyahu denied the allegations against him on Thursday, and said Israel ”rejects with disgust the absurd and false actions” by the ICC, calling them “absurd and antisemitic.”

“There is nothing more just than the war that Israel has been waging in Gaza,” he said in a statement.

Gallant also rejected the allegations, stating that the decision “sets a dangerous precedent against the right to self-defence and moral warfare and encourages murderous terrorism.”

While other countries like France and the Netherlands signalled support for the ICC, the United States joined Israel in saying it “fundamentally rejects” the arrest warrants against Netanyahu and Gallant.

“We remain deeply concerned by the prosecutor’s rush to seek arrest warrants and the troubling process errors that led to this decision,” said a spokesperson for U.S. President Joe Biden’s National Security Council.

About 1,200 people were killed and more than 250 kidnapped when Hamas militants stormed into Israeli towns near the Gaza Strip last Oct. 7. In the months since, Israeli has launched devastating airstrikes — including against refugee camps, hospitals and schools — and a ground invasion in the Palestinian territory that Israel first occupied in 1967. Officials in Gaza said Thursday that more than 44,056 people have been killed there and 104,268 wounded.

The United Nations has warned that Gaza residents are facing desperate shortages of essential supplies like water, food, fuel and medicine. In a statement Thursday, UN humanitarian co-ordinator Muhannad Hadi said the “survival of two million people hangs in the balance.”

In response to months of the Iranian-backed group Hezbollah firing rockets into northern Israel from Lebanon, the Israeli military has also launched attacks into Lebanon, where health authorities say more than 3,500 people have been killed.

In its statement on the arrest warrants, the ICC said it determined there are reasonable grounds to conclude that Netanyahu and Gallant “bear criminal responsibility” for Israel’s alleged use of starvation as a method of warfare, murder, persecution and “other inhumane acts.” The court said it found reasonable grounds to believe Netanyahu and Gallant are also responsible as government leaders for intentionally directing an attack against civilians.

The ICC also concluded there are reasonable grounds to believe Deif, the Hamas militant leader, is responsible for the crimes of murder, extermination, torture, rape and other sexual violence, as well as cruel treatment, torture, hostage-taking and “outrages upon personal dignity.”

Israel said in August that Deif was killed by an airstrike in southern Gaza, but the ICC said it was progressing with its arrest warrant while the prosecution continues to gather information about his reported death.

The court also initially considered applications for arrest warrants for two Hamas leaders — Ismail Haniyeh and Yahya Sinwar — who have since been confirmed killed by Israel.

Foreign Affairs Minister Mélanie Joly echoed Trudeau’s comments and said international law must apply to all parties.

“We need accountability in our world and so, based on that, Canada will abide by its obligation under the ICC treaty,” Joly said in Washington.

Late last year, South Africa brought a case to the International Court of Justice (ICJ), alleging Israel is committing genocide against Palestinians in Gaza — allegations the Middle Eastern state has flatly rejected as “blood libel.”

A UN special committee published a report on Nov. 14 that concluded Israel’s war tactics in Gaza were “consistent with the characteristics of genocide,” including through “mass civilian casualties and life-threatening conditions intentionally imposed on Palestinians.”

The Canadian government has called for an end to the violence in Gaza but never endorsed the allegation that Israel is engaged in genocide.

Israel maintains it is justly defending itself against terrorist groups intent on eradicating the country.
