Correction - hiyo clip si ya conspiracy. Ni analysis au pia waweza kuiita hypothesis.

Hiyo clip ya uchakachuaji inahitaji ipitie tanuru la kuithibitisha kama ni ya kweli au la.

Mpaka sasa sina ushahidi wa kutosha kusema kwamba inachoonyesha ndicho kweli kilichotokea.

Well, the Supreme Court is neither infallible nor beyond reproach. It too can make mistakes and people have the right to criticize it and question its credibility.

So in a highly polarized society like Kenya no one is safe from a cloud of suspicion. Therefore, if the Supreme Court's finding were to side with the petitioners, yes, the IEBC's credibility would take a hit.

But best believe that if that were to happen then there would also be those who will impugn the court's decision.

Im simply advocating for what is right.

The probelm right now lies in perception. People are assuming for whatever reasons that this is about
Raila and Uhuru Kenyatta.

If you take a step back you will realise this case is about the People of Kenya Vs IEBC

I had stated my reservations against this body even before the elections were carried out. They
didn't seem in control either by design or by choice. Thats what this petition will show...their
incompetency in carrying out a general election process and creating all these problems Kenya
is facing now.

Just like you said in an earlier post even in the event of a re-run Raila is likely to lose. I believe
that too sir, but at the end of the day lets enjoy seeing a fair fight.

Thats my stand if you wanted to know mkuu mwenzangu.

In a highly politically charged environment (like what Kenya is in now) no matter what happens someone will end up dissatisfied with the election process.

Accusations and counter-accusations will run rampant. That's just the nature of the beast.
 

The Coalition for Reforms and Democracy (CORD) says they are not hurrying to file their petition to contest Uhuru Kenyatta's election as president.
Cord says they still have time, in accordance to the law, to file the petition and are currently preparing water tight evidence to prove their case before moving to the Supreme Court.

The coalition says they have until Monday next week to file the petition, in accordance to the constitution since IEBC announced the results on Saturday.

"The IEBC announced the results on a Saturday which is not a working day and we have up to Monday next week to file our petition," Education Minister Mutula Kilonzo said.

Accompanied by senators-elect James Orengo, Anyang Nyong'o and Migori Women representative-elect Denita Ghati, Mutula accused IEBC of denying them crucial information.

He said it was wrong of IEBC to deny them information saying the act, was a violation of article 35 of the constitution which guarantees all Kenyans right to information.

"We have demanded for certain information from IEBC but it's not forthcoming and there is no explanation as the commission has failed to reply or even acknowledge our letters. We're asking the IEBC to follow the law," Mutula said.

On his side, Orengo said their lawyers were looking for information from IEBC such as the voter register but have been frustrated by the commission who are withholding the information.

"We were denied the right to access several crucial documents by the IEBC. We therefore could not verify some documents," he said.
The two ministers however said the actions by IEBC may end up strengthening their case since the IEBC will be cited for subverting the cause of justice by withholding public information.

The Cord leaders also criticized the police for what they called creating unnecessary tension and anxiety by flying their choppers on the Supreme Court, as word went round that their lawyers were to file the case Monday.

Mutula said Cord was building a strong case which will set a precedent once the Supreme Court rules.

"Our case will show that you cannot rig elections and get away with it and will set a precedent where future cases will be referred to in whoever way the court rules."

Monday, the leaders once again claimed the provincial administration has been instructed to collect form 34, 35 and 36 from agents in the field and tamper with them.

Cord has further put the IEBC to task to explain why they failed to publish the list of registered voters in accordance to the elections act, which now they claim is being tampered with to conform to the results announced at the Bomas of Kenya.

Although, the commission has received accolades from a cross section of groups and Kenyans on the conduct of the March 4 polls, Cord says it will expose fundamental flaws on the election process to prove that the exercise was marred with anomalies.

Cord has summoned all their Women representatives, governors, Senators and MPs-elect to the Kenya school of Monetary Studies in Nairobi on Wednesday, to brief them on their impeding petition.

Cord will be seeking the nullification of the results that handed Uhuru victory in their petition on grounds that Uhuru's votes were inflated.
