Personally I don't see any issue here, the amendment is meant for traditional marriages and obviously any woman getting married through those tribal customs knows how primitive they are and must abide by them. How do you convince a Maasai who owns a large herd of cattle not to marry an additional wife. The law is clear for church and civil marriages, but as far as those tribal traditions are concerned, we can't control them, they have their ways of doing things.

Nairobi, Kenya: Women leaders have reacted with anger to the passing of the Marriage Bill by their male counterparts in the National Assembly this week.

The passing of the contentious Bill has been termed an infringement on the rights of women and persons with disabilities.

A section of women legislators accused their male counterparts of being insensitive and ignorant to their plight and that of maginalised persons.

They argued that male MPs ganged up to pass amendments to suit their needs, confirming they are against women's progress.

Nominated Senator Godliver Omondi accused male parliamentarians of using "tyranny of numbers" to deny them a chance to have a say in the marriage institution.

"I am disappointed and annoyed. What the male legislators did is unfair especially to persons with disabilities who are also affected by the Bill," she said.

Nominated Senator Beatrice Elachi also registered her disappointment, charging women gains are being reversed.

She accused Majority Leader Aden Duale of failing to show leadership on the matter and instead resorted religious arguments.

"He should have at least taken a back seat and allowed another lawmaker to champion the changes. His position is taken as that of the Government and by supporting the amendments, women had no way of registering their concerns," she said.

"As much as we must protect our traditions, legalising polygamy is not the way to go. How many women will afford a church wedding to protect their marriage?" she questioned.

"The Muslim colleagues came out strongly to protect their religion, yet our Christian brothers did very little to do the same," she said.

FYI, the luhyas practice this thing my friend. Im not sure where 'well versed in luhya culture' puts you if
you claim that luhyas dont practice this wife inheritance thing.

It's very fair because woman can not handle the marriage responsibilities of two men at the same time! man can do it!
 
the "mpango wa kando" phenomena is very common in kenya.
as far as this matter is concerned,existence or non existence of polygamy law wont affect anything.
 
Good move by Kenyans...Good news for woman as well because allot of women will have someone to fu*k them up....

ndiyo, wanawake wamekuwa wengi kuliko wanaume hata hapa kwetu tanzania wanawake ni wengi kuliko wanaume, nafikiri na hili pia liingizwe kwenye sheria zetu. mimi binafsi naunga mkono hoja ya kulinda haki ya wanawake wote kuwa na waume, hata kama itabidi wachangie wanaume ili mradi tu na wao wapate huduma.

I have lived amongst these people and am one of them. Am telling you first hand information but you choose to believe an article written by a foreign NGO at a time when distrust for NGOs info on Africa is being questioned, good for you.

I do believe you, especially the fact my wife comes from Bunyole. However, most Marachis and Samias have taken after Luo cultures and there are instances of such incidents amongst them.

Na dini siku zote inakuwa 1 tu, nyengine sio dini mana ni za uongo kama nazo ni dini kwanini zimekuwa na mapungufu ya kutokujuwa mwanaume anatakiwa aowe wanawake wangapi? mpaka munaenda kujadili bungeni? Hii ni sawa sawa na wale walioenda Beijing China kudai haki za wanawake wakati haki za wanawake tayari zipo kwenye kitabu kitakatifu cha Quran - kuwa Muislam utafahamu yote haya.
