Fake Form 34As are Popping up everywhere Raila may just have a Case

It's about Raila 100%.
The election was that expensive because of Raila and civil society efforts. Particularly the electronic identification and transmission, which they now don't trust after losing.
Form 34As were not even supposed to come to Bomas. IEBC is making allowances for Raila and the civil society.

Over 200,000 forms for all positions, were supposed to be photographed/scanned and sent to the constituency centre and Bomas.
You think involving so many hands would go without glitches?
Dealing with thousands of presiding officers cannot go without numerous human errors. I wouldn't be surprised if a few of them lost the officially provided Form 34As to fill and had to improvise.

And as the observers noted, no election is perfect.

Which organization did you work for to come up with the 30% number?
Observers were scattered in many stations and they gave it a clean bill of health.
Elog alone had observers in over 1000 polling centres (not stations) and they gave it a clean bill of health.

1. Stamping Form 34A is not a requirement in law. Signatures by the officer and agents is enough.
2. Conducting an exercise involving thousands of people will inevitably have many human errors/mistakes.
3. It is foolish to assume that these mistakes were all in the favour of Uhuru Kenyatta.

Read my comments again, I have said in most cases everything was fine even after the poll was closed and even after the counting of votes, the challenge was after the counting, that's where problems raised, And by the way, After the polling closes, Most observers leave, its only in Nairobi that some of the big observers stayed alittle longer and this was out of curiosity esp the foreign observers, But as per iebc rules and even party rules, observers are not expected to stay at one poling station, their work is to constantly move around checking many poling station to confirm that the other polling stations/centers are doing the same thing, outside of Nairobi most observers would just observe the opening of the polling, stay 20Min, go to the next policing center stay 5 min, move to the next like that, then in the shining they will observe closing time, after that, their work was done, they would then leave POs,DPo,Clerks, and party Agents to do the counting... Observers were not involved after closing of polling, Even IEBC official handbook doesnot include desk for observers after polling when the room is rearranged for counting..


Anyway, in those comments you quoted, I never mentioned any plot to rig NASA out, I dint mention anything deliberate or practiced by iebc officials in a particular stronghold, I just said in my own opinion and analysis I would estimate around 30% of the PO's were not properly trained and if anyone were to reopen the ballot boxes in courts they would find so many technical errors that they wouldn't even be able to make a conclusion. But even with all of that, at the end of the day, the court will probably say even with all the mistakes, as long as the party agents signed off on the 32A acknowledging that those were the results, then that would be it

Clearly you did not read Elog report.
They stated that out of 1000+ centres where their observers were, the results announced were the same ones transmitted. They listed these stations.
Don't know how they could accomplish this if their observers left before counting.

But even with the mistakes, this was undoubtedly the most credible election since independence. Of course the country still battles with illiteracy which would explain most mistakes.

Mr.Sam, there is no doubt that Raila has a case , but the question is, does it reach the threshold for a nullification of the election????
The answer is we don't know, the only way we can know for sure is by Raila going to court!

Raila has said he wont go to court bcoz he will get an outcome like the last election, but surely, he must have learnt lessons frm the previous case, if he really had evidence, there is no way the courts can ignore him, besides, he dismissing the point of going to court, he doesn't necessarily have to win, he just has to present the evidence one by one, millions of Kenyans will be watching, Kenyans of all class and level, then and only then will Kenyans like me and you be able to judge for ourselves even b4 the court issues its final judgement... Even the international community might see what Raila is seeing future legitimizing his claims..
But as of right now, Raila to me looks like a sire looser willing to burn every bridge if he is not getting the top seat, only through the court can Raila legitimizes his evidence even if he doesn't win, we will know that indeed this form 32A is genuin, this one is fake, this is the log from the real server, this one is not... Then even if he doesn't win the case, we ourselves will know that what he was claiming, if it was genuine or not,

But if Raila doesn't do that, the only people willing to go with him will be unemployed, probably high school dropouts in Kibera, Mathare and Kondele who don't know how to think for themselves, youth who don't care about anything that is out there, they only care about what BABA will tell us ....

I guess in 14 days we will get to know ....Raila is Going to the Supreme Court to contest the election

Elections in African countries have always been a headache! Those in power think of " how to cling"to power,regardless of what and how they served.On the other hand the opposition think of how to get into power at any cost!

After a tug of war one side must emerge victorious. The looser definately cries " foul" as he stands little chances of "manipulation.

What signals fouls are a few signs like:
1.Res gestae- behaviour that points to guilty after an event connected to an offence ( tempared forms).
2.Conduct (s) before election ( killings, removal of officials ) of the electoral commissions.
3.Ransacking independent observer /tallying stations -to pre-empty counter proof of fraud.
4.Swift and arrogant announcement of purported results to thwart opposition moves against such abuse of democratic processes.

It only helps in most cases when the rulers loose clearly by landslides victory to the opposition that it becomes rather difficult to "mint" the fake results! ( Gambia,Ivory Coast) as case studies. The rest are identical,should not expect much.

Raila started with hacking. When it was proved he forged those log files, he then changed the story to 'Raila is ahead in the IEBC servers'.

We knew that the election will be said to be free, fair and credible only when Raila wins.

Exactly. It starts and ends with Raila.
Even Africog and that Makau Mutua NGO were formed for the single purpose of making Raila president.
But they have hoodwinked Kenyans by blurring the lines between reforms and Raila's win.
I don't even know what Africog does other than file petitions on behalf of Raila.

Yes yes its about Raila. The expensive electronic systems ,the newly reconstituted IEBC ,the court cases about where ballots are tallied ,the case about Al Ghurair printing the ballots - all these are down to one man's endless complaints.

Watched the discussion on JKL on Wednesday night.
The Supreme Court have their job cut out and it is very simple. They will require Nasa to prove that 1.4 million votes (difference between Uhuru and Raila) were added to Uhuru. If Nasa shows the Supreme Court where to deduct these votes, the court will rule that there be a runoff.
You cannot submit 3 faulty Form 34As and expect the court to rule in your favour.

In 2013, the case was very easy for Raila/Cord. All they needed was to show that an extra 7000 votes were added to Uhuru, thereby forcing a runoff.

If in 2013 they were unable to deduct 7000 votes from Uhuru, what are their odds when it comes to 1.4 million votes?

This case is dead on arrival. I am 10001% sure Nasa will lose unanimously and then cry foul that the judges were compromised.
