Staff suspended over Mutunga's JKIA drama

An immigration officer who blocked Chief Justice Willy Mutunga from boarding a plane at Jomo Kenyatta International Airport last week has been interdicted.


The officer had blocked the Chief Justice from travelling to Tanzania until he gets clearance from the Head of Public Service, Mr Francis Kimemia.


The officer's interdiction was part of resolutions of a National Security Advisory Council (NSAC) meeting held on Thursday to deliberate on Dr Mutunga's assertions that his life is in danger.


The Council also ordered Attorney General Prof Githu Muigai, Director of Public Prosecution Keriako Tobiko and Inspector General of Police David Kimayio to launch investigations on the alleged threats to Dr Mutunga's life.

The samburu do that because of tradition and mutunga does that because of relgion, ever heard of moral code, Raila is going home so there is no question about that. let him bask in the glory of stirring controversies left right or centre, but days are counting where history will be made and kenyans will make their decision.

This has been done without thinking, hata kwenye event of run-off mutunga does not come in until the run-off is complete. It is speculative to anticipate any court action, before the election has been done. NAIROBI, Kenya, Feb 22 – Cabinet Minister Otieno Kajwang now says that the immigration officer in the middle of the airport saga involving the Chief Justice has not and will not be suspended, contrary to assertions by government spokesman Muthui Kariuki.
Kajwang told journalists in his office on Friday that the officer would not be used as a scapegoat for a crime he did not commit, instead shifting the blame to Head of Civil Service, Francis Kimemia.

The minister accused Kimemia of issuing a blanket directive on who required State clearance, adding that it would be unfair for the official to be forced to take the heat.

The officer is said to have attempted to stop Mutunga from travelling to Dar-es-Salaam, Tanzania last Thursday, on grounds that the CJ did not have Kimemia’s clearance.

“My officer interpreted that circular the way it should have been interpreted. The person who wrote that circular is the one who should be blamed and he should stop politicising this issue,” he said.

The circular mentions Permanent Secretaries, Chairpersons and Members of Constitutional Commissions, Holders of Independent Offices and Chairpersons, Board Members and Chief Executive Officers of state corporations as those that should seek Kimemia’s clearance.

Capital FM News has seen another circular that has additions with a pen at the bottom exempting the Chief Justice and the Speaker of the National Assembly from the requirement.

“I have not seen the circular that mentions the CJ and Speaker,” said Kajwang.

He added that Kimemia should not have interdicted the officer to facilitate investigations, because he was not mandated to do so.

“Why should my officer be suspended? What crime has he committed? And if you want to suspend my officer, tell me; don’t do it by the roadside. Public servants are employed by the public service commission not by some amorphous security body,” he retorted.

Kajwang also took a swipe at Kimemia accusing him of embarrassing the government. He urged the Head of Civil Service to seek his office’s guidance before issuing such circulars.

“I was not aware of that circular because I would have advised that we make it clear. The government has different arms and you cannot make the Executive a supervisor of other arms of government,” he argued.

Attorney General Githu Muigai has also joined the debate saying he will formulate a policy setting out guidelines for international travel for chairmen of Constitutional Commissions and Independent office holders.

Muigai who spoke after meeting the chairmen of constitutional commissions and independent offices said that the framework will ensure that they only notify their line ministers of their travel.

Commission Chairmen, will however be required to clear their commissioners and members of staff who are travelling out of the country.

The policy is expected to remove immigration officials at the airports from the chain of those who are to be notified.

Mutunga attended Ithookwe Primary School before proceeding to Kitui School for his Kenya Certificate of Education exams. He was the first student to score six points in the exams (an "A" in all subjects), earning him a place at the Strathmore College for his "A" levels. Mutunga received a Bachelor of Laws degree from the University of Nairobi in the 1970s and a Master of Laws from the University of Dar es Salaam.[SUP][2][/SUP] Mutunga joined the law faculty at the University of Nairobi as a lecturer,[SUP][2][/SUP] becoming the first indigenous Kenyan to teach constitutional law at the university level.[SUP][3][/SUP] In the late 1980s, he received his Doctorate of Laws from the Osgoode Hall Law School at York University in Toronto.[SUP][4][/SUP]


As a law lecturer at the University of Nairobi in the 1970s and 1980s, Mutunga's activism was associated with a small but determined group of academics who identified with Marxist / Socialist ideologies, including Ngũgĩ wa Thiong'o, Al-Amin Mazrui, Kamonji Wachira, and Maina wa Kinyatti. On 19 April 1972, this group formed the University Staff Union (USU).[SUP][7][/SUP] Mutunga became the general secretary of USU in 1979, months after Daniel arap Moi succeeded Jomo Kenyatta as president and began tightening his grip on power. Mutunga immediately rallied other USU officials around a campaign for the reinstatement of Prof. Ngũgĩ wa Thiong'o to his former job of teaching English and Literature at the University of Nairobi. Ngũgĩ was incarcerated by the Kenyatta government in December 1977, and although he was released in December 1978, he never returned to his job. Police arrested Mutunga on 10 June 1980, and USU was banned on 19 July 1980.[SUP][8]

Mutunga's arrest threw light on the activities of a seemingly burgeoning Kenyan underground in the dark 1980s. He was accused of being a member of the underground group known as the December Twelve Movement and of participating in the production of the movement's publication, Pambana. The police alleged they had found stamps used for mailing Pambana after searching Mutunga's house. On 12 June 1982, he was charged in court of being in possession of a "seditious" leaflet bearing the headings "J. M. Solidarity Day" and "Don't Be Fooled: Reject these Nyayos". On 29 July 1982, he was detained, just three days before the 1 August 1982 abortive coup by the Air Force. He was also dismissed from his University of Nairobi job.[SUP][2][/SUP]
