The SC verdict has expended the scope of Art.149 in following manner:

  1. Natural resources such as spectrum, oil, gas and minerals- belong to people.
  2. Whenever Union, State, Local bodies or private entities are exploiting natural resources, they’re accountable to people via Parliament.
  3. Although CAG doesn’t have powers to audit any private sector companies under Companies act.
  4. But when private sector is exploiting natural resources under PPP or revenue sharing agreements, every unlawful gain by company is a loss to consolidated fund of India.
  5. Therefore, CAG has right to audit the receipts of private sector companies that share revenue with the government for use of spectrum.

Naweza kukuaibisha vibaya sana. Kwanza kwa ujinga ulionao unasema kwamba serikali inatumia audit report kucalculate tax ilhali hujui kwamba audit report haina all the information required to calculate tax. KRA ikiwa inataka kujua kama kampuni fulani inadanganya huwa wanatembelea kampuni hio na kuitisha various books of account ikiwemo financial statement, P&L account, bank statement, ledgers, cash books, journals, na audit report. Ila audit report pekee haina all the information required kucalculate tax. Na ukinitukana tena mjadala unaisha. Sipendi ujinga wako wa matusi. Unajiona unajua kila kitu wakati hujui lolote. Mambo ya accounting/auditing huwezi kunikingia kifua mjinga wewe.

My friend you are thick upstairs. Sasa unalinganisha private sectors that deal with the natural resources (Public) na zile that deals with real estate? Natural resource is a public resource so the private body that explores it is like an employee employed by the public but in this case he pays himself from the sales of those resources until that day that he scoops all the money he used in the investment. The reason why audit is carried out in those companies is to prevent under reporting of extracted minerals. For the private entities that deals in real estate, they don't have any obligation to full fill apart from paying taxes. So instead of insulting Tony254 I think you should focus more on understanding the difference between public and private sector and different types of private sectors.

Public (govt) auditor anahusiana vipi na private companies? Unaona jinsi wewe ni mjinga halafu unanitukana mimi? Ama unataka nikufafanulie kazi na majukumu ya government auditor?

Kama hujui majukumu ya govt auditor mbona unatukana wenzako?

This guy ananiuliza why a public auditor is not auditing private companies. Sijui ni bangi gani anavuta.

Just think about that for a sec! Kawaida hua inachukua hata wiki kati ya meli kuwasili bandarini na kontena yako kutoka bandarini kuanza safari ya kuja mjini, lakini kwa SGR, ndani ya masaa kumi na moja jamaa wamefanya ofloading from ship, loading to SGR, Scanning and inspection, approval documets kutoka departments tofauti kama KRA, Port Health, KEBS.. etc na wakasafirisha mzigo hadi Nairobi ICD na uko tarari kwa importer kuja kuuchukua! This is some major improvement on efficiency!
